1951-05-01 MINUTES OF CITY COUNCIL MTGMINUTES OF THE REGULAR 'MEETING OF THE CITY COUNCIL OF SOUTH MIAMI HELD TUESDAY EVENING, MAY 1, A.D. 1951 AT THE COWUNITY BUILDING AT 8:00 P.M. The meeting was called, to order by Mayor Fritz,, with all members of the Council, Attorney Ruff and J. H. Shartle, representing the City's engineers, present. Councilmen. Barrow, seconded by Councilmen Bryant, moved that the minutes of the last regular meeting, be adopted as individually read. Motion carried. PETITIONS & COMMQNICATIONSe Item 56. A letter from the Dade County Parks Department re: the Parks & Recreation r-Alng institute to be conducted May 6 to 10 at Highlands Hammock State Park. Councilman Gresham suggested that the letter be acknowledged with the explanation that we have no personnel that might come under this category. Item 57. A 'letter from the South Miami District Chamber of Commerce,, endorsing • the proposed street re- numboring program but urging the retention of the names of the major streets as now in use. Item 58. A letter from the Dade County Engineer, re: the proposed street re- numbering, toget r with a map of the City of 'South Miami on which he had shown the extension of the County system of street - numbering. Councilman Gresham, seconded by Councilman Bryant, moved that the letters from the South Miami District Chamber of Commerce and the Dade 'County Engineer be referred to t , the Zoning and Planning Board. Motion carried* Item 59. Letter from H. T. Drake, requesting refund of building permit fee, because of defeative title -ahich prevented his obtaining; the necessary mortgage to build. Councilman Barrow, seconded by Councilman Corley, moved that under the circumstances the $9.00 paid for building permit No. 2652 be rofunded upon surrender of receipt and 'building permit. Motion carried. Item 60. A letter of resignation from the Personnel Board, by W. S. C. Boyden. Mayor Fritz stated that he had contacted Mr. Boyden who now is willing to withdraw his resignation providing the Council has had the resignation submitted and is willing to re- instate him or re- appoint him. Following discussion, Mayor Fritz stated he will deny the Boyden resignation unless someone on the Council has a reason why the resignation should be accepted. It _ was agreed that the resignation not be accepted. Item 61. A letter from Mrs. S. M. Greene re: a property line dispute. Mayor Fritz read the letter and the file on this matter. Councilmen Gluck, seconded by Councilman Gresham, moved that -a letter be written to Mrs. Greene to ask if she can bear out the facts stated in her letter with a car - tified spot survey, that the City will be glad to work out the matter with here Mayor Fritz, re: the costs suggested if the City is in error, it will bear the expense, if it is her error that she should pay. I Page - -2 Motion carried. Item 62c A letter from the South Miami Lions Club with request for permission to erect entrance signs. Councilman Corley, seconded by Councilman Bryant, mowed that the South Miami Lions Club be granted permission to erect 2 signs under the supervision of Councilman Barrow. Motion carried. Item 63. Written report of W A. Pressley, Jr., Patrol Officer, on the proposed l u ary Police together with a list of names of the 7 men now ready to serve and schedule of shifts, was read by Mayor Fritz. Following discussion,; Councilman Barrow, seconded by Councilman Gluck, moved that Councilman Gresham proosed with the program outlined, subject to insurance coverage. Councilman Barrow stated that one of the members of this group made the highest grade in the course. Motion carried. Councilmen Barrow stated several of the group were in the audience tonight and should be given a vote of thanks. They were asked to rise and an expression of thanks by applause was given to Messrs. Leach, Arroyo, Kinney, Molina and Burmeister. Item 64. Water Board report on letter from Consumers Water Company regarding fire hydrant rental exchanged for taxes, tapping fees, deposits and extension policy., Mayor Fritz read the complete report. Y With reference to Consumers Water Company request, it was felt that it should be tabled and gone into. Re: the Southeastern Underwriters Association letter of July 13, 1950, on what it took to get the 7th. class rating, it was questioned if we still lacked a fire pre- vention code. It was thought all other requirements had been complied with. A class of about 15 members meets once a week for 15 weeks. Following discussion, Councilman Gluck, seconded by Councilman Corley, moved that a committee be appointed to look into the old code or drew up a new one satisfactory to the underwriters. Motion carriede Mayor Fritz appointed Councilman Gresham as Chairman, with Mr. McConnell and any third member Councilman Gresham wishes to appoint, Councilman Barrow, seconded by Councilman Gresham, moved that a letter be sent Mrs. Knickerbooker, Mr. McConnellts secretary, thanking her for her efforts on our behalf. Motion carried. S ecial Item. E4 L, Cotton, Sr. stated that a charter for a State Bank for South Miami has been promised and subscriptions for shares are being solicited. He also spolo of the possible endorsement by the City at 'a later dal*• The bank is to be located this side of Iced Road and 60% of the subscriptions must be from this side of iced Road. Mr. McConnell, re: the extension policy of the Consumers Water Company referred to a resolution passed by Coral Gables. Attorney Ruff stated it is 'a violation of State Law 768.10 and 768.11 to leave any hole open. Councilman Gresham was instructed to give the owner 5 days in which to correct the situation. Councilman Corley Stated Mr. Gammage would like to go on vacation before the now truck and tractor are delivered. Res a Drunkometer, Councilmen Gresham stated the cost is $225.00 but would pay for itself by getting convictions of D.W.I. cases. Councilmen Corley, seconded by Councilman Gresham, moved that bids for one Drunkometer be advertised for. Motion carried. Councilman Gluck asked "if the Stata Supreme Court turned them down. ' Attorney Ruff stated that it ruled that a man could not be condemned entirely by that but it could be used for corroborating testimony. Councilman Gresham, re: the Pension Fund, when set up - will get a percentage back from insurancee Re: the signs, he reported that the garage sign is in front Lof the property and that the Pure -Oil sign is also on Sauls' property, and they have been notified. Mayor Fritz said he will take it up. Get the Pure Oil people to take their sign and the City take out the Loyd's garage sign. Councilman Corley raised the question of painting a yellow line to indicate sidewalks from theater. It was requested by the County Commiss ioners that the City Engineer of South Niami do all the engineering such as survey, profiles, lay -out work and to work ' with the County Engineer as to sizes of culverts and drains to be placed by the county. The cost of this engineering work is estimated at $1,550.00e The County 'Engineers will install the necessary culverts under Blue Road, Mi13ar Road, Hardee Road, Sunset Road, the State Highway, South 8th. Street, South 4th. Avenue and any other roads that stop or retard the flow of water in this glade to Snapper Creek. As the project is very large and will take a great deal of time and effort, numerous methods` of work and ,payment f or work have been discussed. The City Engineer advises at the present time, the most logical and economical method for the work to be handled is on a per diem basis. This method would require a., one survey party complete with party chief and assistants, a weekly basis of approximately $550.00. City Engineers estimate that this work would require about 16 °months or app- roximately 70 weeks. This would involve a total expenditure for engineering, maps and drawings of .'x"38,500.00.
