A Resolution relating to a request pursuant to Section 20-3.4 of the City of South Miami
Land Development Code for Special Use Approval to permit an automobile repair facility
at within the GR -General Retail zoning use district.
BACKGROUND
The applicant is requesting a Special Use Approval to operate an automotive repair facility at the
BP Service Station located at 6350 South Dixie Highway. On February 5, 2013, following a
public hearing, the City Commission approved an amendment to the Section 20-3.3(D) of the
land development code permitting automobile repair as a special use within the GR-General
Retail zoning use district (Ordinance no. 7-13-2154). The applicant currently operates an
automotive repair facility at 6360 South Dixie Highway, adjacent to the proposed subject
property (Figure 1).

This proposed location at the BP Service Station was once licensed as an automotive repair
facility, however the activity had ceased and the license expired. The applicant proposes to
expand their automobile repair to the service bays at this location. This use is limited to
automobile service and repair only; an auto body repair facility is not permitted at this location.
REGULATIONS APPLICABLE:
Section 20-3.4(A) of the LDC provides that special uses must be approved by the City
Commission after a public hearing and receipt of a recommendation from the Planning Board.
The overall purpose is to determine the compatibility of the proposed use with the surrounding
neighborhood.
A proposed special use must comply with the general special use requirements set forth in
Section 20-5.8 which state that the use: (a) will not adversely affect the health or safety of
persons residing or working in the vicinity of the proposed use; (b) will not be detrimental to the
public welfare or property or improvements in the neighborhood; and, (c) complies with all other
applicable Code provisions.
STAFF OBSERVATIONS:
1. The applicant's letter of intent states in part that they will " ... open the repair bays at the
BP gas station to perform light auto repairs to serve the residents and businesses in the
area"
2. The existing structure is a one story BP gas station with two service bays and an
automatic car wash, at the comer of SW 63rd Avenue and South Dixie Highway. Each
service bay can accommodate one vehicle. The car wash will remain in operation.
3. The proposed use is located adjacent to an existing automobile repair facility (Dixie
Auto) that has been at that location for approximately 30 years. The surrounding area
consists of commercial/retail, institutional uses and multi-family (Figure 2).

4. Parking is available at the rear of the property, along SW 78 Street.
RECOMMENDATION:
The proposed use will not adversely affect the health, safety of persons working or residing in
the vicinity; will not be detrimental to property in the neighborhood; and complies with all other
applicable Code provisions. The Planning Board at their April 8, 2014 regular meeting and
following a public hearing, made a motion to recommend approval of the special use request as
presented by a vote of 5 ayes; 0 nays. Staff recommends that the special use application for an
automobile repair facility at 6350 S. Dixie Highway be approved with the following conditions:
1) Automobile repair work shall be conducted inside the service bays.
2) Automobiles under repair shall be stored inside the service bays.
3) If the subject auto repair facility is, in the future, determined by the Director of
Planning & Zoning, to be adversely affecting the health or safety of persons residing
or working in the vicinity of the proposed use, to be detrimental to the public welfare
or property or improvements in the neighborhood, or to be not in compliance with the
special use permit or other applicable Code provisions, may be modified or revoked by
the City Commission upon notification and public hearing.

8 WHEREAS, pursuant to Section 20-3.4 of the Land Development Code (LDC), the
9 applicant, Dixie Auto Service, Inc. submitted Application No. PB-14-003 to the Planning Board
10 requesting a Special Use Approval to operate an automobile repair facility located at 6350 South
11 Dixie Highway, within the General Retail "GR" zoning use district; and
12
13 WHEREAS, the applicant currently owns and operates an automobile repair facility at
14 the abutting location at 6360 South Dixie Highway and wishes to expand to the existing BP
15 Service Station located at 6350 South Dixie Highway to perform light auto repairs; and
16
17 WHEREAS, auto repairs used to be performed at the service station, however the use
18 was discontinued and the applicant wishes to reactivate that use; and
19
20 WHEREAS, the approval of a special use requires a recommendation from the Planning
21 Board and the approval of the City Commission after a public hearing; and
22
23 WHEREAS, at the April 8, 2014 Planning Board meeting, and following a public
24 hearing, the Board reviewed application PB-14-003 and voted unanimously to recommended
25 approval of the request to operate an automobile repair facility; and
26
27 WHEREAS, the City Commission desires to accept the recommendation of the Planning
28 Board.

30 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
31 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:

33 Section 1: Special Use Application (PB-14-003) submitted by applicant Dixie Auto
34 Service, Inc., for approval to operate an automobile repair facility located at 6350 South Dixie
35 Highway at the existing BP Service Station, within the General Retail "GR zoning use district is
36 hereby subject to the following terms and conditions as well as all
37 applicable City ordinances, codes, rules and regulations:

39 (1) Automobile repair work should be conducted inside the service bays.
40 (2) Automobiles under repaIr should be stored inside the service bays.
41 (3) Auto body repairs are not permitted within this zoning use district and are not a part of
42 Application PB-14-003.
43 (4) Any proposed signage for the new establishment is subject to review and approval by the
44 Environmental Review and Preservation Board (ERPB).
45 (5) Any and all exterior renovations or modifications to the existing structure are subject to
46 review and approval by the ERPB.

Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon
approval by the City Commission.

An Ordinance amending Section 20-3.3(D) of the City of South Miami's Land Developmcnt
Code to allow automobile repair work as a special lise in the GR and TODD 1,1-4 Zoning
Districts.
WHEREAS, at one time automotive repair facilities were authorized in the OR zoning district, and
currently thcre is an existing automotive repair shop that is now a non-conforming use; and
WHEREAS, the adjoining service station also had automotive repair as a service to their patrons; and
WHEREAS, the automotive repair facility located at 63.60 South Dixie Highway would like to reestablish
the use of the empty repair bays at the adjacent service station; and
WHEREAS, it would not be necessary for any additional construction to either facility; and
WHEREAS, the special use approval process, with their built in safeguards, would provide protection
against detrimental effects of the use within inappropriate locations in the district.
WHEREAS, on January 10,2013 following a public hearing, the Planning Board voted unanimollsly to
recommend approval oftlle amendment by adding a new permitted llse within the OR zoning district; and
WHEREAS, although Automobile Repair and Body Shop is a special use within the TODD LI-4 zoning
district, the Planning Board felt "Automobile Repair" should be added to the TODD LI-4 zoning district for
consistency.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA:
Section 1: Section 20-3.3(D) of the City of South Miami's Land Development Code shall hereby be
amended to read as follows:

Section 2: Codification. The provisions of this ordinance shall become and be made part of the Code of
Ordinances of the City of South Miarni as amended; that the sections of this ordinance may be renumbered or
re-Iettered to accomplish such intention; and that the word "ordinance" may be changed to "section" or other
appropriate word.
Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason
held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the
remaining pOl1ions of this ordinance.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of
sections of ordinances in direct conflict herewith are hereby repealed. However, it is not the intent ofthis section to
repeal entire ordinances, or parts of ordinances, that give the appearance of being in conflict when the two
ordinances can be harmonized or when only a portion of the ordinance in conflict needs to be repealed to harmonize
the ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby amended to
harmonize the two ordinances. Therefore, only that portion that needs to be repealed to harmonize the two
ordinances shall be repealed.
Section 5. Effective Date. This ordinance shall become effective upon enactment.

An Ordinance amending Section 20-3.3(E) of the City of South Miami Land Development Code
concerning outdoor seating and dining requirements for all commercial properties, except for
properties in the RO -Residential Office zoning district.

A Resolution related to a request pursuant to Section 20-3.4 of the City of South Miami
Development Code for Special Use Approval to permit an Automobile Repair facility within the
GR -General Retail zoning use district.
A Resolution authorizing the City Manager to enter into a multi-year contract with West
Publishing Company a subsidiary of Thomson Reuters to provide the Police Department with
Investigative Database Support.
