BACKGROUND: On December li\ 2013, an application for Waiver of Plat was filed by the owner of the property, Mario Fernandez & Vanessa Turner-Fernandez, in order to divide one existing single family residential parcel located at 6250 SW 67 Avenue into two single family lots as described below. The property currently has a one story single family residence fronting SW 67 A venue and a tennis court to the rear of the structure. The applicant intends to split the lot at the rear of the existing structure and maintain the existing horne. The existing tennis court will remain and be a part of the newly created lot fronting SW 67 Court, where the applicant intends to construct a new one story single-family residence. The complete legal description is contained in the survey prepared by Manuel Felipe (Professional Land Surveyor) and attached as reference. ANALYSIS: The proposed waiver of plat is intended to create two single residential properties (parcels "A" and "B"), zoned RS-3 "Low Density Residential," located at 6250 SW 67 Avenue. The two parcels at this location are consistent with the RS-3 "Low Density Residential" zoning on the north, south, east and west. 6250 SW 67 A VENUE Waiver of Plat february 18.2014 Page 3 of6 The minimum lot size within the RS-3 zoning use district is 10,000 square feet. The proposed wavier of plat would create lots that are 21,738 square feet and 28,556 square feet respectively. Pursuant to Section 20-4.2 of the City's Land Development Code (LDC), subdivision of land is governed by Chapter 28 of the Miami-Dade County Code of Ordinances. However, waivers of plat are subject to the provisions of the City's LDC, including Section 20-4.2(B)(2)(a) of the City's Land Development Regulations, which states in part: (2) City Commission Findings. Prior to approving a waiver-ofplat, the city commission shall use the following guidelines: (a) The building site created by the proposed waiver-ofplat will be equal to or larger than the majority of the existing building sites and of the same character as the surrounding area (this shall be demonstrated using copies of the official plat maps for the subject property and surrounding neighborhood). (2) (b) The building site created by the proposed waiver-ofplat will not result in existing structures becoming nonconforming as they relate to setbacks and other applicable regulations of these land development regulations. (c) The building site created by the proposed waiver-ofplat will be free of encroachments from abutting buildable sites. The resulting "new" lots will be of similar character as the surrounding properties and will be larger than the majority of the existing building sites in the surrounding neighborhood (Figure 1). The existing one-story home fronting SW 67 Avenue will remain on Parcel "A" and will conform to the all required setback back and dimensional requirements for the RS-3 zomng district. The existing tennis court will remain on Parcel "B" and conforms to the setback and dimensional requirements for the RS-3 zoning district. The applicant intends to construct a new one-story single family residence that will front SW 67 Court on Parcel "B", once the necessary approvals have been received. 6250 SW 67 AVENUE Waiver of Plat February 18,2014 Page 4 of6 Figure 1. New driveways are not to be constructed within 5 feet of an interior side property line and a within 15 feet from the property line (right of way line) at comer lots. 2. All planning and zoning requirements will be address separately. 4. Final site plan/driveways, and water and sewer plans to be submitted South Miami PW Engineering Division for approval. City Arborist Review The tree removal permit and tree schedule submitted with the application indicates 23 trees scheduled for removal from Parcel "B" only. No trees are noted for removal on Parcel "A". Based on the initial review by the city's arborist, the following notations have been made. 6250 SW 67 AVENUE Waiver of Plat Februwy 18, 2()14 Page 5 of6 One specimen Oak in the foot print; this tree would require 4 12' native Hardwoods; One specimen Royal Poinciana in the foot print this would require 4 12' native hardwoods; One Jacaranda Mist folia with a canopy of 500 hundred square feet 1 12' Native hardwood replacement; Four Mangos semi poor condition 1 replacement for each with a 12' native hardwood; A cluster of four Poinciana's however since they are so close together they will never achieve specimen status; 4 12' replacements required for canopy loss; Four Sable Palms on site that we recommend for relocation. If relocation is not possible, then mitigation will be required; One Fan Palm that needs to be relocated or mitigated; and One Chinese Tallow tree in poor condition no replacement required. This would bring the preliminary mitigation requirements to 17 (12 foot) native hardwood replacements, the relocation of 5 Palms, the removal 1 poor condition tallow, as well 9 invasive trees listed on site plan that do not require mitigation. The department will continue to work with the applicant and the landscape architect as the project moves forward.
