A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI,RELATING TO A REQUEST FOR SPECIAL
EXCEPTIONS FROM SECTIONS 20-7.7,20-7.9 AND 20-7.11 OF THE LAND
DEVELOPMENT CODE FOR A TWO-STORY MIXED USE DEVELOPMENT,
LOCATED AT 5796 SUNSET DRIVE,WITHIN THE HOMETOWN DISTRICT
OVERLAY ZONE REQUIRING NONUSE DEVIATIONS FROM THE

ORDER TO REDUCE THE REQUIRED BUILDING FRONTAGE ON SUNSET
DRIVE;INCREASE BUILDING DEPTH ON SIDE STREET;AND TO ALLOW

WHEREAS,JerryB.Proctor,Esq.,on behalf of Alfred andGayCinque,property
owners of 5796SunsetDrivesubmittedaletter of intenttobuilda6,095 sqft.mixeduse
projectwithinthe Hometown District,and
WHEREAS,theprojectincludesStarbucksCoffee,specialtyretailandoffice
space,and
WHEREAS,theapplicantisseekingSpecial Exceptions tovaryfrom Sections 20-
7.7,20-7.9 and 20-7.11 ofthe South MiamiLand Development Code,and
WHEREAS,staff recommendsapprovalwithconditions of theapplicationfora
Special Exceptionbasedupon(a)themerits of the application (b)consistencyand complying
withthespiritandtheintent of theHometown Plan and(c)consistency with the City's
adopted Comprehensive Plan;and,
WHEREAS,staff recommendationdated January 14,2000ismadepart of this
resolution;and
WHEREAS,onJanuary 11,2000,thePlanningBoard voted 4:0to recommend
approval with conditions of theSpecial Exception request;and,
WHEREAS,theMayorandCityCommission of theCity of South Miamidesireto
acceptthe recommendation ofthePlanningBoard.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1:Thatthefollowing special exceptionsaregrantedwithconditions:
(a)ToreducetherequiredbuildingfrontageonSunsetDrivefrom100%(57feet)to
35%(20feet).
(b)ToincreasethebuildingdepthonS.W.58Avenuefrommaximum70%(70feet)
plusdepth of anoutbuildinguptoa maximum 30feettoatotal of 95%(95feet).
(c)Toallowforacantileveredbalconyinlieu of arequiredarcadeonSunsetDrive.
Section 2:That the conditions are as follows:
(a)Providingaleaseagreement,satisfactorytotheCity,fortherequiredparking
beforeanydemolitionorbuildingpermitisissued.Theprovision of required
parkingisacontinuingcondition of thisapproval.Theapplicant,oritsdesignee,
shallprovideanaffidavittotheCityonorbefore September 30 of eachyear,
affirmingthataparkingleaseagreement(1)isineffectand(2)hasbeenapproved
bytheCity.
(b)Providingenclosedandair-conditionedtrashroomatleastfortherestaurant
(Starbucks).
(c)The sidewalk along 58th Avenue along the side ofthe project is aligned with the
sidewalk located infront of theHanging Basket.
(d)Sidewalk andon street parkingshouldbeconfiguredina manner notto aggravate
the traffic movement at the intersection.
Section 3:The Staff report datedJanuary14,2000,therevisedSitePlandated January 3,
2000andthemodificationmadetotheon-streetparkinglayoutatthemeetingaremade
a part of this resolution.
Section4:TheCity Commission encourages and strongly recommends that Starbucks and
otheremployersatthispropertyrecruitatleast20%of itsemployeesfromtheSouth
Miamicommunity.
Section5:This resolution shalltakeeffectimmediatelyuponapproval.

BACKGROUND
Introduction and Site Description:
Theapplicantisproposingtobuildanewtwostorymixedusebuildingatthesoutheast
corner of Sunset Drive and 58th Avenue.The rectangular shaped property is located at
5796SunsetDriveandhasanarea of 5,700squarefeetor0.13acres.The property
currentlyhasa vacant onestorylathand plaster buildingwitha courtyard facingSunset
Drive.Theexisting structure isconsideredtobea "contributive building"duetoanumber
of significantarchitecturalanddesignfeaturessuchasthebuildingfacedefiningpublic
space,presence of the court yard,use of water feature,use of low wall to delineate public
andsemi-publicspaces.However,the construction methodsandthe structural design of
theexisting structure donotmeetany of thecurrentbuildingcodes.The structure is
deemedtobeunusablebecause of its inability tobebroughtuptothepresentdaycodeand
wouldhavetobe demolished tomakewayforanewstructure.Theproposedprojectisa
twostorymixedusebuildingthatincludesStarbucksCoffee,specialtyretailandoffice
space.The "L"shaped buildingisdesignedto provide a courtyard in the same location as

theexisting courtyard.The courtyard features shade trees,alow masonry wall,water
feature andlandscaping.

Special Exceptions Requested:
Thefollowingspecialexceptionsarerequestedbythedevelopertoaccommodatethe
proposed development:
1.To reduce the required building frontage on Sunset Drive from 100%(57feet)to
35%(20 feet).
2.To increase the building depth onS.W.58th Avenue from maximum 70%(70 feet)
plus depth of an outbuilding up toa maximum 30feet to a total of 95%(95feet).

3.To allowfora cantilevered balcony inlieu of a required arcade on Sunset Drive.
TheLandDevelopmentCode specifies thatconstructionintheHometownDistrictmust
complywiththeregulations established forthedistrict.TheCityCommissionmay,by
specialexceptionafterapublichearingbythePlanningBoard,waivestrictcompliance of
theDistrictprovisions.ThePlanningBoardmustfindbysubstantial,competentevidence
that:
(a)Theproposeddevelopmentcontributesto,promotesandencouragesthe improvement
of theHometownDistrictandcatalyzesotherdevelopmentasenvisionedinthe
Hometown District regulations;
(b)The proposed developmentiscompatiblewiththelanduseanddevelopment
intensities prescribed byallapplicableCityregulations;
(c)Theproposeddevelopmentmustpossessintegrity of designcompatiblewithdesign
criteriaestablishedforthe Hometown Districtandwiththeoverallimage of thecity;
(d)Theproposeddevelopment shall be designed inamannerthatprovidesfor effective
management of traffic(vehicularandpedestrian),parking,lighting,noise,andwaste
generated bythedevelopment,andformanagement of theimpacts of thedevelopment
onpublicfacilitiesandservices;
(e)The proposed development doesnotexpandthe permitted useswithinthe Hometown
District;
(f)The proposed developmentwillnothaveanunfavorableeffectontheeconomy of the
City of South Miami;
(g)The proposed development,whenconsideredcumulativelywith other development,
bothpresentandfuture,withintheHometownDistrict,willnot create excessive
overcrowding orundueconcentration of population.
Project Analysis:
Staffs analysis of theprojectforconsistencywiththeabovecriteriaisasfollows:
(a)The proposed development contributes to,promotes and encourages the
improvement of the Hometown District and catalyzes other development as
envisioned in the Hometown District regulations.
The proposed developmentprovidesamix of usesthat create astrongpedestrian
oriented building edge alongthesidewalk.It contributes toand encourages similarthe
improvements of otherdevelopmentsasenvisionedbythe Hometown District
regulations.Theexistingbuildinghasbeenvacantforoverayearandisits
deterioratingconditionis detrimental totheoveralleconomicand physical health of
downtown.
°The project enhancesthesense of placebyproviding ground level pedestrian oriented
activities,providingpedestrianrelatedamenitiessuchasacourtyardfacingSunset
Drive,andtheuse of projecting balconies,awnings andstreettreestoprovide
protectionfrominclementweather.
°The proposed developmentwillhelpreducelocal commuter traffic demand of thearea
by providing amix of uses that willbeprimarilyutilizedbythe people that arealready

inthearea.The proposed developmentprovidesthe required parkingspacesbasedon
thecoderequirementsaftertheHometownDistrictparkingincentivesisapplied.
(b)The proposed development is compatible with the land use and development
intensities prescribed by all applicable City regulations.
Theproposeddevelopmentiscompatiblewiththelanduseanddevelopmentintensities
prescribedbyallapplicableCityregulations.Alltheproposedusesareallowedbythe
codeandthedevelopmentiswithintheprescribedFARandtheheightlimitations of
four stories/56 feet.
(c)The proposed development must possess integrity of design compatible with
design criteria established for the Hometown District and with the overall image
of the city.
Theproposeddevelopmenthasreceivedconceptualapprovals of theEnvironmental
Review and Preservation and the Historical Preservation Boards.The scale and the
architecturaltreatment of theprojectreinforcethepedestrian character of SunsetDrive
and 58th Avenue.
(d)The proposed development shallbe designed ina manner that provides for
effective management of traffic (vehicular and pedestrian),parking,lighting,
noise,and waste generated by the development,and for management of the
impacts of the development on public facilities and services.
Theapplicanthas completed the concurrency evaluationfortraffic.Theevaluation
indicates that there are adequate roadwaycapacitiesto support thedevelopment.The
proposed development will be required to dedicate 5-feet along 58th Avenue at the time
abuildingpermitisrequested.Thisadditionaldedicationwillallowforonstreet
parking and realignment of the sidewalk along east side of 58th Avenue.The applicant
hasobtainedSewerCapacityCertificationfromMiamiDadeCountyDepartment of
Environmental Resources Management (DERM).Solid waste generated bythe
developmentiscontainedwithinthesite.Allstormdrainagerelatedissues,onand off
sitewillbe addressed anddesignshavetocomplywiththe requirements of theSouth
Florida Building Code atthetime of issuance of buildingpermit.Other County
concurrencyrequirementsandimpactfeesforitemssuchasfire,water,schoolswill
havetobesatisfiedbythedeveloperduringthepermittingprocess.
(e)The proposed development does not expand the permitted uses within the
Hometown District.
Alltheuses proposed are permitted withinthe Hometown District.
(f)The proposed development will not have an unfavorable effect on the economy of
the City of South Miami.
Duetotheunderutilizationandthepresentcondition of theproperty,theproposed
developmentwillsubstantiallyincreasethetaxbasegeneratedbytheproperty.

(g)The proposed development,when considered cumulatively with other
development,both present and future,within the Hometown District,will not
create excessive overcrowding or undue concentration of population.
Thedevelopmentiswithintheprescribedregulationsfordevelopmentdensity,height
anduse.Thesuggestedmix of uses of thedevelopmentwillnotcreateexcessive
overcrowding orundue concentration of population that isbeyondwhatisenvisioned
within the Hometown District.
Staff generallyfindsthe requests forSpecial Exceptions meettheintent of the Hometown
DistrictOverlayOrdinanceandtherequirementssetforthintheLandDevelopment
Regulations for granting suchexceptions.Thespecial exception request to reduce building
frontagealongSunsetDriveisnecessitatedbythepresence of thecourtyard.Thestaff
believesthatthecourtyardisanimportanturbanelementhavingacontextual significance
tothe City's pastandthereforemustbeincorporatedinthedesign of theproject.The
specialexceptiontoincreasethebuildingdepthonthesidestreetisaresult of thelinear
shape of the building along 58th Avenue.This condition is created by the placement of the
courtyardonSunsetDriveasopposedtotherear of the property asisgenerallyenvisioned
bythe Hometown Plan.Thethirdrequesttobuildcantileveredbalconiesinlieu of the
requiredarcadealongSunsetDriveisduetotheconflictbetweentheSouthFlorida
BuildingCode(SFBC)andthe City's LandDevelopmentCode(LDC).SFBCdoesnot
currentlyallow obstructions suchascolumnstobeplacedonthepublicright of way.The
cantileveredbalconiesprovidethesameintendedfunctionsasthat of arcades.The
development:
(a)Willnotadverselyaffectthehealthorsafety of persons residingorworkingin
thevicinity of the proposed use;
(b)Willnotbedetrimentaltothepublicwelfareor property orimprovementsinthe
neighborhood;and
(c)ComplieswithallotherapplicableCodeprovisions.
The staff alsofindsthattherequestsforspecialexceptiondonotconflictwiththeadopted
ComprehensivePlan of theCity of South Miami.Infact,thedevelopmentfurthersmany
of thegoals of theFutureLandUseElement of the City's adoptedComprehensivePlan,
including,preservation of theCity'ssmalltowncharacter,theencouragement of pedestrian
oriented developments asenvisionedbythe Hometown Plan,andincreasingthetaxbaseto
provide ahighlevel of municipalservices.
Board Actions:
Atthe request of theapplicanttheHistoric Preservation Board atitsmeeting of November
29,1999 gave permission todemolishtheexisting structure.The Board strongly
recommended that anynew construction onthissitemaintainsome of the architecturally
significantelementsthatmadetheproperty "contributive".Theseelementsare,butnot
limited to,courtyard,waterfeature,low masonry wall defining thepublicand semi-public
spaces.TheEnvironmentalReviewandPreservationBoardreviewedandapprovedthe
project by unanimous vote atits November 2,1999meeting.

TheprojectwaspresentedtothePlanningBoardonJanuary 11,2000.The Board,atgreat
length,discussedtheviabilityandthe appropriateness of four(4)onstreetparkingspaces
on 58th Avenue along the frontage of this property due tothe concern about the congested
condition at the intersection of Sunset Drive and 58th Avenue.Asa compromise,the
Board recommended pushingthesidewalkfurtherbacktoalign with theexistingsidewalk
infront of Hanging Basket.After conductingapublichearing the PlanningBoard
consideredtherequestforthree special exceptions.TheBoardthrough substantial
competent evidencefoundthatthe application meetsthecriteriasetforthintheLand
Development Codeforgranting special exceptions.The Planning Boardadoptedamotion
(4-0)torecommendtotheCityCommissionthewaiving of thestrictcompliance of
regulationsas requested with certainconditionsthathave been incorporatedintothe staff
recommendations.
RECOlVDvlENDATIONS
The staff recommends approval of theallthree of thespecial exception requestssubjectto
the following conditions:
•Providingaleaseagreement,satisfactorytotheCity,fortherequiredparkingbefore
any demolition orbuildingpermitisissued.
•Providing enclosed andair-conditionedtrashroomatleastfortherestaurant
(Starbucks).
•The sidewalk along 58th Avenue along the side of the project is aligned with the
sidewalk locatedinfront oftheHanging Basket.
•Sidewalk andonstreetparkingshouldbeconfiguredinamannernottoaggravatethe
traffic movement at the intersection.
Note:
At therequest of the Planning BoardmemberMs.Gibsontherepresentative of the
Starbucksmadea commitment tohirelocalresidentsas employees atthislocation.

Thezoning application contemplated by Starbucks andthe property owners
atthis location has been previously submitted,togetherwith plans asprepared by
ChaelCooper&Associates,P.A.A traffic/concurrency analysisand utility
informationwillbeprovided separately totheCity.The purpose of thisletteristo
outlinethevariancesfromtheLand Development Code("Code")of the City of
South Miami,and thepublicpolicy reasons whywebelieve that theserequests
should ultimately be approved by the City Commission.

30%placementonthe "Build-To Line"requested.
Thesubject property containsacontributivestructure,pursuanttothe
HometownOverlayOrdinanceandthe Future LandUseElement of the
Comprehensive Plan of theCityof South Miami ("Comprehensive Plan").This
designation certifies thatthesubject property contains structures and design elements
thathavethehighestpriority for preservation inthe Comprehensive Plan.
Unfortunately,duetothecondition of theexistingbuildingonthe subject property
and the financial and practical infeasibility of bringing the building into compliance
withthe provisions of the South Florida Building Code,the building cannot
reasonably be rehabilitated.Inlieu thereof,however,Citystaff has notedthatthe
contributive significance of the subject property stemsnotonly from the placement
of the existing buildingonthe "Build-To Line",butfromthe existing courtyard
between the subject building and the easterly adjacent commercial area dominated
bythe First National Bank of South Miami.This courtyard provides architectural,
historic,and contextualsignificancetothe City's past.Citystaffhasindicateda
desire to maintain thecourtyardinany future development of the subject property
and to incorporate thedesign features withinthe City's Hometown District Overlay
Ordinance,as ameans of providing a bridge betweenthe contextual importance of
the courtyard and the future development goals of theCity as espoused inthe
Hometown District Overlay.
Accordingly,the applicants have proposed atwo-story structure (as required
intheHometown Plan)tobedevelopedonthe"Build-ToLine",withthebalance of
theSunsetDrive frontage preservedinitscurrentopenspace,courtyard character.
Indoingso,the applicants have complied withthe goal of creative mixeduse
developmentinPolicy 1,5.1 of theLandUseElement of theComprehensive Plan,
bynotonly proposing amixeduse project butby retaining the current creativity and
form of the courtyard design.In addition,the courtyard,as enhanced bythe
proposed development,will advance the pedestrian character of the Sunset Drive
commercial area in accordance with Goal 2 of the Land Use Element of the
Comprehensive Plan.Theexisting courtyard feature is unique tothesubject
property along theSunsetDrive commercial corridor,andits retention precludes the
use of the property inamanner consistent withtheHometown District Overlay
portion of the Code.

The applicants also request a special exceptiontopermit95%building depth
alongthesidestreet (SW 58 Avenue),where70%is permitted inthe Hometown
DistrictOverlayOrdinance.Thisrequestlogicallyaccompaniesthereductionin
development along theSunsetDrive"Build-To Line".Withoutbuilding
development along thestreetontheSunsetDriveportion of theproperty,the
applicants'ability tocreateamixedusedevelopmentconsistentwiththeCodeand
ComprehensivePlanisseverelylimited.Thesubjectpropertyisonlyabout 5,700
squarefeetinsize,one of thesmallestcommercialpropertiesintheSunset Drive
commercial corridor,andtheplacement of the existing building onthis historically
significant property justifiesits redevelopment withasimilarbuilding footprint.The
applicants will dedicate a portion of their already limited property for additional
parkingontheeastside of SW 58Avenue,therebyprovidingtheinfrastructure
neededtoserveits development.Ratherthanorienting pedestrians intotheproject
alongSW58 Avenue,itismore desirable toprovidethe focal point of theproject
inthe courtyard alongSunsetDrive,SouthMiami's"main street"businesscenter.
In effect,thecourtyardretentionandtherequireddedication of additional right-of-
wayforSW58 Avenue createa situation wherecompliancewiththesidestreet
buildingdepthlimitationwould preclude eventhe reasonable use of thesubject
property.
The applicants alsorequesta special exceptionfromSection20-7.7 of the
Codeto permit a cantilevered balcony atthe front of the Starbucks project inlieu of
an arcade as contemplatedintheCode.Thisrequestissought as aresult of a
conflictbetweentheCoderequirementthatthe arcade extendbeyondthe"Build-To
Line,"and the provisions of theSouth Florida BuildingCode prohibiting columns
tobe placed inthepublic right-of-way.Thisconflict also precludes the
encroachment of habitablespacesonupper floors overthe arcade intothepublic
right-of-way of Sunset Drive.
The applicants haveaddressedtheaboveconflict by designing apublicspace
infront of Starbucks in the form of a cantilevered balcony,with outdoor seating on
theupperlevel.Thissolution incorporates the City's goal of providingpedestrian
continuity along Sunset Drive,inacovered walkway design.Inaddition,the
solution provides apublic gathering space onthesecondlevel,further enhancingthe
proportion of outside public meeting spacesto property size thatis unique forthis
parcelalongthe Sunset Drive commercial corridor.

Starbucks multi-use siteat5796SunsetDriveintheCityofSouthMiami.The traffic concurrency
analysis summarized inthis letter uses information from theCity's Comprehensive Plan as well as
procedures and data provided through Miami-Dade County's concurrency management system.
DatacontainedhereinupdatesourNovember23andDecember28,1999,letterreportstoinclude
trip information about recently approved developments inthe area as well as the final setof square
footage allocations among uses proposed atthe Starbucks multi-use site.
Existing orasof right uses at the Starbucks site have been ignored.Additionally,a considerable
portion of the walk-up patronage that would logically be anticipated for this type of development
withina downtown settingistreatedas arriving by automobile inasuburban location.These and
other assumptions used provide a conservative analysis of roadway concurrency (i.e.,some
overestimation of new vehicle traffic generated).
Proposed Development
The6,095sf project willbe located onthesouthsideofSunsetDrivenearthecenteroftheCity's
downtown commercial area.The proposed uses ina two-story structure are(1)a 1,982 sf Starbucks
restaurant,(2)1,456 sfof specialty retail use,and (3)a 2,657 sf office.

Data from the Institute of Transportation Engineers*(ITE)Trip Generation sixth edition wasused
to estimate daily and PM peak hour traffic generated by the multi-use site.To provide a
conservative analysis with possible overestimation of site traffic,the potential for some internal
satisfaction of trips among the different users at the site as well as between these site uses and
multiple other useswithin reasonable walking distance of the sitewere ignored.

The ITE manual provides various rates and equations for estimating traffic for office uses,specialty
retail and various categories of restaurants.The ITE information was used directly in estimating
traffic tobe generated by the office and specialty retail components of the site.However,coffee
shops are not a specific category of use listed by ITE,so other land uses which would be expected
tohavesome of thesame basic trip generation characteristics asa Starbucks were investigated.
TheITElandusecategoryunderwhichStarbuckswouldbeclassifiedisahigh-turnoversit-down
restaurant.However,aStarbucksmightalsoexhibitsome of thetrip generation characteristics
similar to fast food restaurants or convenience stores,particularly during theAM street peak periods
buttoamuchlesserdegreeduringthePMstreetpeakperiods.Thesevariationswouldalsoaffect
daily trip rates.TheITE trip generation characteristics of theseotheruses,as wellas for high-
turnover restaurant were investigated.To provide a conservative analysis with potential for
overestimating trip making,the ITE daily rates for high-turnover restaurant were increased 50%,and
thePMpeakhour rate was increased 20%for making trip generation estimates for the Starbucks
component of this development.
ITE recognizes that not all trips generated by retail and restaurant uses (i.e.,patrons through the
door)are necessarily new trips generated onto and impacting the adjacent roadway network.Some
patrons are already traveling on the adjacent street for another or associated primary trip purpose.
Thus,ITE recognizes that some reduction should be made for this pass-by trip phenomena for those
land uses susceptible tothis condition.As applied tothe Starbucks development,for example,itis
easy to imagine a commuter on his journey to work stopping temporarily enroute topickupa cup
of coffee,ora commuter who works in downtown South Miami walking into Starbucks for a cup
of coffeeto carry tothe workplace.
Update materials to the fifth edition of ITE's Trip Generation explore this topic for shopping centers,
restaurants,convenience marts,etc.The pass-by traffic component can be significant.For purposes
of this analysis,onlya 10%pass-by component for the specialty retail useis applied to daily and PM
peak hour traffic.ITE data for larger retail facilities is two tosix times this value.No trip
adjustment is made for the development's office component.All office traffic generated is assumed
tobenewprimarytrips.
FortheStarbucks restaurant component of thisdevelopment,ITEtripdata for fast food restaurants
show only 29%arc primary trips,while 24%are diverted trips and an average of 47%are pass-by
during PM peak hours.For high-turnover sit-down restaurants the percentages are slightly different:
28%primary,32%diverted-linked trips and 40%pass-by.For convenience markets,only 16%of
the trips to and from the sites during the PM peak hour are primary trips,an average of 18%arc
diverted-linked trips and 66%are pass-by.For this analysis,amodest 20%pass-by rate is used for
PM peak hours,and 30%for daily traffic generated bythe Starbucks component.

Empirical data reported byITE regarding trip generation isoverwhelmingly drawn from land uses
situatedin suburban locations,notdowntown areas.Further,mosttripgenerationdatais for stand
alone facilities that have limited transit service.Due to the proximity of Metrorail service along the
SouthDixie Highway corridor and giventhe location of thisdevelopmentina downtown
commercial setting,amodest5%reduction toITE values isusedinestimatingthenetnew traffic
thatwillbe generated bythe proposed developmentontothe surrounding arterial streetnetwork and
passing through the traffic concurrency stations shown is Exhibit 1.Themodest reduction will result
ina conservative traffic concurrency analysis (i.e.,likely overestimation of vehicle traffic generated).
Table 2 summarizes the net calculation of new dailyandPM peak hour traffic estimated tobe
generated bythe three land use components of the proposed development.

Conclusion
The future condition with the multi-use Starbucks development constructed and fully operational
will result in sufficient capacity remaining on the major roadway network.The transportation
network sites analyzed in this concurrency evaluation and the analysis techniques used are consistent
with the sites monitored and the procedures used by governmental agencies.The transportation
network sites monitored have sufficient capacity (trip reserve)to absorb the additional new traffic
tobe generated bythe multi-use Starbucks development.

Be:Water and Sewer Availability for Cinque Mixed Use Building,to be located at
5796 Sunset Drive,Miami-Dade County,Florida.
Dear Mr.Bochnovich:
This letter is in response to your requested service agreement tor the AbdVMMIir-
enced property for the proposed construction of one thousand four hundred sixty-
four (1,464)square feet of retail space,two thousand four hundred "*ty-two (2,452)
square feet of office space and a sixty-seven (67)seat Starbucks Coffee Shop .
The County owns and operates a twenty (20)inch water main located in S.W.72 Street
and S.W.58 Avenue,abutting the northern boundary of the referenced property,from
which'the property owner shall install and connect a twelve (12)inch water main
southerly in S.W.58 Avenue covering the referenced property.Any proposed water
main extensions within the referenced property shall be twelve (12)inches minimum
in diameter with two (2)points of connections.
The County also owns and operates an eight (8)inch gravity sewer main located in
S.W,58 Avenue,from which the property owner shall install and connect eight (8)
inch gravity sewer mains within the referenced property,provided that there is
sufficient depth and that there are no obstacles ^^^^^11 ^rvftheofthesewer.However,Sewage Pumping Station Number 177,.which will serve he
referenced property,needs some improvements.When,and if the property owner pre-
paresto enter into an agreement with the Department,the property owner shall be
required to make said improvements to said pumping station.Other points of con
nection may be established subject to approval of the Department.
Construction Connection charges and connection charges shall be dete£^*^£«J£
ment.
Information concerning the estimated cost or facilities must of!^^"««consulting engineer.All co3t6 of engineering and construction will be the respon
XliM of the property owner.In addition,the Department's standard water ande^rionnection^chrrgel will be required Easements must be provided covering any
on-site facilities,which will be owned and operated by the Department.
The availability of water and sewer service for the subject property is conditionalJonZapprovalofvariousregulatoryagentsand-continuing -'^-^commitment can be made at this time.Consequently,this letter is for informal
purposes only and is not intended as a commitment for service.

All conditions noted herein are effective only for thirty (30)days from the date
of this letter.When development plans for the subject property are finalized,
and upon the owner's request,we will be pleased Co prepare an agreement for water
and sewer service,provided the Department is able to offer those services at the
Cime of the owner's request.The agreement will detail requirements for off-site
and on-site facilities,if any,point of connections,connection charges,capacity
reservations nd all other terms and conditions necessary for service in accordance
with the Department's rules and regulations.

Staff reviewed the response from the South Florida Regional Planning Council (SFRPC)
regarding South Miami's three Comprehensive Plan amendments.
Report on recent City Commission action appointing a Zoning Task Force to assist in a
comprehensive review ofthe City's Land Development Code.
Staff related that the City would be forming a Zoning Task Force for future review of the
Land Development Code (LDC),per resolution adopted by the City Commission in
December 1999.
The Board expressed concern that the area of the City west of US 1,such as the CRA,be
adequately represented onthetask force.
