A Resolution supporting the Town of Surfside's resolution urging the State of
Florida Legislature and the Florida Department of Environmental Protection
("FDEP")to establish chemical testing standards prior to issuing acoastal
construction control line ("CCCL")permit which authorizes the transfer and
placement of excavated sand seaward of the coastal construction control line onto a
public beach.
WHEREAS,thebeaches throughout Miami-DadeCountyandtheState of Floridaarevitaltothe
quality of lifefor residents andtouristsalike;and
WHEREAS,itis important topreservethequality of sand that is placed onthepublicbeaches
that provide a source of recreation and relaxation for both adults and children;and
WHEREAS,theTown of Surfsideadopted Resolution No.15-2282,attached heretoasExhibit
"A",andhas requested other municipalities to support that Resolution;and
WHEREAS,the City Commission supports the Town of Surfside Resolution which requests a
change if FDEP regulations regarding chemicaltesting of sand transfer ontothebeachaspart of aCCCL
permit or similar permits issued by FDEP,for placement of sandona public beach,and urges the Florida
Legislature and FDEP to amend the appropriate sections of the Florida Statutes and rules and regulations
of FDEP,torequire chemical testing of allsandplacedeast of theCCCL.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT:
Section 1.Theabovestatedrecitalsareherebyadoptedand confirmed.
Section 2.TheCity of SouthMiamisupportsTown of Surfside Resolution No.15-2282,which
urgesandrecommendsthattheFDEPrequireminimumchemicaltestingstandardstobeestablishedby
theStateofFlorida,withtherecommendedbaselineanalyticalprofileasoutlinedinSurfsideResolution
No.15-2282.
Section 3.TheCityClerkisherebydirectedtotransmitacopy of thisResolutiontothe
GovernoroftheStateofFlorida,theSecretaryoftheFloridaDepartmentof Environmental Protection,
MembersoftheMiami-DadeCountyDelegationofStateofFloridaLegislators,theMayorandCounty
Commissioners of Miami-Dade County,theFlorida League of Cities,the Miami-Dade County League of
Cities,the Miami-Dade County Department of Regulatory and Economic Resources ("DERM"),and
municipalitiesin Miami-Dade County.
Section 4.Severability.If anysectionclause,sentence,orphrase of thisresolutionisforany
reasonheldinvalidor unconstitutional byacourtof competent jurisdiction,theholdingshallnotaffect
thevalidity of theremainingportions of thisresolution.
Section 5.EffectiveDate.This resolution shallbecome effective immediately upon adoption by
vote of the City Commission.

WHEREAS,the Florida Department of Environmental Protection (FDEP)issues permits
which authorize excavation and placement of sand seaward of the Coastal Construction Control
Line(CCCLXpursuantto 161.053,Florida Salutes;and
WHEREAS,FDEP Permit No.DA-631-S undertook the excavation and completed
transfer of sand onto the Town of Surfside beach from 96*Street to88*Street prior to May 1,
2014;and
WHEREAS,community concerns were raised regarding the chemicals of concern
contained inthe transferred sand due toa portion of the sand being excavated beneath ashewhich
was constructed over75 years ago and continuously operated;and
WHEREAS,in compliance with FDEP rules,the sand was transfened and placed onto the
beach inaccordance with FDEP Permit No.DA^31^wthomchemic^analysis being performed
onthe sand transferred and placed onthe beach;and
WHEREAS,FDEP guidelines state that sandy material excavated seaward of the CCCL
or 50-foot setbackshallbe maintained onsite seaward of die CCCLor 50-foot setbackandshall
be placed inthe immediate area of construction unless otherwise specifically authorized by the
Department,as provided byRule62B-33.005(6),FAX.;and
WHEREAS,FDEP defines beach quality sand as sand whichis similar tothe native beach
sand in bom coloration and grain size and is free ofconstruction debris,roclcs,clay or other foreign
matter,pursuantto Rule 62B-33.002(8),F.A.C.;and
WHEREAS,FDEP is currently amending Rule 62B-33,F.A.C.,Rules and Procedures for
Coastal Construction and Excavation and is proposing the creation ofa CCCL Applicant's
Handbook;and
