Sarah Eormen, who signed the application, stated they intend to establish a regular

Following discussion, Councilman Barrow, seconded. by Councilman Corley, moved that they
grant the request for two months, subject to proper sanitary faciltieso

Councilman Gluck suggested surveys be required only when external ;additions or al-
terations are made and all agreed to the amendment of the ordinance to this effect•

placed on second reading by caption only. Motion carried and Ordinance Nos 230 read
by caption only.
Councilman Gresham, seconded by Councilmen Corley, then moved that Ordinance Nos 230 '
be declared an emergency ordinance sad placed on third and final reading.

Mayor Fritz stated he had placed this on the agenda to make the Council and the people
conscious of the necessity for a policy for the City employees, and suggested the
letter be referred to the administrative officers for reply.
Item (No number ) A proposal from the firm of Boaster, Godwin & Shartel, Inc. for Ong-
neer� i`ng services.
Mayor Fritz stated that no definite action is planned at this time. He believes it
should be filed for consideration•

Item (No number) Mayor Fritz reported receipt of a letter from Attorney L. C. Proby
re: Wo . c4mingtone It was received too late to be inoluded on the agenda, if the
Council desires, he would consider it as an emergency items otherwise he would hold it
over. (He passed the letterto,,the Councilmen to read.)
Mayor Fritz reported the filing of a damage suit; against the City in the George Alderman
came with the serving of papers which had been turned over to the Insurance Company.
Attorney Ruff stated there is no further report at, this time and it will be handled
by the Insurance Company's attorneys•
It was agreed that the'Proby letter rat W. 0. Carrington cannot be considered an
emiergency, and will be put on the agenda for the next regular aoetinge

In pursusnoe of legal notice-calling for same, Mayor Fritz called for the confirmation'
of Improvement H -20. Councilman Gluck, seconded by Councilman Barrow, moved that

A RENDLUTION 'CONFIRMING THE PRELIMWARY
ASSESSMENT ROLLS FOR HIGHKY IMMVEMENT H -'20.
'HEREAS, the Council of the City of South Miami, Florida, net on April 3,`1951
pursuant to legal notice of said meeting under Section #64 of the City Charter to
hear all written objections to the confirmation of the Preliminary Assessment Rolla
for the cost of work in highway district H -20, and
WMREAS, no objection thereto was made by auy person interested in or affected
by said ,rolls and the said assessment rolls appearing in all respects regular and in
aI000rdance with the requirements and provisions of the City 'Charters
NOW, 'THEREFORE, BE IT RESOLVED BY THE MAYOR AND TIC; CITY COUNCIL OF THE CITY OF
SOUTH MIAMI 't
. That the prima facie assessment as apportioned and indicated on said
Preliminary Assessment Rolls be and it is hereby in all things confirmed and sustained
against apps and all lots or parcels of the ground described therein.:
2e That the sums or amounts assessed against each of the lets or parcels of
ground in said Preliminary Assessment Rolls are loss then the "amount that each of said
lots or parcels of ground is especially benefitted by said improvement and that such.
smusts are in proportion to the special benefits that the property reoeiced and
according to frontage, and not in excess of the special benefits to the property
assessed.

So That the total costs of said improvements in the sum of 84,156.08 for
H,.20 be, and the same area hereby approved and confirmed.
4. That thirty days after the above oonfirmation of assessments, the ennount
apportioned and assessed against each lot or parcel of ground shall be due and payable
at the office of the mayor at the City Hall, but that if the owner of any lot or parcel
shall file with the Mayor before such dente on which full payment is required, his or
her written undertaking waiving all irregularity and illegality in connection -with
the said assessment against such lot or parcel, he or she shall have the 'privilege;
of paying the same in equal annual installments in each of five suooeeding years, with
interest upon such deferred installments at the rate of six percent (6q) per annum,
payable annually from the date on which such assessment,would be due if such under-
taking were not filed.

Item #39s The confirmation of Resolution No. 387 setting up Improvement District H -21.
In pursuance of legal notice and direct notice to affected property owners, a hearing
was called for this mater.
The streets and areas; as set forth in Resolution No. 387 were read.
Councilman Gluol Vie: the cost, stated that it would be '35¢ per abutting foot for a pave-
ment 18 feet wide* but that the portion of S. 12th. Street with a parkway would require
two pavements each 12 feet wide, at approximately 50¢ per linear foot, the balance will
be 35X per abutting foot.
Following discussion on extent of the area and traffic control, Mayor Fritz asked for
a showing of hands. In favor - 8. No hands opposed*

A RESOWTION CONFIRMING RESOLUTION NO. 387 ORDERING
HIMMY MWVEMINTS H -21 IN THE CITY OF SOUTH MIAMI.
WERF&S, on the 20th. day of March, A.D. 1951, at its regular meeting on that
day duly and legally held, the City Council passed and adopted its Resolution Number 387
ordering certain highway improvements to be done in said City of South Miami, a dea-
cription of which more fully 'appears in said Resolution No. 387, and
TMERUS, subsequently thereto after due and legal notice, duly and legally published,
calling and providing for the 'hearing of objections upon the part of all interested'
persons, the City Council at its meeting held at '8 o'clock P.M. on April 3, A.De 1951,
did hear and consider all objections presented by interested persons to the confirmation o'
of said Resolution No. 381 ordering said highway improvements,* and the plans, specifioat
ions end estimate of cost therefor and no objection to said improvements, plans, specific&-
tions and estimate of cost hating been sustained, the said Resolution No. 387 so order-

for the Chief of Police,

1, That the salary of the Chief of Police of the City of South Miami, to -wits

1950.51 budget under Salaries Expense for the Police Department.

SANITATION: Councilman Corley reported the survey of the City Dump which showed the fence
is 25 ft. inside of the City's property. The gate is Nelson's•
Mayor Fritz suggested notifying Nelson if that is his fence*
Reading of letter from Allied Equipment Co to Councilman Car]sy, re: trgotor, 19 T., angle
blade.'
Councilman 'Barron, seconded by Councilman Gluck moved that Councilman Corby be authorized
to advertise for bids for a bulldozer. Motion carried.
Councilmen Corley rsp'orted that as of March 14th. they were picking up 1546 residences,
145 business and 141 apartment units and that another 141 buildings were under construction.
Mayor Fritz asked if a new ordinance for garbage collection is ready and Counoilman Corley'
stated he will have it by the nest meeting.
Mayor Fritz, re: a resolution setting up an appropriation for the purchase of the truck
and loader, presented resolution No. 398, as follows

As EMHGENCY BUSINESS, Mayor Fritz presented a letter from the South Miami „Baptist Church
requesting permission to setup a -tent 20 by 30 for temporary Sunday school services.
Councilman Gresham, seconded by Councilmsn Gluck, moved that the request be granted for
two months from date with privilege to request renewal.
Motion carried.
FINANCE: Councilman Bryant gave a report of the cash receipts and disbursements for the
month of March.
FIRE`t Councilmen Gresham, reported the 25 hydrants, boxes and valves ordered at a total
coat of $3,930.00, have been shipped.

Resolution No. 378, when received. Motion carried by poll, as follows

POLICES Mr. Boyden, when asked for a ,report from the Personnel committee, reported they
had interviewed Joseph Kephart and Warren Hanson and recommended the appointment of
Kephart as a police officers as patrolman, for 6,months' probationary period.
Councilman Gresham suggested they accept the recommendation of the Personnel Board*

all effective as of April 1, 1951 and through the current budget year ending June 30, 1951,

STREETS & PARKS: Councilmen Gluck gave a financial report of his department and the work
done. He discussed a stop light at U.S. #l; and So. '8th. St. vihen that crossing is put
in. He discussed the aalary of John Shuck and his crew and recommended that increases;
be ;considered by the Personnel and 14erit Boards.
Mayor Fritz suggested he come in at the next meeting with that.

Councilman Gluck said he will give way at this time if that is to be brought up.

Councilman Gluck, seconded by Councilman Corley, moved that Councilman Barrow be authorized
to ask for for a 24 in. rotary power mower. Motion carried.
Councilman Barrow, re: stopping the use of the front yard of the Community Building for a
plaYground, said he would like permission to draw up some rules re's this.
Councilman Gresham, seconded by Councilman Gluck moved that Councilman Barrow be authorized
to set necessary rules for the protection of the Comminity Building grounds and buildings.

Mayor Fritz reported that, the Personnel :Board consisted of Messrs. Tharp and Boyden and

Mayor Fritz recommended the division of the Planning and Zoning Board into 2 divisions,
as follows

19 Revision of the Zoning Ordinance.
2. Revision of the Building Code to comply with the 'Zoning Ordinance.
3. Review of all 'building permit requests.
4. Investigate all zoning and building violations•
be 'PLANNING:
1. Plan a survey of the City to establish :line and grades.
2. Plan establishment or zoned aregsr
3. Establish improvement districts to include stroots, sidewalks, eta.
4. Plan street re- numbering program.
5. Establish traffic control routes and off- street parking•
6. Review all requests for variances.
At this point Councilman Gluck asked to complete his report. He discussed ihs need to
clarify Sunset Drive re= street lines grade lines, etc* He said he would 1110 the Plan-
ning Board to work out the street re- numbering proposition 3 months before the telephone
directory goes to press.
