A Resolution for special use approval to permit a general restaurant at 5701 Sunset
Drive, Shops at Sunset Place Unit C11 D, within the Specialty Retail "SR", Hometown
District Overlay "HD-OV".
BACKGROUND:
Pursuant to Section 20-3.4(B)(4)(b) of the land Development Code (lDC) the applicant
is requesting Special Use Approval to locate a general restaurant at the above
referenced location. This proposed use is located in the "SR" Specialty Retail, "HD-OV"
Hometown District Overlay zoning district which allows restaurants if approved
through the special use process. The location of the restaurant will be within the Shops
at Sunset Place at the first level and will front SW 57th Avenue (Red Road). The existing
retail space that fronts the interior courtyard of the Shops along Banyan Court is being
subdivided, with the rear 1,400 square feet allocated to Jimmy John's Gourmet
Sandwiches. (Figures 1 & 2).

This restaurant has focus on delivery by bicycle, but as noted in the proposed floor plan
A-1, some interior seating is provided for patrons. The City's Public Works and Planning
Department will work with the applicant to locate bicycle racks in this general area
where pedestrian access is not impeded.
On April 1, 1997, the City Commission approved Resolution No. 64-97-10035, allocating
the Shops at Sunset Place a total of 61,250 square feet of restaurant space. Parking
calculations were based on these space allocations for all the uses in the Shops. With
the addition of the 1,400 square feet for Jimmy John's, the total restaurant square
footage at the Shops is 44, 723 square feet; area remaining for restaurant use is 16,528
square feet.
The requested special use complies with the lDC requirements set forth for special
uses in Section 20-3.4 and the proposed use meets the conditional requirements set
forth in Section 20-5.8 in that the use:
a) Will not adversely affect the health or safety of persons residing or working in
the vicinity of the proposed use,
b) Will not be detrimental to the public welfare or property or improvements in
the neighborhood; and,
c) Complies with all other applicable Code provisions.
This application does not conflict with the Comprehensive Plan.
The lDC provides that special uses must be approved by the City Commission after a
public hearing and receipt of a recommendation from the Planning Board. The overall
purpose is to determine the compatibility of the proposed use with the surrounding
neighborhood. Any exterior modifications or signage for this business will require a

separate ERPB application for review and approval, prior to the issuance of a building
permit.
RECOMMENDATION:
At the June 10, 2014 Planning Board meeting and following a public hearing, the Board
voted 6-0 to recommend approval of the special use application PB-14-006.

8 WHEREAS, pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC),
9 the applicant, JJ Marauders, LLC submitted Application No. PB-14-006 to the Planning Board
10 requesting a Special Use Approval to operate a general restaurant located at 5701 Sunset Drive,
11 Shops at Sunset Place Unit C11D, within the Specialty Retail "SR", Hometown District Overlay
12 "HD-OV" zoning district; and

14 WHEREAS, the applicant proposes to take over a portion of an existing vacant space
15 that will front on SW 57th Avenue (Red Road); and
16
17 WHEREAS, restaurants are permitted as a special use within the Specialty Retail "SR",
18 Hometown District Overlay "HD-OV" zoning district and is subject to meeting general
19 conditions specified in LDC Section 20-5.8 and subject to meeting special use requirements set
20 forth in LDC Section 20-3 A(B)( 4 )(b); and

22 WHEREAS, the applicant's restaurant special use meets the special use requirements set
23 forth in LDC Section 20-3A(B)(4)(b) which are
24 i. All such establishments shall provide only inside or patio service on private
25 property. Public streets, rights-of-way, sidewalks and required setbacks may not be
26 used for patio or street-side services of any kind.
27 ii. No services of a drive-in or of a fast food nature shall be permitted.
28 iii. The city commission shall review and recommend approval, disapproval or
29 modification of all site plans and project specifications for this special use permit; and
30
31 WHEREAS, the approval of a special use requires a recommendation from the Planning
32 Board and the approval of the City Commission after a public hearing; and
33
34 WHEREAS, at the June 10, 2014 Planning Board meeting, and following a public
35 hearing, the Board reviewed application PB-14-006 and voted 6 ayes, 0 nays to recommended
36 approval of the request for a special use to operate a restaurant; and
37
38 WHEREAS, the City Commission desires to accept the recommendation of the Planning
39 Board.

41 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
42 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:

District Overlay "HD-OV" zoning district is hereby subject to the
following terms and conditions as well as all applicable City ordinances, codes, rules and
regulations:
(1) Adhere to the Special Conditions applicable in Section 20-3.4(B)(4)(b)
General Restaurant and Section 20-5.8 Special Use Approval of the Land
Development Code.
(2) All signage for the new establishment is subject to review and approval by
the Environmental Review and Preservation Board (ERPB).
(3) Any and all exterior renovations or modifications are subject to review
and approval by the ERPB.
(4) The Public Works and Planning Departments' will provide the applicant
with locations for the installation of bicycle racks along SW 57th Avenue
that does not impede pedestrian access.
(5) If the subject restaurant is determined by the Planning and Zoning
Director in the future, to be adversely affecting the health or safety of
persons residing or working in the vicinity of the proposed use, or to be
detrimental to the public welfare or property or improvements in the
neighborhood, or not be in compliance with other applicable Code
provisions, the special use approval may be modified or revoked by the
City Commission upon notification and a public hearing.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon
approval by the City Commission.
