The meeting was called to order by Chairman Andrews,, with Mayor Acker.,
Atty. Yates, and Councilmen Yrebish, Corley, Carballo, Andrews, Preble
responding to roll call.

Pres. Prebis�i read the notice for the meeting which had been called for
the purpose of having a third and final reading of the !Ullage Ordi-
nance, h?o. 190.
Councilman Andrews, seconded by Councilman Yreble, moved that Urdizance
No. 190, caption of which follows, be placed on third and final reading
in its entirety. notion carried.

Thereupon Councilman Andrews, seconded by Councilman. Freble, moved that
a Ordinance No. 190 be adopted as read.
In discussion, Councilman Andrews stated that there was some question re-
garding the validity and legality of the two mills assessment for a
street fund and asked whether there was any statome4 from the attorney,
Bitty. Yates replied that in his opinion the two mills levy for the
street fund is questionable inasmuch as it is not backed up by a
prior appropriation in the budget, but not necessarily illegal.
Following discussion in which members of the audience also participated,
Councilman Carballo,'seconded by Councilman Corley moved that the parts
referring to the Wo mills in caditzance #190 be stricken.
Vollowing, discussion, Councilman Andrews asked if Urdinw-ice #190 is
taken, to Court and declared invalid, what would apply, the whole ordi-
nance or liz just part of it Z
it was also pointed out that if not passed tonight, per Sec. 30, last
year's millage would hold in effect.
At this point Councilman (arballo aithdrew his amending motion and
Councilman Corley withdrew his second.

of Ordinance 190 be amended by ih,sertuia the word Itrevolving" in front
of "street fund" and add n, +'that all such tastes shall be deposited in

Ordinance No. 190 as amended be adopted.

Councilman Preb'le stated 'ghat it really was no amendment, merely
clarification of the street fund and how it is to be' handled.
