APPLICANT'S PROPOSAL Pursuant to section 20-3.4(B)(19)ofthe Land Development Code (LDC)the applicant is requesting a Special Use Approval to operate a small restaurant,Miyako Restaurant,at the above referenced location.The proposed area of the restaurant istobe located within an existing one story retail building.It will occupy 2,000 square feet,and will be a casual-oriental restaurant, featuring a sushi bar.The proposed facility will have 50 space seats with 10 additional seats at the sushi bar.The applicant intents to offer beer and wine.The proposed operating hours are from 11:00AM to 11:30 PMon Monday through Saturday and from 1:00 PMto 12 midnight on Sunday.The applicant also intends to provide limited outdoor seating. SPECIAL CONDITIONS APPLICABLE The LDC provides that special uses must be approved by the City Commission after a public hearing and receipt ofa recommendation from the Planning Board.The overall purpose is to determine the compatibility of the proposed use with the surrounding neighborhood.In addition, special uses may also be required to comply with the additional requirements,which are set forth in Section 20-3.4(B).Inthe case ofa small restaurant the following supplemental requirements are listed: (a)Small restaurants must be located within two hundred (200)linear feet ofa municipal parkinglot. (b)The on-site parking on small restaurant premises must be used for customers only; employees and management mustparkin off-site parking. (c)Requiredparkingmustbeon-site. (d)Small restaurants may only serve alcoholic beverages to any given patron in combination withfoodbothpreparedandservedonthe premises. ANALYSIS Theproposeduseislocatedinthe "SR(HD)"SpecialtyRetaildistrictwithintheHometown OverlayZone.A restaurant ispermittedwithaSpecialUseApproval.The proposed usemust meettherequirementsforspecialusescontainedunderSection 20-3.4(B)19SmallRestaurant andSection20-5.8SpecialUseApproval of theLDC.Arestaurantthat contains nomorethan 2,000sqftandis within 200feet of amunicipallotisdefinedasaSmall Restaurant havinga parkingrequirement of 1spaceforevery400sqft.Theexistinguseatthislocationwasretail, whichhasa higher parking ratiothanthat of theSmall Restaurant category andassuchno additionalparkingisrequired.Allexistinguseswithindowntownare considered tohavemet theirparkingrequirementsatthetimethestructuresthattheyoccupywerebuilt.Whenan existinguseisreplacedwithamoreintensiveusetheapplicantisrequiredtoprovidethe additionalparkingneededasaresult of moreintenseuse.Conversely if alessintenseuseis proposednoadditionalparkingisrequired. TherequestedspecialusecomplieswiththeLDCrequirementssetforthforspecialusesin Section20-3.4andthe proposed usemeetstheconditionalrequirementssetforthin Section 20- 5.8 in that the use: a)Willnot adversely affectthehealthorsafety of persons residing or working inthe vicinity ofthe proposed use, b)Willnotbedetrimentaltothepublicwelfareorpropertyorimprovementsinthe neighborhood;and, c)ComplieswithallotherapplicableCodeprovisions.
