A Resolution amending a Special Use Approval to permit a public car wash at 5795 South
Dixie Highway, within the TODD Light Industrial ITODD-U4" zoning use district.
BACKGROUND:
Pursuant to Section 20-3.4(A) & (B) of the Land Development Code (LDC) the applicant,
Auto Body Experts, LLC, is requesting special use approval to operate a car wash open to
the public at the above referenced location. On January 6, 2009 the applicant received
special use approval for an automobile repair and body shop with a car wash as an
accessory use, at this location [Resolution 05-09-12814]. Pursuant to the resolution, the
car wash facility could not be expanded or opened to the general public as a full car wash
business. In order for the applicant to open the car wash service to the public, an
amendment to the original resolution approving the business was required.
5T AFF ANALYSIS:
Located in the TODD (U-4) zoning district, the use of the proposed automobile car wash
is a use that is permitted in the district via special use approval. As shown on the attached
site plan, two (2) car wash bays and two (2) lift centers under an unenclosed canopy
structure are located towards the center of the property. Considered to be accessories to
the main automotive repair use, a modification to the 2009 special use approval would
allow the car wash facility to be open to the general public, no longer making it an
accessory use.
In anticipation to opening the car wash service to the public, the applicant has obtained
approval from the Miami-Dade County Water and Sewer Department for the operation of
the existing car wash facility. It is important to note that the existing and facility utilizes
hand washing techniques only, and will not be an automated drive thru. Furthermore, no
expansion of the car was wash service is being proposed with this application.
As shown in Figure 1, the owner lists the entire property as 5795 S. Dixie Highway, where
the Property Appraiser shows that the property is divided into two (2) individual lots, 5795
South Dixie Highway, and 5786 Progress Road, with the proposed car wash being located
on the former property.

Please note that the location of an automobile repair-body shop and car wash facility in the
Progress Road industrial area are compatible uses for the area and will not be detrimental
to the neighborhood. Also, this application does not conflict with the city's
Comprehensive Plan.
CONCLUSION:
After review of the proposed amendment, it was found that the requested special use
complies with the LDC requirements set forth for special uses in Section 20-3.4 and the
proposed use meets the conditional requirements set forth in Section 20-5.8 in that the
use:
a) Will not adversely affect the health or safety of persons residing or working in the
vicinity of the proposed use,
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and,
c) Complies with all other applicable Code provisions.
Furthermore, the requested special use also complies with the LDC requirements set forth
in Ordinance #15-14-2193 which recently amended Section 20-3.4(B)(1 0). Last, at its June
10, 2014 Planning Board meeting, the Board unanimously recommended approval for the
application after a public hearing was held on the item.

RECOMMENDATION:
The requested special use approval for a car wash at this location complies with the LDC
requirements set forth for special uses in Section 20-3.4 and the conditional use
requirements set forth in Section 20-S.B. Therefore, approval of the application is being
recommended at this time with the following conditions:
(1) The applicant agrees that the carwash facilities will remain a hand washing operation
and will not be expanded nor automated. Any proposed expansion or automation will
require a re-review and amendment to the application, and a re-review by Miami
Dade County water and sewer.
(2) The applicant shall apply for a City business license to operate a car wash open to the
public.
(3) Vehicles accessing the facility shall not be stacked on Progress Road or impede traffic
movements. Should it be determined that the carwash operation is creating a traffic
problem in the area, the business will be required to provide the City with a traffic
study and mitigate the problems associated with the operation.
(4) If the proposed use, in the future, is determined by the Director of Planning, to be
adversely affecting the health or safety of persons residing or working in the vicinity of
the proposed use, to be detrimental to the public welfare or property or improvements
in the neighborhood, or to be not in compliance with other applicable Code
provisions, the special use approval may be modified or revoked by the City
Commission upon notification and public hearing.

8 WHEREAS, pursuant to Section 20-3.3(D) and Section 20-3.4(A) of the Land Development
9 Code (LDC), Auto Body Experts USA, LLC has submitted Planning Board Application No. PB-14-007
10 requesting a modification to a previous Special Use Approval to operate a carwash open to the public, at
11 5795 S. Dixie Highway located in the "TODD(LI-4) Zoning District."; and

13 WHEREAS, on January 6, 2009, the City Commission approved a special use to operate an
14 automotive repair and body shop, with a carwash as an accessory use at 5795 South Dixie Highway by
15 Resolution No. 05-09-12814; and

17 WHEREAS, the hand carwash was approved for the washing of vehicles being repaired at the
18 facility only; and

20 WHEREAS, the applicant proposed to continue this use, but would like to open the hand
21 carwash service to the general public, necessitating an amendment to the previous approval; and

23 WHEREAS, a carwash is allowed in the "TODD(LI-4) Zoning District." as a special use subject
24 to meeting general conditions specified in LDC Section 20-5.8 and subject to meeting special
25 requirements set forth in LDC Section 20-3.4(B)(10) as amended by Ordinance #15-14-2193; and

27 WHEREAS, the approval of a special use requires a recommendation from the Planning Board
28 and the approval of the City Commission after a public hearing; and
29
30 WHEREAS, at its June 10, 2014 meeting the Planning Board, after public hearing, voted 6 ayes
31 0 nays to recommend approval with staffs conditions of the special use Application No. PB-14-007; and
32
33 WHEREAS, the Mayor and City Commission of the City of South Miami desire to accept the
34 recommendation of the Planning Board.

36 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
37 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:

ORDINANCE No. 15-14-2193
An Ordinance amending Section 20-3.4(B)(10)(a), (b) and (c) of the City of
South Miami Land Development Code concerning special uses to clarify
the conditions required for car washing operations.
WHEREAS, Section 20-3.4 (8) (10) sets forth the conditions for "AUTO WASH
OPERATIONS" and subsection (a) requires that all such uses "shall be conducted in a fully
enclosed structure"; and
WHEREAS, the condition requiring a fully enclosed structure prevents the use of
automated and un-automated car washing operations in the City of South Miami, in spite of the
fact that the City has authorized such uses in the past; and
WHEREAS, the current automated operations in the City are conducted in structures
that only have three sides with an opening at both ends to allow vehicles to be driven or pulled
through the washing operation; and
WHEREAS, an automated car wash has mechanical parts and there is a rational basis
for requiring that it be contained within a structure and that it be located at least 100 feet from a
residential district due to the noise generated by such operations; however, a hand car washing
operation does not create any significant noise and there does not appear to be a rational basis
to require such operations to be contained within a structure or restricted to a set distance from
a residential district; and
WHEREAS, an automated car wash usually has vehicles stacked up waiting to enter the
car wash structure; whereas, a hand car washing operation does not require such an assembly
line for its operation since vehicle do not need to enter and travel through a set line of
operations; and
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Section 20-3.4 (8)(10)(a) of the City of South Miami Land Development Code
is hereby amended to read as follows:
(10) AUTO WASH OPERATION
(a) All such uses involving an automated car washing operation shall be conducted
in a fu.#y enclosed structure enclosed on three sides.
(b) All such uses involving an automated car washing operation shall have storage
lanes adequate to accommodate four (4) vehicles for each bay.
(c) No such use involving an automated car washing operation shall be located less
than one hundred (100) feet from any residential district.
Section 2. Codification. The provisions of this ordinance shall become and be made
part of the Code of Ordinances of the City of South Miami as amended; that the sections of this
ordinance may be renumbered or re-Iettered to accomplish such intention; and that the word
"ordinance" may be changed to "section" or other appropriate word.

Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.
However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances,
that give the appearance of being in conflict when the two ordinances can be harmonized or
when only a portion of the ordinance in conflict needs to be repealed to harmonize the
ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby
amended to harmonize the two ordinances. Therefore, only that portion that needs to be
repealed to harmonize the two ordinances shall be repealed.
Section 5. Effective Date. This ordinance shall become effective upon enactment.
