A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH
MIAMI,RELATING TOA REQUEST PURSUANT TO SECTION 20-3.4(B)(19)OFTHE

OVERLAY ZONING DISTRICTS SPECIFICALLY AT 5844 S.W.73rd STREET
WHEREAS Le Kim,on behalf of KBRSS,Inc.property owner of 5844 S.W.73rd Street
.has submitted an application foraspecialusetoallowasmallrestauranttobelocatedinthe
"SR(HD)"Specialty Retail,Hometown DistrictOverlay zoning districts specifically at5844 S.W.
73rd Street;and
WHEREAS,a small restaurantis allowed asaspecial use in the SR(HD),Specialty
Retail,Hometown DistrictOverlayzoningdistrictssubjectto meeting certain conditions
specified intheLandDevelopmentCode Section 20-3.4(B)(19);and
WHEREAS,the approval of a special use requires a recommendation from the Planning
Board andthe approval oftheCityCommission after apublic hearing;and
WHEREAS,The Planning and Zoning Department staff recommended approval of the
proposed special use with the following two conditions:1)that final plans show an enclosed air-
conditioned trash room;and2)all dishwashing activities mustbe contained withinthe building;
and
WHEREAS,staff recommendation dated January 20,2000 is made part of this
resolution;and
WHEREAS,on January 25,2000,the Planning Board voted (6-0)to recommend
approval with conditions of the special use request;and,
WHEREAS,the Mayor and City Commission of the City of South Miami desire to
accept the recommendation ofthe Planning Board.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OFSOUTH MIAMI,FLORIDA:
Section 1:That a special use is approved for locating an small restaurant at 5844 S.W.73r
Street subject tothe following conditions:
(a)Final plans show an enclosed air-conditioned trash room
(b)All dishwashing activities must be contained within the building

APPLICANT'S PROPOSAL
Pursuant to section 20-3.4(B)(19)ofthe Land Development Code (LDC)the applicant is
requesting a Special Use Approval to operate a small restaurant,Miyako Restaurant,at the above
referenced location.The proposed area of the restaurant istobe located within an existing one
story retail building.It will occupy 2,000 square feet,and will be a casual-oriental restaurant,
featuring a sushi bar.The proposed facility will have 50 space seats with 10 additional seats at
the sushi bar.The applicant intents to offer beer and wine.The proposed operating hours are
from 11:00AM to 11:30 PMon Monday through Saturday and from 1:00 PMto 12 midnight on
Sunday.The applicant also intends to provide limited outdoor seating.
SPECIAL CONDITIONS APPLICABLE
The LDC provides that special uses must be approved by the City Commission after a public
hearing and receipt ofa recommendation from the Planning Board.The overall purpose is to
determine the compatibility of the proposed use with the surrounding neighborhood.In addition,
special uses may also be required to comply with the additional requirements,which are set forth
in Section 20-3.4(B).Inthe case ofa small restaurant the following supplemental requirements
are listed:
(a)Small restaurants must be located within two hundred (200)linear feet ofa municipal
parkinglot.
(b)The on-site parking on small restaurant premises must be used for customers only;
employees and management mustparkin off-site parking.
(c)Requiredparkingmustbeon-site.
(d)Small restaurants may only serve alcoholic beverages to any given patron in combination
withfoodbothpreparedandservedonthe premises.
ANALYSIS
Theproposeduseislocatedinthe "SR(HD)"SpecialtyRetaildistrictwithintheHometown
OverlayZone.A restaurant ispermittedwithaSpecialUseApproval.The proposed usemust
meettherequirementsforspecialusescontainedunderSection 20-3.4(B)19SmallRestaurant
andSection20-5.8SpecialUseApproval of theLDC.Arestaurantthat contains nomorethan
2,000sqftandis within 200feet of amunicipallotisdefinedasaSmall Restaurant havinga
parkingrequirement of 1spaceforevery400sqft.Theexistinguseatthislocationwasretail,
whichhasa higher parking ratiothanthat of theSmall Restaurant category andassuchno
additionalparkingisrequired.Allexistinguseswithindowntownare considered tohavemet
theirparkingrequirementsatthetimethestructuresthattheyoccupywerebuilt.Whenan
existinguseisreplacedwithamoreintensiveusetheapplicantisrequiredtoprovidethe
additionalparkingneededasaresult of moreintenseuse.Conversely if alessintenseuseis
proposednoadditionalparkingisrequired.
TherequestedspecialusecomplieswiththeLDCrequirementssetforthforspecialusesin
Section20-3.4andthe proposed usemeetstheconditionalrequirementssetforthin Section 20-
5.8 in that the use:
a)Willnot adversely affectthehealthorsafety of persons residing or working inthe
vicinity ofthe proposed use,
b)Willnotbedetrimentaltothepublicwelfareorpropertyorimprovementsinthe
neighborhood;and,
c)ComplieswithallotherapplicableCodeprovisions.
Thisapplicationdoesnotconflictwiththe Comprehensive Plan.
PLANNING BOARD ACTION
Thesubject application was presented tothe Planning BoardatitsJanuary 25,2000 meeting.At
thattimetheBoardadoptedamotion(6-0)recommendingapproval of theapplicationsubjectto
two conditions as set forth by staff.
RECOMMENDATION
APPROVAL subject tothe following conditions:
1)finalplansshowanenclosedair-conditionedtrashroom,and
2)alldishwashingactivitiesmustbecontainedwithinthebuilding

LETTER OF INTENT
We request to operate a 2,000 S.F.small restaurant with some outdoor seating along
the sidewalk at the above referenced location.The hours of operation will be Monday
through Saturday from 11:00 am to 11:30 p.m.,and Sunday from 1:00 p.m.to 12:00
p.m.Beer and wine will be consumed on premises.All dishwashing and cleaning will
occur within the leased area.Two on site parking spaces are assigned to the restaurant,
the remainder of employees and patrons will park in the nearby municipal parking lot
and surrounding metered parking.
