BACKGROUND: Pursuant to Section 20-3.4(B)(4)(b) of the land Development Code (lDC) the applicant is requesting Special Use Approval to locate a general restaurant at the above referenced location. This proposed use is located in the "SR" Specialty Retail, "HD-OV" Hometown District Overlay zoning district which allows restaurants if approved through the special use process. The location of the restaurant will be within the Shops at Sunset Place at the first level and will front SW 57th Avenue (Red Road). The existing retail space that fronts the interior courtyard of the Shops along Banyan Court is being subdivided, with the rear 1,400 square feet allocated to Jimmy John's Gourmet Sandwiches. (Figures 1 & 2). Figure 1. THE SHOPS AT SUNSET PLACE Jimmy John's SW 57th Avenue (Red Road) Special Use -Jimmy John's Restaurant 5701 Sunset Drive; Unit C11D June 17, 2014 Page 2 of 3 This restaurant has focus on delivery by bicycle, but as noted in the proposed floor plan A-1, some interior seating is provided for patrons. The City's Public Works and Planning Department will work with the applicant to locate bicycle racks in this general area where pedestrian access is not impeded. On April 1, 1997, the City Commission approved Resolution No. 64-97-10035, allocating the Shops at Sunset Place a total of 61,250 square feet of restaurant space. Parking calculations were based on these space allocations for all the uses in the Shops. With the addition of the 1,400 square feet for Jimmy John's, the total restaurant square footage at the Shops is 44, 723 square feet; area remaining for restaurant use is 16,528 square feet. The requested special use complies with the lDC requirements set forth for special uses in Section 20-3.4 and the proposed use meets the conditional requirements set forth in Section 20-5.8 in that the use: a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use, b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and, c) Complies with all other applicable Code provisions. This application does not conflict with the Comprehensive Plan. The lDC provides that special uses must be approved by the City Commission after a public hearing and receipt of a recommendation from the Planning Board. The overall purpose is to determine the compatibility of the proposed use with the surrounding neighborhood. RECOMMENDATION: At the June 10, 2014 Planning Board meeting and following a public hearing, the Board voted 6-0 to recommend approval of the special use application PB-14-006. All such establishments shall provide only inside or patio service on private 25 property. Public streets, rights-of-way, sidewalks and required setbacks may not be 26 used for patio or street-side services of any kind. 27 ii. No services of a drive-in or of a fast food nature shall be permitted. 28 iii. Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution.
