MINUTES OF THE SPECIAL LMTING OF TIC
CITY COUNCIL OF SOUTH AIAMI HELD THURSDAY
EVENING, NOVEMBER 4, A.D. 1948 AT THE CITY
HALL AT 8 :00 P.U.
The .,meeting was called to order by Pres. Broutnt with Mayor Barrow
Atty. Ward and Councilmen Bryant? Bennett, Shafer, Maples and Brown
responding to roll call.
Pres. Brown read the notice for the meeting which had been called for
the purpose of conducting any business that might have come before the
regular meeting scheduled for Tuesdayq November 22 1948 and not held
because of the General Election on that day.
Minutes of the regular meeting of October 19 and of the special meeting
of Gctober 21 were respectively read and approved as read. '
P. E. Jacobs presented an oral complaint that the calls for the Phil
brick ambulance which is being parked across the street From the
police station, are coming in over the City Hall phone in the police
station.
H. E. Keating of Consumers YJater Company questioned the manner of post-
ing the recently passed water franchise and although the papers 'bad
already been given the story, it was agreed to give another notice
stating that the Ordinance is posted at the City Hall. Mr. Keating
reported that he had submitted initial drawings to the County to cut
Hardee Rd.
There was also a discussion on the wording "or during construction" in
proposed ordinance r #179. Atty. Ward stated that he believes it is O.K.
and Mr. Keating assured the Mayor and Council that the company is will-
ing to let the Council determine to what extent this should apply.) that
they can usually lay water mains much quicker than houses can be built,
and, that they would not want to hold up anyone on building.

Councilman Bryant, seconded by Councilman Bennetty then moved that Ordi-
nance #179 be adopted as read. Motion carried by poll, as follows:

and approved by Mayor Barrow.
A request for bids to be opened at this meeting was published in the
Miami-Daily News on October 23 for the _following one pressure dis-
tributor, one Huber lift- loader attachment with sod fork9 one Huber
attachment with broomq and one Buckeye spreader box nine feet in length.
Only bids received 1.-Jere _ from, the Florida Equipment Company of Miami,
Inc.2 as follows:

Bill Coleman of the Fla. 'Equipment Co. was present to explain the fi-
nancing plan used by various municipalities) under the terms of which
the first payment for the group would be approximately $233 -00 and
the balance $240.00 per month for 18 months.
At this _point Councilman Pressley joined the meeting.
Mr. Coleman also stated than the City might be able to borrow funds
from the bank:at,a lower interest rate and avail itself of 71 to 10
discounts for cash.
It was generally conceded that this is much needed equipment and that
the bon all c
purchased for post -war projects could rightly be used for
this purchase'.
Councilman Bennett, seconded by Councilman Pressleyt accordingly, moved
that the City place the order for delivery as soon as possible, using
the Post -War and Contingency money and bonds for this purchase in order
to take advantage of the proposed discounts. Motion carried by poll
as follows:

A petition from residents of S. W 62nd Ave. from Bird Rd. south to S.W.
44th St asking the City to help them yet trees planted in the parkways
in front of their houses was referred to the County. Parks Dept. with the
Council's recommendation for action. 1votiol .csrrC d.
Reports of standing eommitteea were as follows
Finance-' Mayor Barrow raised the question of revenue from the bus line

in accordance with the terms of the franchise, stating that with the two
new buses there would be still more `wear on the streets. In connection
with this matterI Councilman Bryant stated that the Coach Line is trying'
-:. to work this out but also want to see about a renewal of the franchise
at the same time. He agreed to have .'a report ;for the next meeting.
Sanitation: Chairman Bennett asked that his department be taken up later.

Buildings. Chairman Shafer raised the question as 'to what constitutes
a quorum for the Advisory Zoning and Planning Board, that only three
members were present at the hearing on Dr. Fortner''s application for
change of zoning to ,permit the erection of his office building. Atty."
Ward pointed out the Board acts in an advisory capacity only and the
Council has the final vote. It was also pointed out that the Board did_,
not take action until it had a quorum. Chairman Shafer also reported
that he had talked both with Sam Larkins: and with Howard Smith, and that
Sam Larkins said he was involved in <a law suit,. The legal description
of the Larkins ;property was to be given to Atty. 'f7ard so that his office
could check that statement.
Councilman Shafer also presented the request of Michael FaAcell for the
Council's re- action to the possibility of reaoning his South Red Road
frontage for duplexes. It was suggested he turn it over to the Zoning'
Board.
Fred Acker appeared before-the Council with a request for approval of his
plat, now that the City has complete! jurisdiction with the Court order
re- instating the ten acres excluded in 1938 by Quo `Jlarranto action. He
was told to bring in his final draft and turn it over to the Zoning
Board for a final check and recommendation for acceptance.
Sanitation: Chairman Bennett reported that they had "cleaned house" at
the trash pit by having a bull dozer push everything back, down into the
water and leveled off 3 or 4 inches$ pushing the dirt back onto the rock
at a total cost of $110.00. He stated that he would like the Counc'il's
approval to plant an Australian pine hedge around on two sides to hide
the pit. Councilman Shafer suggested contacting John Sapos of the South
Miami IJursery on what to plant. It was generally agreed that this would
make the pit more presentable
Chairman Bennett also had a list of questions pertaining to the enforce-
ment of the garbage ;fee ordinance and it was agreed to give Atty. Ward
a copy of the ordinance and the questions.
Councilman Bennett also discussed the matter of the Philbrick ambulance
brought up earlier in the meeting and suggested that the drivers be de-
nied the use of the City facilities for getting their calls.
In connection with preliminary surveys being made for the new Greater
Miami directory to be published in 1949, Councilman Bennett, seconded by
Councilman Pressleyt moved that the City plgco its order for a city
directory at $45.00. Motion carried.
