MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF SOUTH MIAMI HELD TUESDAY' EVENING, MV1h1BER 7, A.D. 1950 AT THE CITY HALL AT 8s00 P.M. President ;Prebish called the meeting, which was 'being held at the City Hall because of the General Election at the Community Building, to order, with Councilmen Proble, Rebozo, Gresham end Probish responding to °roll call and Councilmen Carballo and Andrevis, Mayor Acker and Attorney Ruff joining the meeting somevdiat later. Minutes of the regular meeting of October 3rd., of the adjourned meetings of October 10 and;16, of the special meetings of October 18 and 24, were respectively read and approved as read. - President Prebish read the legal notice calling for a hearing of obdections to the con- firmation of the rpreliminary assessment liens for H -16, published October 25 and Nova 1 in the Miami Daily News. Carp Gluck, representing the American Legion Post, stated that in view of their de- 'dication of lands, and streets alroady built by them at their expense, it is the re- quest g a their property is concerned. (This figure was erroneously stated,acorrect sfiauro is $179.55). Following discussion between Councilmen RebO£O and Andrews, and Mr. Gluci. , in which Mr. Gluck also pointed out that their building is used for civic purposes at no expense to the organizations and serves as a storm shelter for the entire community, Councilman Reboeo, seconded by Councilman Gresham, -moved that the request of the Legion be granted* Motion carried. J. P•, Jackson discussed his assessment, but after discussion made no objection. That the total cost of said improvements in the sum of 43,179.99 for H -16 be, and the" same are, hereby approved end confirmed. 4. Frye appeared before the Council in connection with a proposed Youth Center for the colored section. She stated that Marshall Killiamson had agreed to sell a trabt of land 65 ft. by approximately 150 ft. for $1200., adjoining the colored school property,, that the .colored people would put up the building. Following_ discussion as to the extent to which this should be done, by the City or by i, subscription, President Prebish named the following committee: Councilman Gresham as chairman, with Councilman Carballo and Mr. Boyden to serve with hint Mrs. Frye stated these people want to show their good faith by putting up the building. They ask only for the ground and to have it bull - dozed. Councilman Carballo stated Cecil Carter agreed to bull doze the property as his donation. A letter from J B. Slocum requesting interpretation of a zoning classification for a proposed open -air dairy store was read. Councilman Preble, seconded by Councilman Gresham, moved that it be referred to the Z oning Board. Motion carried. A letter from Hurry D. L. Kaye, M.D., asking for a change to liberal rohing on his lots in Block l WESTERF'IELD IWOR, was rend. After considerable discussion regarding wor�ing of releaseq Councilman Reboz6 asked if it would be proper to emend resolution If-366 by dropping the last sentenose Attorney Ruff replied they can amend the resolution, but the question is whether it is proper to .do what they are doing. The re- imbursement of monies is not necessarily proper. A short recess was declared at 11:00 P.M. and business was resumed at 11:150 Councilman Preble, seconded by Councilman Rebozo, moved that the City Clerk be instructed to accept the release submitted by Mr. Carballc and issue the necessary check to cover. Attorney Ruff, re's the Canington suit, reported that the Circuit Court has dismissed the suit but that Attorney Proby indicated his intent of carrying on the suit against B. C. Powell• Mr. Canington cannot collect from the City for any back salary, however* Councilman Andrews stated he believes Attorney Ruff should be commended for the work done on this case* The following bills were submitted for approval and payment.
