G, ' IES��Y The meeting was called to order at 8:00 P.M9 by Mayor J. W. G. Fritz, with Councilman Gluck, Barrow, Gresham', Bryant and Corley and Attorney Ruff responding to roll call. Mayor Fritz: Gentlemen: You have received the minutes of our last regular meeting on July 17. Mayor Fritz: The next item on the agenda is a' communication from the South Miami Chamber of Commerce, requesting approval for the expenditure by the Chamber of Commerce of a certain sum for publicity. (Reads letter.) Following discussion, Mayor Fritzb Gentlemenj I take it then that this letter is the for the ?2,000 set 'up in the budget for the purpose of publicity. You have here a breakdown, of the N2,000 which the City is financing. This, however, is not going to cover tho entiro expense. For instance, your new city map is goin; to cost more than $100, in the quantities that we will have to have them. The administration fees are going to be more than ?300 for the year. Supposing this folder and the photographs run more than 411,6507 Is the Chamber of Commerce guardntfaing that the folder will go out -- that they will supply the money from somewhere else if more funds are needed? Mrs. Dorn, President of the Chamber of Commerce, stated probably wo may have •to go out and raise a little bit more, but we will do it. I think it would be to the City's advantage to have such a booth. They ex- pact 50,000 Legionnaires at this' particular convention. suggested in the letter (not publicizing f vie had a booth such as blicizing the Legion particularly, but asking the Legionnaires to stop), and had this literature ready, it would be good for the City and would create a little bit of good will. Mayor Ptitz: Have you thought where; you would like to have the booth placed? Mr. Henry Fuller: Yes, on the North Side of the Highway, just Sou& of Red Road at the stop- light, on the railroad property, if we can. That would catch them coming and going. There will not be any, American Legion literature for sale. It will strictly be ,for the benefit of the City of South Miami. Mayor Fritz: What do you anticipate this booth would cost? Following discussion, Councilman Gluck: It wouldn't run over %50.00, =- I would say between 035. end 750. -- because if it is going to be used again in the future, it 'should be made ° of a good material and it has to be kept light., Councilman Gresham: I make a motion that a resolution be drawn authorizing; the expenditure of up to $W for the erection of a publicity booth for the American Legion Convention, and that the money be taken from the publicity fund. c Councilman Corley seconded the motion. The motion carried by a unanimous vote. Mayor Fritz: I have a communication I received this afternoon about 4:30. This letter of classrooms and a playground. Reads letter as follows:g building P yg ( ) is from the Baptist Church requesting rezoning of certain round to allow the "The South Miami Baptist Church Asso. request 'change of Zoning use through variance on Lots 1 through 5 and S2 of Lot 6 and Lots 23 through 26 and S2 of Lot 22, POINCIANA PARK, to allow erection of Class Room Buildings and use of the balance of the ground for play grounds for Church recreation use. This project is to be sponsored by all local Churches and its use non denominal in nature. Its operation is to be a non profit organization." Councilman Gluck: I make a motion that this request be referred to the Advisory Zoning and Planning Board. Councilman Gresham seconded the motion. The motion carriod unanimously. Mayor Fritz: Here is a letter addressed to the Mayor and the City Council from the Advisory Zoning and Planning Board, with reference to a,zoning change of Lots 19 through 24, Block 2, LARKI S PINES. - -- I have brought the map so that we can look at this. The request for re- zoning was for a change from R -1 to C -2. As you gentleman know from the preliminary meeting that we had on that, the alleyway actually is being used by the abutting property owners for many roasons and uses -- septic tank drain fields, hbusesp etc. This has boon done vrith the aonsont of the City over a period of years. The utilities now wish to go through this alloy and that is :ghat brought tho situation to a head. Either wo have to force the proporty ovrnors out of the alley or prevent the utilitios from using it, because thoy couldn't both use it ri Page - -3 The property owners who would be effected by re- zoning (that is the residents in that area) had objected, but if they are properly protected by proper screening and the fact that " no entrance will be allowed from South 3rd. Road and that the back part of the lot be used as a driveway and parking area, they are willing, I, believe, to make the concession. Following discussion, Mayor Fritz stated, Actually they are asking now for 'a block yell and a hedge. The block wall would be I believe, at the expense of the property owners figuring on three feet from the sidewalk back to the wall and that ground to be dedicated to the City, it would then become a City parkway and the City would maintain the hedge and the three feet Discussion followed'. Councilman- Gresham: I make a motion that this thing be tabled until the next meeting and that we obtain from these property owners owners an agreement on the wall: -- whether they are willing to put this wall up and when it will be put up. Mayor 'Fritz: May I suggest, Mr. Gresham, that you don't table it but that a- coimni.ttee of three from the Council 'work with them and bring it before the Council at the nett meeting? Discussion followed. Councilman Gresham: I will ammehcf that motion to include that a committee of three be appointed from the Council. Councilman Barrow seconded the motion. Mayor Fritz:' The motion has been made and seconded that a committee of three from the Council work with the property owners to come to an agreement and bring this before the Council at the nest meeting. Councilman Corley: Since that is all we have to call this meeting for is to find out who - will erect and pay for the 'wall, I make the motion that vie accept the Advisory Zoning and Planning Board's recommendation on this re- zoning., Councilman Gluck seconded the motion. Councilman Corley: Since that is the only bid we have r;eceived,, I make a motion that we 'accept the bid of Mr. Liberto in favor of the Pan American Bank of Miami for $3,500. This. was brought up at the special meeting of July 24, I believe, and referred over to this meeting« Councilman Corley stated he had talked with Mr. Gamiage about this as Councilman Barrow had set it up in the budget. He is willing to accept (that figure with a $90. a month car allowance, and the reason for that car allowance is for the simple reason that he is ;covering approximately 1200 miles a month in his own automobile, unless the City wishes to furnish him with s car. ` ~' Following discussion, Councilman Corley made a motion that Mr. Gammage be granted a - salary' of X325. a month, plus a $90. 'a month car allowance, and that j750•0tcar allowance be authorized for Mr. Ben C. Powell, retroactive to July 1. Councilman Bryant: seconded the motion. Councilman Gluck: At the time we, went into salaries, Mr. Shuck was away on vacations He is a Department: Head and I believe that it is no more than fair that he is entitled to $325o a month as Department Head. (Reads letter.) This would go under the head of publicity. We gave them u50 last year. Councilman Gluck: Gluck• make a motion that we spend X350 of our advertising money for .ad- vertising in theCoco lum Noman-s Cltio Book. Councilman Bryant seconded the motion. J ;dayor Fritz: Now, gentlemen, I have an item on the Agenda which I would like to bring up, and I was hoping that our Attorney would be with us at this time. He became 'ill and had to leave. I would like to bring up the question of a referendum. The main reason that I request the Council to consider a referendum at this time is that we have in- formation from the Florida Power 6: Light Co. which is to the effect that if we could give them a 30 -,year franchise, we would receive frori them approximately *15,000 a year that we are not now receiving. That is a minimum of $15,000 and as our population increases, we would receive more. It is taken on a percentage basis of the total -electrical useage in our 'area. I know of no other source that we can got electric power from and the franchise that they ask us to sign on the 30 -year basis is the same one that we now have on a yearly franchise. It will require a referendum to authorize the Council to make such a contract. AT the same time, there are other items that should be brought to a referendum. ono is our City -- merit system or Civil Service, to enable us to set up a;,;retirein3nt fund, and a condideration of transferrint the police department employees from Appointed positions pp p to employee status. There is also the ruestion of survey and sidewalks; the question of the hours of opening and° closing of liquor establishments and there are' other possible desireable changes in our Charter. Following further discussion, Mayor Fritz stated there is another reason for signing '.his° contract. If we have a franchise from the Florida Power & Light Co, that gives, us an income, we can break the present franchise with the Consumers 1Vater Company and require them to sign a new franchise, reducing the rates or refunding some money to the City, which the tax 'payers will ?receive in the way of tax reductions. ° ----- If you are in favor of the referendum then, I would suggest that the Council sot itself up as Charter Board and that, they instruct the City Attorney to start '•the necessary legal proceedings. Councilman Corey; I make a motion that this Council be set up as a Charter Change Board to call for a referendum at the earliest possible momenta Councilman Bryant seconded the motion. Gentlemen, this question has been before the Advisory Zoning and Planning Board twice and it has been turned down. Then they had a public hearing and they turned it down a third time. The main reason for turning ;down the request for adding a second story is that the old building will not take a second floors Counoilmm Gresham :: I make a motion that we accept the recomnendation of the Zoning and Planning Board. Councilman Bryant seconded the motion. Motion carried with a unanimous vote. Mayor Fritz: The next item is the general report from the,ifater Board. Following discussion, Mayor Pritz said we were asked what the Plater Board is going to do. If we are not happy with the Consumers Water Company, let's direct the Water Board to take up such matters with the Water Company. But, unless we tell the *liter' Board va at we want them to do and unless these things are reported to them, I doubt that they know anything about it. Following further discussion, Mayor Fritz suggested, Let's hold up the balance of the Agenda until a special meeting next week Councilman Corley: Some men who are working for the Sanitation Department Who are due a raise haven't got theirs yet. Everybody in the City has gotten one but them. I just want to know if you want him to go ahead and prepare the plans, so he can figure up what his fee will be. Mayor Fritz: Tell hime-go ahead. We have X8,500,. which has to include the building and Q _ everything. _ Councilman Gluck: We have a demand by individuals who want to put in their own sidew$lks Our ordinance covering specifications is as follows: "Sidewalks -- not less than five feet wide and the inside of the sidwwalk must be on the property line." Here is what Coral Gables has. (Reads Sidewalk' Ordinance from Coral Gables.) I make a motion that an ordinance be drawn up to comply with the specifications just read. Councilman Corley seconded the motion. The motion was passed with a unanimous vote. Discussion followed on street lights being put in vicinity of No. 4th Road and Pdo. 8th - Street and Mayor Fritz asked Councilman. Gluck to make a rough slmtch of the area showing the existing poles and his recommendation for street light;, and bring it in to the 'Tuesday Council at the meeting next night. Mayor Fritz said I'have hero two emergency deals hhat have to be handled. Mr. Gresham did you know about the fire over at the Davis Garage today? Councilmen Gresham ro;,7lied "no." rayor Fritz: He has a multitude of wrecked cars on the back end of his property and this afternoon one of them caught fire. The whole back end of the car burnt right over the gas tank. We have an ordinance on the books that requires that a wracked car lot be' enclosed in a ten foot walk.
