RESOLUTION NO.075-15-14414 A Resolution repeating Resolution No.134-13-13952 which granted approval for a special exception tothe parking requirements for a general restaurant locatedat5818SouthDixieHighway within theSpecialtyRetail "SR",Hometown District Overlay "HD-OV". WHEREAS,Rice South Miami,LLC submitted Application No.PB-13-016 on April 26, 2013 requesting approval ofa special exception to the required number of parking spaces to establisha restaurant locatedat5818SouthDixie Highway withintheSR (HD-OV)zoning district,said project to include 38 restaurant seats within approximately 4,000 square feet of restaurantspace,requiringatotal of 40parkingspaces;and WHEREAS,theapplicantwas requesting aspecialexceptionwaivingstrict compliance withthe Hometown District Overlay parking requirements;and WHEREAS,theCityCommission,atitsJune 18,2013meeting,grantedapproval of the application forspecial exception towaivestrictcompliancewiththe Hometown District Overlay parking requirements via Resolution No.134-13-13952 WHEREAS,theCity Commission,atitsSeptember16,2014 meeting,approved OrdinanceNo.20-14-2198,amendingSection20-7.12 of theCity of SouthMiamiLand DevelopmentCodereducingtheparkingrequirementforrestaurantswithintheHometown District Overlay (HD-OV)Zone;and WHEREAS,RiceSouth Miami,LLC no longer needs a special exception approval from the City Commission since the Hometown District Overlay parking requirements have changed; and WHEREAS,the City Commission desires to see businesses thrive in the city and desires thatthe revised parking requirements should apply to Rice South Miami,LLC aswellasall other businesses in the Hometown District. NOW,THEREFORE,BEIT RESOLVED BY THE MAYOR AND CITY COMMISSION OFTHE CITY OFSOUTH MIAMI,FLORIDA: Section 1:Resolution No.134-13-13952,which gave Rice South Miami,LLC a special exception to waive strict compliance with the Hometown Overlay,is hereby repealed in part by amendingtherequirednumberofspaceswhichareherebyreducedbv half forone year following thedateofthis Resolution.Thereafter this Resolution shall sunset andRice South MiamiLLCshallcomplywiththeCity'sLand Development Codeasitexistsatthat time- Section 2:Rice South Miami,LLC shall hereafter be responsible for all required on-site parking spaces for the use ofa general restaurant at 5818 South Dixie Highway as required by the Hometown District Overlay parking requirements. Section 3.Severability.If any section clause,sentence,or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction,the holding shall notaffectthe validity ofthe remaining portions ofthis resolution. Analysis: On September 16,2014,the City Commission adopted Ordinance No.20-14-2198,amending Section 20-7.12of the Land Development Code.This amendment revised the formula utilized incalculatingthe minimum amountofrequired parking spacesforbothgeneral restaurants and walk up restaurants that are located in the Hometown District.Since the restaurant has not opened,and therefore has not availeditselfof the original approval of the CityCommission related to the original parking requirement and the waiver,the restaurant wishes to utilize the new requirements currently required by ordinance. Staff revieweddatafroma2007statisticalanalysis of parkingbylanduse,specificallyfor familystylerestaurantswithmenusormenuboards.Theanalysissuggeststhatwhile1 spaceper 100 squarefeetisa common standard,thenumberofseatsisabetterpredictorof peakparking demand.Thedatasuggeststhatarate of 1parkingspaceper 2-seats wouldbea reasonableapplicationforthislanduse.Thisrate of 1-space per 2-seats translatesto19 parkingspaces;2morethantheapplicantproposes. ThestaffhascomparedtheprojecttoeachofthesevencriterialistedintheLDC,andhas determinedthattheproposaltoconverttheexistingretailspace(Z-Mattress)toarestaurantuse advances the economic development oftheCityandis compatible withlanduse,density,and willbe required to follow the design criteria established forthe Hometown District.The parking requirement istheonlyissue deficient tothis proposal.Based upon this review the Planning Department findsthatthe proposed development supports the granting of special exception for waivingstrict compliance withtheparking requirement. The Planning Board atits meeting on June 11,2013,the board held a public hearing on the request. The Board discussed the constraints of the siteas well asthe fact that the actual customer seating area occupies approximately 1,500 square feet.Ifthe parking was calculated onthe proposed seating area only,the applicant would need to provide 15 parking spaces (1 per 100 square feet). The board also took into account the proximity of the City's surface lot behind this proposed use. They discussed the applicants proposal for providing 1 parking space per 2.5 seats and agreed to aratioof1 parking spaceper2 seats.Following thepublic hearing and additional discussion, the board voted unanimously to recommend approval ofthe special exception for parking within theHometownDistrictOverlaywith staffs recommendations. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA THAT: Section 1:SpecialUse Application (PB-13-015)submitted by applicant Rice South Miami,LLC,for approval to operate a general restaurant located at 5818 South Dixie Highway, within the Specialty Retail "SR",Hometown District Overlay "HD-OV zoning district is hereby approved subjecttothe following termsand conditions aswellasall applicable City ordinances,codes,rulesandregulations: (1)Adheretothe Special Conditions applicable in Section 20-3.4(B)(4)(b) General Restaurant and Section 20-5.8 Special Use Approval ofthe Land Development Code,listed. (2)Theparking agreement between the applicant andtheCityforthe necessary parking spaces must be completed prior tothe issuance ofthe Business Tax Receipt for thewalkup restaurant. WHEREAS,the City of South Miami (the "City")adopted the Hometown District Overiay (HD-OV)in order "to invigorate the economic and social vitality of South Miami's "main street5'business center;"and WHEREAS,one ofthe guiding principles ofthe HD-OV isto implement a parking code that recognizes theshared parking benefits of vertically mixeduse development andthe opportunities ofanenhanced Metrorail connection;and WHEREAS,consistent withthe intent and purpose ofthe HD-OV,theCity desires to modify the parking requirements within the HD-OV to better reflect parking demands for the non-patronareas ofrestaurants;and WHEREAS,theCityAdministrationhasrecommendedapprovaloftheOrdinanceto more equitably addresstheparkingrequirements for restaurant usesinthe HD-OV;and WHEREAS,theCityCommissiondesirestoaccepttherecommendation of theCity Administration. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Section 20-7.12 of theCity of SouthMiamiLand Development Codeis hereby amended to read as follows: 20-7.12 Permitted uses. Theusesbelowareapplicabletobothnewandexistingbuildingsinthe Hometown District: USE TYPE Unadjusted Parking Requirements: 1 parking space required per:1 A.Storefront Uses *** Restaurant,GeneralorWalkUp*100 SFdevotedto patron use 300 SFdevotedto non-patron use *** *** *Uses marked with an asterisk require a special use permit with city commission approval.All other usesare permitted of right.Outdoor dining is permitted ofrightin special pre-approved areas(seeRegulatingPlan). Section 4.Ordinances in Conflict Allordinancesorparts of ordinancesandall sectionsandparts of sections of ordinancesindirectconflict herewith areherebyrepealed. However,it isnottheintent of thissectiontorepealentireordinances,orparts of ordinances, thatgivetheappearance of beinginconflictwhenthetwoordinancescanbeharmonizedor whenonlyaportion of theordinanceinconflictneedstoberepealedtoharmonizethe ordinances.If theordinanceinconflictcanbeharmonizedbyamendingitsterms,itishereby amended toharmonizethetwo ordinances.Therefore,onlythatportionthatneedstobe repealed toharmonizethetwoordinancesshallbe repealed.
