An Ordinance amending Sec.8A-1(e)of Chapter 8A of the City of South Miami's
Code of Ordinances to provide an exception for solicitation of gifts sponsored by
non-profit organizations or that benefit theCityand adopting applicableportions of
the Miami-Dade County ethics ordinance concerning such exceptions.
WHEREAS,the Miami-Dade CountyCommissiononEthicshas provided theCity of South
Miami("City")withanethicsopinionthatconcludesthatthepromotion,bymembersoftheCity
Commission,of non-profiteventsisaviolationoftheCity'sethicscode.Acopy of theopinionis
attached to this resolution;and
WHEREAS,the City's currentethicsordinancedoesnotprovideanexceptionforthepromotion
of non-profiteventsorthesolicitation of donationsthatbenefittheCity;and
WHEREAS,the Miami-Dade County ethic's code Section 2-11.1 (e)(2)does provide forthe
followingexceptionswhichincludethepromotion of non-profiteventsandsolicitation of giftsthat
benefit the County:
e.Gifts solicited byCountyemployeesor departmental personnel on behalf of the
County inthe performance of theirofficialdutiesforusesolelybythe County in conducting its
official business;
f.Gifts solicited by Commissioners on behalf of the County inthe performance of
their official duties foruse solely by the County in conducting its official business;
g.Gifts solicited by Commissioners,or their staff members,on behalf of any
nonprofit organization foruse solely by that organization where neither the Commissioner,nor
hisorher staff receives any compensation asa result of the solicitation.Asusedinthis
subsection,a "nonprofit organization"shallmeanany entity described in section 501(c)(3)of the
Internal Revenue Code (the "Code")that istax exempt under section 501(a)of theCode.As used
inthis subsection,"compensation"meansanymoney,gift,favor,political contribution,thing of
value or other financial benefit.

WHEREAS,the Mayor andCityCommissionfortheCity of SouthMiamidesiretoadoptthe
exemptionforthesolicitations of giftswhichwouldincludethepromotion of theeventssponsoredby
non-profit organizations.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Section8A-1(e)titled "Gifts"of Chapter8A of theCity of South Miami's Code of
Ordinances is hereby amended to read as follows:
(e)Gifts.
(1)Definition.Theterm "gift"shallrefertothetransferofanything of economicvalue,whether
intheformofmoney,service,loan,travel,entertainment,hospitality,itemor promise,orin
any other form,without adequate and lawful consideration.
(2)Exceptions.Theprovisionsofparagraph(e)(1)shallnotapplyto:
a.Political contributions specificallyauthorizedbystatelaw;
b.Giftsfromrelativesormembersofone'shousehold,unlessthepersonisaconduit
onbehalfofathirdpartytothe delivery ofagiftthatis prohibited under paragraph (3);
c.Awards for professional orcivic achievement;

d.Materialsuchas books,reports,periodicals orpamphletswhicharesolely
informational or of an advertising nature.
e.GiftssolicitedbyCityemployeesor departmental personnelonbehalfoftheCity
inthe performance oftheir official duties foruse solely bytheCityin conducting its official
business;
f.Gifts solicited byCommissionerson behalf of theCityintheperformance of
their official duties for use solely by the City in conducting its official business;
g.Gifts solicited by Commissioners,or their staff members,on behalf of any
nonprofitorganizationforusesolelybythat organization whereneitherthe Commissioner,
norhisorher staff receivesanycompensationasaresult of thesolicitation.Asusedinthis
subsection,a"nonprofit organization"shallmeananyentitydescribedinsection501(c)(3)of
the Internal Revenue Code(the"Code")thatistaxexemptundersection501(a)of theCode.
Asusedinthissubsection,"compensation"meansanymoney,gift,favor,political
contribution,thing of value or other financial benefit.
Section 2.Codification.Theprovisions of thisordinanceshallbecomeandbemadepart of the
Code of Ordinances of the City of South Miamias amended;thatthe sections of this ordinance maybe
renumberedor re-lettered to accomplish suchintention;andthattheword"ordinance"maybechangedto
"section"or other appropriate word.
Section 3.Severability.If anysection,clause,sentence,or phrase of this ordinance isforany
reason held invalid or unconstitutional byacourt of competent jurisdiction,this holding shallnotaffect
the validity of the remaining portions of this ordinance.
Section 4.Ordinances in Conflict.All ordinances orparts of ordinances andall sections and
parts of sections of ordinances in direct conflict herewith are hereby repealed.However,itisnotthe
intent of thissectiontorepealentireordinances,orparts of ordinances,thatgivethe appearance of being
inconflictwhenthetwo ordinances canbeharmonizedorwhenonlyaportion of theordinanceinconflict
needstobe repealed to harmonize theordinances.If theordinancein conflict canbe harmonized by
amendingitsterms,itisherebyamendedtoharmonizethetwoordinances.Therefore,onlythatportion
thatneedstobe repealed to harmonize thetwoordinancesshallberepealed.
Section5.EffectiveDate.Thisordinanceshallbecomeeffectiveuponenactment.

I will assume for the purposes ofthisinquiry that the languageusedbyany commissioner in question would befor the
purposeofencouragingmembersof the publictoparticipateinthisevent,and,thereby,topaytheregistrationfeefor
the purposeofbenefitingthedesignatedcharity.Theregistrationfeewould represent agiftinsofarasitwouldinclude
aportiontobedonatedtoaspecifiedcharitablecause.Theportionoftheregistrationfee attributable to the charitable
donation would,in effect,beagift under Section8A-l(e)(3)of the SouthMiamiCode,since the amount of the
registration feewould exceed the amount of the consideration provided for the event itself.
Unlike the County Ethics Code,the Cityof South MiamiEthicsCode does not contain an exception forgiftssolicitedon
behalf ofa charitable 501(c)(3)organization.Therefore,I wouldnotreadsuchan exception into the South MiamiCode,
which pretty closelyfollows the CountyCodeindescribing what isagift,butdoesnotinclude the exception that is
providedundertheCountyCodefor charitable solicitations.The City ofSouth Miami is permitted toimposeastricter
standard for solicitation ofgifts than does the CountyCode.
Accordingly,the broadprohibitionagainstgift solicitation underSection8A-l(e)(3)wouldapplytothis solicitation,and
the commissioner should not participate insolicitingforthisgift.

After speaking toyouonthe phone,I researched our ordinance andI didn't find,anything
thatwouldprohibitthepromotionofsuchanevent.Ithinkitwasyour opinion thatit
was prohibited bythe City's ethics ordinance 8A-1 (e)(3),Ithinkthatwhat yon were
sayingwasthatthe commissioner wouldbe soliciting agiftforthethird party,i.e.,the
corporate sponsorofthe running event 8A-1 (e)(3)prohibits a commissioner from
soliciting agiftbutit doesn't saywhetherthe prohibition involves agiftbeingsolicited
forhimselfor whether it includes a solicitation ofagift for athird party.Was it your
opinionthatit prohibits the solicitation ofagiftforathirdpartyandthatwhenthe
commissioner promotes theeventheis soliciting someone togivetheirmoneytothe
third party?
Ifthatisthe case,wouldn't itbe different inthe case ofa running event since the payment
of the registration feeisnotagiftbecausethepersonpayingthefeegetssomethingof
valueforhispayment,i.e.,theopportunitytorunintheevent?-
8A-1 (e)(3)Prohibitions.A person described in paragraphs (b)(1)through (6)shall neither solicit nor demand any

Councilman Tim Schaffer,

agenda,warned residents
thatalthoughtheywilldis

done on the roads,
"Our roads were con
structed by Miami-Dade
County,"Schafler said."We
havenocontrolover perma
nent decisions on county
roads."
Schafferwas referring to
main artery roads such as

184th Street,as well as87th
Avenue,77th Avenue and
