(2)The property is currently vacant;however,most of the existing residences in the subject property's block are currently located in non-conforming lots due to their size. (3)The three variances requested will have minimal impact on surrounding properties.Hence, the variances are also necessary to use the property and create a two-story structure within the permitted density allowed under the singlefamily residential zoning district. The subject parcel at 6345 SW62 Avenue is considered a legal non-conforming lot of record and any new construction must meet the zoning standards for the RS-4,SmallLot Single-Family Residentialzoning district.Development of the property is prohibited because the lot area of the parcel is 3,600 sq.ft.whichis below the minimum required lotsize of 6,000 sq.ft.,and because the current property frontage is40 feet,where 60 feet is required (LDC Section 20- 3.5(H)).The third variance requested is to allowa side (interior)setback of5 feet when 7.5 are required.Please refer to the proposed SitePlan,Sheet A-Q01,which illustrates the overall intent.Further,the development will comply withall other City Code requirements. In June 2008 the City Commission amended the Land Development Code to add specific criteriafor judging variance requests.LDC Section 20-5.9 (H)now requires that all variance decisions shall be based on an affirmative findingas to each of the following criterion: 1.The variance is necessary to relieve particular extraordinary conditions relating to a specific property; The requested lotsizeandlot frontage variancesarenecessarytobeabletobuild onthe property. 2.Denial of the variance would result in hardship to the owner.Hardship results if the restriction of the zoning ordinance,when applied to a particular property,becomes arbitrary,confiscatory or unduly oppressive because of conditions of the property that distinguish it from other properties under similar zoning restrictions; Adenial of thevarianceswouldbeanoppressivehardshipontheownerby preventing thepropertyfrombeing used orbuilt upon. 3.The extraordinary conditions and circumstances do not result from the actions of the applicant; The property wasa non-conforming platted lot of recordpriorto being transferred to the current owner. The approval of the variance is consistent with the City's objective to preserve the character of the designated structureandneighboring structures,andwillallow a vacant property to be used and for theCityto receive property tax.In addition, the proposed useisthe type of use consistent withthe RS-4 zoningdistrictand willbe compatible with the abutting and surrounding properties.These objectives are consistent with the stated objectives of the adopted comprehensive plan and land development code.Thevariance requested will have no impact to surrounding properties. At the May 12,2015 Planning Board Meeting,the board reviewed application PB-15-005 for the requested variances,andfollowingapublic hearing on the application,voted 4ayesand1nays to recommend approval of the variances as requested. Recommendation The Planning Board recommends approval of the request as presented.TheCityCommission can approve the application as submitted,approve with conditions/modifications or deny the application.Should the Commission recommend approval of the requested variances,the development will complywith the RS-4 Small Lot Single-Family Residentialzoningdistrict, Section20-3.5(H),Dimensional Requirements,includingmaximumbuilding height of2 stories (25 feet),maximumimpervious coverage of45 %andall other CityCode requirements.
