REQUEST A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTHMIAMI,RELATINGTOAREQUEST PURSUANT TOSECTION20- 3.4(B)(21)OFTHE LAND DEVELOPMENT CODE FORA SPECIAL USE APPROVAL TO LOCATE AN ANIMAL HOSPITAL IN THE "GR "GENERAL RETAIL ZONING DISTRICT SPECIFICALLY AT 5820 BIRD ROAD APPLICANT'S PROPOSAL Pursuant toLand Development Code (LDC)Section 20-3.4(B)(21),the applicant is seeking a Special Use Approval in order to operate an animal hospital at 5820 SW 40 Street.Thestructurehasbeenvacantforovertwoyearsandisa"legal nonconforming" structureduetothefrontandsidesetbacks.Theprevioususeatthis location wasa restaurant.The 2,420 square foot building is located inthe General Retail (GR)zoning district fronting Bird Road in the northern-most portion of the City.The subject property is bordered by Bird Road onthe north,other GR properties on both sides,and single- family homes on the south.An animal hospital is permitted in the GR zoning district as a special use. SPECIAL CONDITIONS APPLICABLE The LDC provides that special uses must be approved by the City Commission after a public hearing and receipt ofa recommendation from the Planning Board.The overall purpose isto determine the compatibility of the proposed use with the surrounding neighborhood.In addition,special uses may also be required to comply with the additional requirements,which are set forth in Section 20-3.4(B).Inthe case ofan animal hospital the following supplemental requirements are listed: 5820 Bird Road SpecialUseApproval Page 2 (a)Allsuchusesshallbelocatedwithinafullyenclosed,air-conditioned,soundproof structure. (b)Thereshallbenoovernightboarding of animalsexceptformedicalpurposes. (c)Thehours ofoperation forvisitsandtreatmentwillbe7:00A.M.to9:00P.M., Monday through Saturday;hours of operation shallnot prevent emergency medical treatment. ANALYSIS TheapplicantproposestooperateaVeterinaryEmergencyandTraumaCenteratthis location.Thefacilitywillnotcontainanyovernightboarding,except formedical purposes andisfully enclosed,air-conditioned and soundproofed.Thehours of operation for visits and treatment are limited to between the hours of 7:00 a.m.to 9:00 p.m. Monday through Saturday. The applicant doesnot propose any changes thatwill increase the structure's nonconformity.PursuanttoSouthMiamiLand Development CodeSection20-4.8(B), thestructuremaycontinuetobeusedforanypermitteduse. As shown inthe attached plans,the applicant proposes to remodel the interior of the building.In order to increase the conformity oftheuseandthesitewiththe LDC,the applicant must add additional landscaping to bring landscaping upto code and construct a CBS wall onthe south property lineto provide adequate buffer between residential and commercial properties. The current proposal will enhance the property.The proposed use will have less adverse impact on the surrounding area than the previous restaurant uses that maintained late hours.The Special Use Approval request complies with all the conditions outlined in LDC Section 20-3.4 andthe proposed use meets the conditional requirements set forth in Section 20-5.8 in that the use: 1)Will not adversely affect the health or safety of persons residing or working in thevicinity of theproposeduse; 2)Will not be detrimental to the public welfare or property or improvements in the neighborhood;and 3)Complies withall other applicable Code provisions. The requested Special Use approval does not conflict with the adopted Comprehensive Plan of theCity of SouthMiami.
