MINUTES OF THE SPECIAL MEETING OF THE CITY`
COUNCIL OFSOUTH MIAMI HELD TUESDAY EVENING,,
MAY 8, A.D. 1951 AT THE COMMMITY BUILDING AT
8:00 P.M.
The meeting was called to order by Mayor Fritz, with all members of the City
Council and Attorney Ruff present. .
Mayor Fritz stated that although the meeting had been called for the purpose of
holding a hearing on the proposed garbage ordinance, he is asking the Council for
the consideration of two resolutions providing for budget adjustments.
Followin,g discussion, Councilman Gresham, seconded by Councilman Barrow, moved that
the two resolutions providing for adjustments of the curreft budget be considered at
this meeting. Motion carried.;
Mayor Fritz read Resolution No. 408, as follows=
RESOLUTION NO. 408,
A RESOLUTION AUTHORIZING AN INCREASE OF EXPENDITURES
IN THE OPERATION OF THE POLICE, SANITARY AND MUNICIPAL
BUILDING DEPARTMENTS, RESPECTIVELY, AND Milt ING AN
APPROPRIATION THEREFORE'.
'WHEREAS, since July 1, 1950 and since the adoption of the Budget for the current
fiscal year the costs of certain supplies and equipment have increased materially,; and
WHEREAS, it is essential to the efficient administration of the City and to the
safety and welfare of its residents that these: services be maintained,
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND 'THE CITY COUNCIL OF SOUTH MIAMI - -,
FLORIDA:

A RESOLUTION TRANSFERRING UNENCUMBERED BALANCES TO
THOSE DEPARTMENTS AND DIVISIONS FOR 71HICH THE .APP
ROMIIATION FOR THE FISCAL YEAR 1950 -51 HAS PROVEN
INSUFFICIENT.
WHEREAS, appropriations for the fiscal year 1950. -51 as set forth in Ordinance
No. 215 have in some departments and divisions proven insufficient and in others
an unencumbered balance remains, and
WHEREAS, the total amount of the unencumbered balances and the excess accruing
revenues exceeds the total r,:notdut of t�,.o aoiJ"(:A-6,
SEAS, the Mayor in accordance tivith Section 23 of the Charter of the City
of South bliami has requested the transfer of certain unencumbered balances and app-
ropriations of excess revenues to those departments aril divisions for which tho
appropriation for the fiscal year 1950 -51 has proven insufficient

1 That the unencumbered balance of the following department's be reduced as

Councilman Gresham, seconded by Councilmen Corley, moved that Resolution No. 409

The hearing on the proposed garbage ordinance was next taken up, with 11 citizens in
the audience.
Councilman Corley stated he had had `Councilmen 'Barrow and Gluck and Mr. Gammge and
everybody else in on this. They had listed tho businesses, how many cans picked p
each day, and the rates arrivad at waro :,,12 00 par year par home, $90.00 business
plus 5 -3% par oach additional can. The Holsum Balery and Carl's Market alone
will pay approximately $000. por year on this basis.

Councilman Gluck stated he had talle d with Mr. Chivers, at the Bakery, vrho agreed
that it would be a fair and equitable plan but they did not arrive at any cost per
can.'
Councilman Corley stated the proposed rate ,,rill not make the department self- sustaining
but he does hope to get more new equipment. He believes that between $28,000 and
$30,000 would be paid in and stated that taking into consideration the need of a
watchman out at the pit, a building to take care of the pit supplies, etc. they can
still operate for approximately ;333,000. He dca s not believe it would be any more
than $35,000.

landlord to be responsible for the collection of the fees in his 'apartionts. If
was agreed to add that to the proposed ordinance.

DEFINING GARBAGE AND REFUSE, REGULATING THE CONTAINERS IN WHICH TO ACCUWn&.rE THE
SAME, AND THE PLACING AND MA.INTFNANCE OF SUCH CONTAL`IERS FOR COLLECTION BY THE CITY
GARBAGE DEPARTMENTS REQUIRING JKNUAL PERYLITS FOR ALL OOLLECTORS OF GARBAGE AND
REFUSE, AND PROHIBITING THE DISPOSAL OF SUCH MATERIALS WITHIN THE CITY LIMITS OF
SOUTH JaIMIJ, FLORIDA, AND A GIVEN DIS TANCE THEREFROM: RECOMIAENDING APPROVED METHODS
OF GARBAGE AND REFUSE DISPOSAL: STATING OWNERSHIP, FIXING SCHEDULES OF REASONABLE
CHARGES TO BE BADE AGAINST OWNERS, OCCUPANTS, THUNT$, AND LESSEES OF BUILDINGS
AND PREMISES RECEIVING SAID SERVICE: PROHIBITING REMOVAL OF MATERIALS FROM THE
DISPOSAL BITES: DECLARING 'UNCOLLECTED GARBAGE A NUISANCE AND PRESCRIBING A PENALTY.
Discussion re: wrapping garbage. It was suggested to put a request for this on the
notice for the permit fee.

Councilman Barrow asked to be excused at 9:20 P..fi.
After discussion re: the colored section problem of collection, it was decided to
make the owners responsible.

No. 232 be considered the first reading of said Ordinance No. 232 in its entirety.
Motion carxied
Councilman Groahan, socondod by Councilman Corley, thereupon moved that sOrdittaneo No
