161 ORDINANCE NO. ______ _ 2 3 An Ordinance amending the Land Development Code, Section 20-6.1 4 (B)(2)( d) changing the time of the Planning Board meetings. 5 6 Whereas, the Land Development Code provides in Section 20-6.1 (B)(2)(d) that the 7 Planning Board meetings shall take place at 7:30 p.m.; and 8 9 Whereas, the City of South Miami (Athe City@) has changed its commission meetings to 10 7:00 p.m.; and 11 12 Whereas, the Planning Board has requested that its meetings commence at 7:00 p.m. 13 NOWTHEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 14 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 15 Section 1: Section 20-6.1 (B)(2)(d) of the City of South Miami's Land Development 16 Code is hereby amended as follows: 17 20-6.1 -Administrative entities. 18 * * * * 19 20 21 (B) (2) Planning Board. * * * Organization. 22 * * * 23 (d) The Planning Board shall hold regular meetings at times set by the Board but no 24 earlier than 6:00 p.m. and no later than 8:00 +;W p.m., on the second and last Tuesday 25 of each month with the exception of the months of June and July. The Planning Board 26 shall hold one (1) regular meeting at 7:3Q p.m. on the third Tuesday of June and 27 second Tuesday of July. Meetings need not be held if there are no scheduled agenda 28 items. All regular meetings shall be held at City Hall. 29 Section 2: Codification. The provisions of this ordinance shall become and be made 30 part of the Code of Ordinances of the City of South Miami as amended; that the sections of this 31 ordinance may be renumbered or re-Iettered to accomplish such intention; and that the word 32 "ordinance" may be changed to "section" or other appropriate word. 33 34 Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is 35 for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding 36 shall not affect the validity of the remaining portions of this ordinance. 37 38 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all section 39 and parts of sections of ordinances in direct conflict herewith are hereby repealed. However, it is Page I of2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 not the intent of this section to repeal entire ordinances, or parts of ordinances, that give the appearance of being in conflict when the two ordinances can be harmonized or when only a portion of the ordinance in conflict needs to be repealed to harmonize the ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby amended to harmonize the two ordinances. Therefore, only that portion that needs to be repealed to harmonize the two ordinances shall be repealed. Section 5. Effective Date. This ordinance shall become effective upon enactment.
