MEETING Or THE CITY COUNCIL OF SOUTH MIAMI "HELD WEDNESDAY EVENING AUGUST 16, A.U. 1950 AT THE COISIUNI TY BUILDING AT 8:00 P M. The meeting was called to order by President Probish with Councilmen'Prebish, Carballo, Corley and Gresham responding to roll call. Minutes of the regular meeting of August lst. were approved as read. Petitions and Co=mnications were as follows a. A letter from Robert B Goeser asking that the first matter of business to be considered at this meeting be the payment of the July 1950 bills. A recom andation for a variance permit on Lots 11, 12 Block 3, TWTERFIELD y MANOR, to permit the erection of a doctors'' office building as follows "It is therefor recommended that a varianoe be granted on this property permitting the erection of a doctor's office building limited to two professional medical men, the building, to meet all residential set -back requirements, to be of residential ' character and not over 1 -story high. Sufficient off - street parking should also be provided. N An ordinance incorporating' these reoommendations has been prepared by the City Attorney at our request and is submitted herewith for your consideration." Councilman Gresham, secondediby Councilman Carballo, moved that Ordinance No. 218, caption of which follows, be placed on'first reading in its entirety. Motion carried and Ordinance No. 218 read. President Prebish suggested that Councilman Carballo ask the City Attorney to prepare one for the next meeting. 2. The Board submitted the following recommendation regarding a proposed lat for the subdivision of the Dexter Saunders property, legally' described as W21SW, -SE -NE4, Section 36- 54-40: "A proposed plat for the subdivision of the Dexter Saunders property, legally des - N as 11F2`- WISE$ -NE4- Section 36- 54 -40, was carefully gone over. As presented, it meets the zoning requirements of miniim m frontage, lot size, and right -of --way and the Board recomrends the tentative approval of this plat." Councilmen Gresham,_ seconded by Councilman Carballo, moved that they accept the recommenda- tion of the Zoning Board and give tentative approval to the plat. A request from the Pullman Furniture Company for a change of zoning of property acquired by them immediately adjoining their store, was referred to the Zoning Board for hearing upon motion by Councilman Gresham, seconded by Councilman Corley, and carried. c. A request by Henfy Fuller, attorney for Virginia Daniels, for a place on the agenda to present her application for an occupational license as realtor, in accordance with Sec. IX (1.) of Ordinance x{98, Auxiliary Uses, which refers to home occupations,, office and studios in Residence and Apartment Districts.; Upon Mr. Fuller's assurance that Mrs. Daniels would observe the rules regarding signs, Councilman, Corley, seconded by Councilman Carballo, moved that her application for license be granted. Motion carried. d. A request by Frank Me Barks,, attorney, for a place on the agenda to ask re-con- sideration Of the application of the Levine Harlem Inn for a beer and wine 'license. Mr. Marks pointed out that Mr. ;Levine had applied both in November 1949 and again in April 1950 for a beer and wine license but was not granted one. He stated Mr. Levine operates a restaurant, and referred to Ordinance No. 128, as amended by No. 153. Mr. Marks said the state license had been granted and Councilman Gresham remarked that the state had gone overboard on that. There was discussion regarding requirements. The rocotmnendation of the Zoning Board on December 20, 1949 was read., Councilman Carballo stated the Council accepted the recommendation of the Board but failed to make an ordinance, therefore cannot deny the man his license. Councilman Grosham'stated this application has boon before the Council twice and thinks the City has the authority and ,moved that the application be denied. Motion lost for lack of a second. Councilman Corley advised that insofar as using the Lime Plant for an incinerator(one of the County s 'recommendations) that the people in the neighborhood are against it.` There was .a discussion regardin the Paragon Construction Co. services (a garbage collection service now used by West Miami. Councilman Carballo suggested using the Coral Gables incinerator, dealing with the Paragon Construotion Co., or building our own incinerator. He suggested the appointment of a committee to go into this right now and report as soon as possible. President Prebish named Councilman Corley as Chairman of such a committee to choose his own committee, and Councilman Corley asked Councilmen Gresham and Carballo to serve with him. f. it letter to Mayor Acker from the C000 Plum Women's Club, asking for a donation in the form of an ad, in their year book„ at $20.00`, to help with their library fund. Motion carried. At this point a short recess was declared and business resumed at 9:46. He suggested knocking out the garbage service foe and using the excess money we are going to have for the operation of that department. Mr. Fritz, re: the Cigarette Law and the $16;,000,stated that we must report by October 1st. as to how this money will be spent. He believed reducing to 14 mills sufficient and that the money be used for the curtailment or abolishment of the sanitation, tax. Following further discussion in which Councilmen Carballo urged staying on the 14 mills but spread the money around, Councilman Gresham asked to be excused at 10:26. This left the meeting without a< quorum, and following informal discussion, the remaining Councilmen adjourned the meeting to 8 :00 P.M.
