Resolution of the City of South Miami relating a Final Plat approval to allow for the
Subdivision of the property located at the Southeast corner of SW nnd Street and
SW 68th Avenue, South Miami, Florida.
BACKGROUND:
In November 2013, Gloria Betancourt submitted an application to the City for preliminary review of a
tentative plat that was being filed with Miami-Dade County. A tentative plat application No. T-23437-2-
COR was also filed with Miami Dade County, pursuant to Section 28-4 of Miami Dade County Code and
Section 20-4.2 of the City's Land Development Code. The applicant owns the property specifically
located at the southeast comer of SW 68th Avenue and SW 72 Street, within an RS-2 Semi-Estate
Residential zoning district and is requesting this replat in order divide the property into two buildable
residential lots. The parent tract is currently vacant.
Only 25-feet of right-of-way exists along that portion of SW 68th Avenue, and the pavement width for
vehicles between SW 74th St. and SW 72nd St. (Sunset Drive) is approximately 10-12 feet, which creates
a dangerous condition for two-way traffic. The applicant is providing an additional 25-feet of right-of-
way on the east side ofSW 68th Avenue for the necessary roadway and drainage improvements as part of
this final plat, and pursuant to Section 20-4.2(C) of the land development code, which states the
following:
(I) Sidewalks, curbs, gutters, drainage and paving shall be installed by the developer in accordance
with Chapter 28 of the County Code and other applicable city requirements, unless such can be
and are waived or deferred by the city commission.
(2) No building shall be erected, improved, modified, altered or enlarged in any zoning use district,
other than in an RS residential district, unless proper public improvements have been installed.

The purpose of this district is to provide for semi-estate type single-family residential development
located in a relatively spacious setting which emphasizes the preservation of open space. This district is
appropriate in areas designated "Single-Family" on the adopted city's comprehensive Plan.

The final plat as proposed meets the mJ1lUTIum requirements for the RS-2 Estate Residential zoning
district with the dedication of the 25-feet of right of way for required improvements. The City arborist
will provide a comprehensive review of the proposed tree disposition once the proposed development and
landscape plans have been submitted to the department for Board review, and prior to the issuance of a
development permit. All tree relocation and removal shall be done in compliance with the City'S
permitting and canopy mitigation requirements. It is recommended that the applicant comply with the
following conditions, and/or other conditions deemed appropriate by the City Commission.
1. Compliance with the conditions of the Miami-Dade County approval of application No.
T-23437-2-COR;
2. Compliance with current City Land Development Code requirements.

WHEREAS, Gloria BetancoUlt, trustee of the parcel located at the Southeast corner of SW 72
Street and SW 68 Avenue, submitted a Tentative Plat to Miami Dade County, application No. T-23437-2-
COR, pursuant to Section 28-4 of Miami Dade County Code; and
WHRERAS, the Miami Dade County plat committee met on December 27, 2013 and
recommended approval of the tentative plat subject to any provisions enumerated in their approval letter,
and subject to final plat approval by the City; and
WHEREAS, the replat application requests a subdivision of said parcel into two buildable single-
family lots with the dedication of twenty-five feet for necessary roadway improvements along SW 68th
Avenue; and
WHEREAS, the replat is in compliance with the City's requirements within the RS-2, Semi-
Estate Residential zoning district; and
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The application submitted by Gloria Betancourt, requesting approval of a proposed
Final Plat for the property legally described in Section 2, pursuant to section 20-4.2(b) of the Land
Subdivision Regulations is hereby , and subject to the following
conditions, and/or other conditions deemed appropriate by the City Commission:
1. Compliance with the conditions of the Miami-Dade County approval of application No.
T-23437-2-COR;
2. Compliance with current City Land Development Code requirements.
3. Compliance with the City's tree removal and canopy mitigation requirements.
4. Compliance with the City's Public Works requirements for any roadway and/or drainage
improvements.
5. Compliance with any Miami-Dade County Environmental Resource Management requirements
prior to final recording of this plat.

adoption by vote of the City Commission.

RIGHT-OF-WAY IMPROVEMENT AGREEMENT BETWEEN
CITY OF SOUTH MIAMI AND GLORIA BETANCOURT,
TRUSTEE
THIS AGREEMENT is entered into on this ______ day of February, 2014 by and
between GLORIA BETANCOURT, TRUSTEE OF THE GLORIA BETANCOURT
REVOCABLE TRUST DATED MARCH 1, 2011 (Owner) and the CITY OF SOUTH
MIAMI, a political subdivision of the State of Florida (City) and
WHEREAS, Owner owns real property (the Property) located in the City and
generally described by tax folio number 09-4035-000-0020 and located at the southeast
corner of the intersection of SW 68 Avenue and SW 72 Street and legally described on
Exhibit “A” attached hereto; and
WHEREAS, Owner has an application for Final Plat pending with City and the
City’s Code (specifically Section 17-9) requires an agreement to accompany any
proposed plat of lands in order to provide for “the construction of street paving, parkways
and other improvements within such proposed subdivision as well as the public right-of-
way adjoining the real estate in accordance with the city’s specification” and;
WHEREAS, in order to comply with Section 17-9 of the City of South Miami
Code, the Owner and the City hereby enter into this Agreement to accompany Owner’s
pending plat request based on the terms and conditions contained herein.
NOW, THEREFORE, in consideration of the mutual promises, covenants and
conditions herein stated, the parties stipulate and agree as follows:
1. The above referenced recitals are true and correct.
2. The Owner shall construct the right-of-way improvements reflected on the
proposed Plat of Grandiose Subdivision, which improvements include the widening of
SW 68 Avenue to a paved width of twenty (20) feet for that portion of SW 68 Avenue
that abuts and runs parallel to the west boundary of the Property together with paving
improvements to the southeast corner of the intersection of SW 68 Avenue with SW 72
Street and in accordance with the city's specifications and at the expense of the owners of
the land to be subdivided
3. The above referenced paving requirements may be amended by the City
after review of the tentative plat.
4. Owner shall remit the requisite security (bond; letter of credit; cash or
other acceptable security) for the performance of the construction of the required
improvements (Performance Bond) as required in Section 17-9 of the City’s Code.
Owner shall be responsible for all costs and fees related to the Performance Bond. Said
Performance Bond shall remain in force and effect until such time that the required
right-of-way improvements are completed. The Performance Bond shall accompany
this agreement.
5. Owner shall satisfy all state, county and City plan review, permitting and
construction standards.
6. All notices given or required under this Agreement shall be deemed
sufficient if sent by certified mail, return receipt requested or via hand delivery to the
address specified below, unless either party shall specify in writing different address for
the giving of notices. The return of a notice mailed to the address set forth below shall be
deemed completed even if the envelope is returned due to being unclaimed or due to
being undeliverable at said address. The date of delivery shall be the date of receipt or
the date of the postal notice concerning non-delivery.
7. The construction work is to be completed within one year from the date of
such submission unless provided otherwise in writing by the City Manager.

7. For the purposes of this Agreement, Florida law shall govern the terms
of this Agreement. Venue shall be in Miami-Dade County, Florida.
IN WITNESS WHEREOF, Gloria Betancourt, Trustee of the Gloria Betancourt
Revocable Trust dated March 1, 2011 this agreement is accepted and delivered on the date stated
above by the following signatories.
