1951-03-20 MINUTES OF CITY COUNCIL MTGMINUTES OF THE REGULAR MEETING OF THE. CITY COUNCIL OF SOUTH MIAMI HELD TUESDAY EVENING, MARCH 20 A.D. 1951 AT THE COYdivIUNITY BUILDIN, AT 8 :00 P.M. The meeting was called to order by Mayor Fritz with all members of the Council and Attorney Ruff responding to roll call. Mayor Fritz reported that minutes of the regular meeting of March 6, had been dis- tributed to members of the Co#noil, and read. Councilman Gluck, seconded by Councilmen Corley, moved that the minutes of the` re- gular meting of March 6 be 'adopted as individually read. Motion carried. PETITIONS AND COMMUNICATIONS: Item 12. A letter from the Florida State Chambor of ;Commerce re: an ad in the Directory. Councilman Gluck, seconded by Councilman Barrow, moved that the City place an ad not to exceed 1p100.00 in cost for that advertisement and allow the local Chamber of Commerce to'word it to the best advantage of the City. Motion carried. Item 13. A letter from the Advisory Zoning and Planning Board, addressed to the Mayor and CiTty Council, 'recommending the retention of Ben Powell as Building Inspector because of his efficient work in that capacity. Mayor Fritz stated there would be no action at this time because the matter will come up-, under regular order of business under "appointments." Item 14.' A letter from the - Advisory Zoning and Planning Board, to the Mayor and City Councl , stressing the need of the services of a full. -time qualified en 'Weer in various phases of municipal work, including zoning and planning. - Councilman Gresham stated he would like to see the new firm of engineers,that have come into South Miami given a chance to come into this. Councilman Gluck stated that he and Mayor Fritz had .meetings with !members of the Rader- Cneppen- Tippets Etrgineering Company. Mr. Rader was personally present, and stated they have complete staff for all kinds of engineering. Their proposal was for a $100,00 per month retainer, and fees for definite projects, and the entire proposal of the f irm of Rader- Knappen- Tippetts was read: Following further discussion, Councilman Gluck, seconded by Councilman Corley, moves that the City Council moot with the Zoning Board, if agreeable to them, Friday evening,, to discuss ways and means of planning for the future of the City. Motion carried. Item 17. A letter from the Rev. Rarvey Morrison, asking permission to continue using the Community Building for Sunday School services. Councilman Gresham, seconded by Councilman Bryant, moved that they grant 'permission to the South Miami Baptist Church to continue using tho Community Fuilding as r,o- quested, for Sunday .school purposes. 14otion carried. e Page- 2 Item 18. Conference. , Councilman Gresham, seconded by Councilman Bryant, moved that the City send a check a for $50.00 for the City's share of expense in the forthcoming conference of the American Planning and Civic Association. Motion carried and Ordinance No. 229 read by caption only. Item 20. A letter from Wallace Tropp, red: the S. 5th. St. "tobacco road" conditions. '.. Mayor Fritz read the letter, in which &ir. Tropp acknowledged satisfaction as to the road improvement. Councilman Gresham, seconded by Councilman Corle y, moved that the com.aunication be filed. Motion carried. Item 21. -A letter from Rader- Knappen- Tippetts Engineering Go. setting forth an offer for engineering services on a retainer basis of X100.00 per month and fees for add- , itional work. No act-ion taken at this time as this had been covered in an earlier item. Item 22. Re: the Frost matter. Following discussion, in which 1,Ir. Frost stated he had rejected the City's offer, and I.iayor Fritz stated this Council has gone as far in e monetary way as it could, Councilman Gresham, seconded by Councilman Corley, made the, motion that 'they, have 3 real estate man appraise that corner and, -ahatover they appraise on it, have the Frost Tien deducted from the it valuation of it and he be offered the difference. Ave., and the condition of the pavement in S. 1st. Ave. from S. 8th. St. to S. 12th. Ave. Councilman Gluck also reported that the complaint was being corrected by the placing of signs. A letter from the South 'Miami Civic League, re: re- ntunbering the streets and offering their services in the project. R S. McClelland, Asst. Supt. of the I,liami P.O., said he thought it would be an im provementp but that it would be a greater advantage to the citizens of South Mian than to anyone else. Councilman Gluck, seconded by Councilman Gresham, moved that the communication from the South Miami Civic League be placed on file and thank them for their offer o£ help.' Motion carried. Item 33. A request by Dr. Ira K Brandt for a variance to permit a doctor's office, in a proposed residence. Councilman Gresham, seconded by Councilman Corley, moved that the request be referred to the Zoning Board. Motion carried, Item 26. :Clarification of scope of responsibility and authority of Committeemen. Requested by Commit Leeman J. M. Bryant. T This was originally scheduled under "New Business," but Councilman Barrow, seconded by Councilman Corley, moved that it be taken up at this time. motion carried.' Councilman Bryant stated that he is asking for clarification by the City Attorney on the question of the :authority of the Committeeman on Finance with reference to the City Hall employees. Attorney Ruff stated he had prepared an opinion, which he read. Followsng considerable discussion,, Mayor Fritz, roe a leave of absenoe granted without consent of the Council to an employee in the City ball, said it was because of a question of whether the Committeemen of Finance had authority to grant it without consulting the Mayor or the Council that the whole question arose* Councilman Bryant said he wants someone also to clarify the matter, he has stated ' his position. Councilman Gluck asked what is the condition of leave of absence. Councilman Bryant stated it involved P. 1). Loylesc who has a seniority with the F.B.C.;Ry., but is on the extra board subject to call only during the rush months. Mr Loyless explained his position. Loyless be granted' 22 hours off ';3 days a week, until April 15, and that it be deducted from his salary. With the resumption of business, Mayor Fritz brought up as an emergency measure, the written request of J. P. Jackson for the. use of the Commnunity Building' the 2nd. and 4th. Friday afternoons, from 2 to 4, for the meetings of the Townsend Club. Councilman Corley, seconded by Councilman G �eshwri, =moved that the Townsend Club be granted the use of the Com�mznity Buildng_ free. of charge from 2 to 4 P.M. every 2nd. and 4th. Councilman Barrow stated he had checked through the records and f ound- that Wednesday was the only open date through the month and 'believes it should be held for local people. Councilman Gresham, seconded by Councilman Bryant, moved that the request of the ry Dade County Employees Union for the use of -life Community Building be denied. The Grace Bower matter of right -of -way, preNented by Attorney Proby. :Following discussion, in which the question of sidewalks, and of jurisdiction - County vs. City - was raised, Councilman Gresham, seconded by Councilman Barrow, moved that Mrs. Bower has the privilege to block off this •"property until the City can get an overall; plan and determine how much is necessary for a sidewalk. Councilman Gluck named George Hollahan for City Judge. Councilman Bryant named Clement L. Theed for City Judge,. Messrs. Tatum was named Chief of Police. Councilman Corley asked to be excused. Mayor Fritz asked him to remain. ' I4iayor Fritz stated McKinney is an employee of the City on a permanent basis. Does this mean that McKinney is still on the police force but no longer Chief of Police? Attorney Ruff answered "no," that McKinney is an officer and not an employee. Following discussion, Councilmen Barrow, seconded, by Councilman Gluck, moved that a petition for declaratory decree be presented to the Circuit Court to resolve the question "Does each now City Council have the authority to appoint the Chief of Police as designated in Section :5 -a -2 of the Charter as amended after they have taken office?"
