A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,RELATING TO A REQUEST FOR
A SPECIAL USE PERMIT FOR A "RESTAURANT,GENERAL,"
PURSUANT TO SECTION 20-3.4 (B)(4)(b)OF THE LAND
DEVELOPMENT CODE,REGARDING THE PROPERTY LOCATED AT
5701 SUNSET DRIVE,TENANT SPACE CI8,SOUTH MIAMI,
FLORIDA 33143;PROVIDING FOR A LEGAL DESCRIPTION;AND,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,the applicant,China Grill Cafe Sunset,
Incorporated,on behalf of Bakery Associates,Ltd.,hasmade
application,inordertorequestaSpecialUsePermittooperate
a "Restaurant,General,"tobe located in the "SR"Specialty
Retail/Residential district and in the Hometown District,
pursuanttoSection 20-3.4(B)(4)(b)andSection20-7.12 (A)ofthe
City's Land Development Code;and,
WHEREAS,the property is located as part of 5701 Sunset
Drive,South Miami,Florida,33143,and is legally described ina
document attached hereto and labeled as,"Exhibit 1;"and,
WHEREAS,the property owner has submitted a letter of intent
authorizing the future use proposed by the applicant;and,
WHEREAS,Planning &Zoning Department staff has recommended
approvaloftheapplicationforaSpecialUse Permit,which
recommendation is based upon (a)the merits ofthe application
and (b)consistency with theCity's adopted Comprehensive Plan;
and,
WHEREAS,on June 30,1998,the Planning Board voted 6:0 to
recommend approval ofthe Special UsePermit;and,
WHEREAS,the Mayor andCity Commission ofthe City of South
Miami desire to accept the recommendation ofthe Planning Board.
NOW,THEREFORE,BEIT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.TherequestsubmittedbyChinaGrillCafe Sunset,
Incorporated,tenant,foraSpecialUsePermittooperatea
"Restaurant,General,"which istobe located in the "SR"

Specialty Retail/Residential district and the Hometown District,
pursuant to Section 20-3.4(B)(4)(b)and Section 20-7.12(A)of the
Land Development Code,is hereby granted.
Section 2.This approval is subject to and dependent upon
the restrictions and limitations of the "Restaurant,General"use
to the project at 5701 Sunset Drive as indicated on the submitted
plans.
Section 3.The City Manager may revoke this approval upon a
determination that any other portion of the property,legally
described herein,is being utilized for restaurant purposes,
including storage,food preparation,deliveries or any services
related to restaurant uses,which are not authorized and licensed
by the City of South Miami forthe subject property.
Section 4.The City Manager may revoke this approval upon a
determination that any other property is being utilized for
restaurant purposes,and such use is related to the subject
property,but such usehasnotbeen authorized and licensed by
the City of South Miami,including storage,food preparation,
deliveries or any other services related to this restaurant use.
Section 5.The City Manager shall have final approval and
authority over all matters regarding the determination ofthe
applicant's compliance with the intent of these sections.
Section 6.This resolution shall take effect immediately
upon approval.

OnApril1,1997,theCity Commission approved Resolution No.64-97-10035,allocating the
Shopsat Sunset Place atotal of 61,250squarefeet of restaurant space.

Thedefinition of General Restaurant,special use conditions for alluses,andspecific conditions
for General Restaurant are included below:
DEFINITION [from Section 20-2.3;found on page 16 ofthe Land Development Code]
Restaurant,general.Shall meanan establishment where the principal business isthesale of food and beverages to
thecustomerina ready-to-consume state and where the design or principal method of operation consists of either of
thefollowing:
Sit-down restaurants where customers are normally provided withan individual menuandfoodand beverages are
generally servedin non-disposable containers bya restaurant employee atthesame table or counter atwhich said
items are consumed;or,
Cafeteria-type restaurants wherefoodand beverages are generally servedin non-disposable containers and
consumed onthe premises.Allsuch cafeteria-type establishments shall provide onlyinsideor patio service on
privateproperty.
CateringserviceshallbeallowedasanadditionaluseintheSRzoningdistrict.
Ineitherthecase of Sit-downor Cafeteria-type restaurants,public streets,rights-of-way,andsidewalksmaynotbe
usedforpatioor street-side services of anykind.Thisusemay include takeoutservice,butexcludeanyservicetoa
customerinamotorvehicle.Seatingmustbeprovidedforall patrons diningonthepremises.
Theproposeduseislocatedinthe "SR"SpecialtyRetail/Residentialzoningdistrictandthe
Hometown District.A "restaurant,general"ispermittedasindicatedunderSection20-7.12(A)
of theLandDevelopmentCode [use listedon page 156];however,theuseisnotedbyan asterisk
whichisexplainedunderSection20-7.12(C)[foundonpage 158],indicatingthat"usesmarked
withanasterisk require aspecialusepermit."Thus,suchusesmustmeetthe requirements for
specialusescontainedunder Section 20-3.4andSection20-5.8 of theLand Development Code.
TheserequirementsarethesamethroughouttheCity,andexcerptedsectionsareincludedbelow:

(A)General Requirements (fromSection20-3.4;foundonpage39 of the Land Development Code)
(1)Allsuchuses shall complywithall requirements established inthe appropriate zoninguse district,unless
additional ormore restrictive requirements areset forth beloworbytheCityCommission.
(2)All suchusesshallbedeterminedtobe of a compatible andcomplementarynaturewithanyexistingor
plannedsurroundinguses.

(3)A public hearing shall be held bythe City Commission to determine the overall compatibility of theuse
with the surroundins neighborhood.

i.Allsuch establishments shallprovideonlyinsideorpatio service onprivateproperty.Public
streets,rights-of-way,sidewalksandrequiredsetbacksmaynotbeusedforpatioorstreet-side
services of anykind.
ii.No services of a drive-in or of afastfoodnatureshallbe permitted.
iii.TheCityCommissionshallreviewandrecommend approval,disapprovalormodification of all
siteplansandprojectspecificationsforthisSpecialUsePermit.
Staff believes thattherequestedspecialusecomplieswiththeoverallrequirementsstatedunder
Section20-5.8 of theLand Development Code[foundonpage 111],regardingtherequired
conditions forspecialuseapprovalbytheCity Commission.Specifically,staff findsthattheuse
meets theconditional requirements setforthinSection20-3.4andthattheuse:
a)Willnotadverselyaffectthehealthorsafety of personsresidingorworkinginthevicinity of the
proposed use [Section 20-5.8 (B)(1)(a)];
b)Will notbedetrimentaltothepublicwelfareorpropertyorimprovementsintheneighborhood
[Section 20-5.8 (B)(1)(b)];and,
c)ComplieswithallotherapplicableCodeprovisions[Section20-5.8(B)(1)(c)].
OnJune30,1998,thePlanningBoardvoted6:0to recommend approval of thesubject
application.

Froma visual perspective,theCafeisbeingdesignedto extend China Grill's
concept of culinary theatre.These cafes will incorporate manynew visual and
dining features guaranteedtobethetalk of thetown.EachCafetakesthe
open,exhibition kitchen for which China Grillis world famousandadds video
and robotic elements designed to enhance the dining experience.Throughout
the restaurant,there will be video cameras capturing the essence of theChina
Grill experience and transmitting these vignettes live throughout the restaurant.
There will bea huge video wall capable of showing seven different images or
feeds,as well as video monitors strategically-placed inother areas of the
restaurant,including the bathroom facilities,sothat every diner gets the
imagery of theChinaGrill experience.
In addition tothe video and audio components of thenew Cafe,China Grill
intends to take cafe dining tonew culinary levels by introducing in addition to
its regular waiter service,satay grill and dimsum exhibition cooking areas
surrounded byconveyorbeltsand robots capable of delivering the just-cooked
fooditems direcdy tothe customer,on small plates with translucent covers.
Nomorewaiting for yourserverto deliver yourfood.Now,if youseeitand
wantit,you have theoption of reaching out and grabbing your food selection.
And,for thosenot seated bythe exhibition cooking areas,uniquely designed
robotic carts will circulate throughoutthe restaurant withthese food items and
drinks for the customer's immediate gratification.Inthe spirit of China Grill,
these Zen-like robots willinteract with diners,while simultaneously
transmitting the video andsound images tothevideo monitors placed
throughout the restaurant.
While others have tried toadoptthe style,ChinaGrill still holds its position as
the original,thanks to its mission to keep World Cuisine more fission than
fusion,more constant and bold inventiveness than just a simple blending of

3.Staff noted thatthe City Commission hadapproved61.250squarefeet of restaurantspacefor
the Shops andthatthe Planning Boardhad approved 34.147squarefeet of thetotalthus far.
4.Staff related details of the application,including the proposed area of therestaurantas 6,551
square feet,providing sufficient seating for300 customers located both inside and outside of the
restaurant.
5.Staff further noted there will be "extensive"outdoor seating/dining that would createand
enhance apedestrian atmosphere on Sunset Drive.
6.Mr.NeilFaggen signed intospeakastherepresentativeforChinaGrillCafeSunset,Inc.,
noting thatthe company has"carriedforward"tothe Shops thecafe concept being established at
other South Florida locations,including the Riverwalk complex inFortLauderdaleandthe
Aventura Mall expansion in north Dade.
7.Mr.Faggen continued by explaining that,withvariousfeaturesproposed for theShops
location,such asarobot element anda video wall element,an "upscale,exciting cafe concept"
will be created.
8.InresponsetoMr.Morton's inquiry,Mr.Faggen commented ontheanticipated"shared"
restroom facilities,specifically sink andpowderareasandhe explained that this has become a
"signature"element of China Grill establishments,including China Grill-Miami Beach.
9.Mr.Carl Levin,of the Zvscovich firm,spokeasasecondrepresentative,elaboratingonthe
proposedrestrooms,noting thattheshared areas willbelocated between the men's and women's
lavatories.
10.InregardtoMr.Basu's inquiry regarding the cafe's unique elements,bothrepresentatives
explained thefunctioning of these features,includingtheplacingand choosing of foodorderson
andfroma conveyor belt.
11.Mr.Fagan continuedbyrelating details of another feature of the restaurant,namelythat of
the "table of 30",an element thatencouragescamaraderie discussion among customers
12.Mr.Pages complimentedthe applicant onitsinclusion of anextensiveoutdoor seating/dining
area,andtheBoardconcurredthatitwaspleasedwiththeoutdoorseating/diningproposal.

IV.Telecommunications Towers
1.Staff presentedtheitemtothe Board,statingthatadditionalmaterialhadbeenprovidedinthe
Board's informational packetforreviewonthesubject.
3.Staff notedthattonight'smeetingwasanopportunitytofurtherconsiderthetopicof
telecommunicationstowers,followingconsideration of thesubjectmatterattheCity
Commission/Planning BoardworkshopheldonJune 23,1998.
4.Staff relatedideasfortheBoardtoconsiderinrelationtothetopic,includingwheretowersare
tobeplaced,whatzoningdistrictsareappropriatefortheirplacement,whatkind of towerswill
be permitted inthesezoningdistricts,andwhatwillbethecapregardingthenumberandheight
of erected towers.
5.The Board and staff began its discussion of the matter.
a.Mr.Wiscombe concurred thatanimportant consideration involveswhereandwhatkind of
towerswillbe allowed,in order torenderthemas unobtrusive as possible.
7.Staff responded that visibility andobtrusivenessare important detailsfortheBoardto consider
in developing a City of South Miami ordinance relating to telecommunication towers.
8.Staff suggested that,asmembers of theBoardcontinuetoworkondevelopinganordinance
fortheCity,theyforward comments andrecommendationsto staff for incorporation intoamodel
document.
9.Mr.CarlLevin,of the Zvscovich firm,spokeasasecondrepresentative,elaborating onthe
proposed restrooms,noting that the shared areas willbe located between the men's and women's
lavatories.
10.InregardtoMr.Basu's inquiryregardingthe cafe's uniqueelements,bothrepresentatives
