MINUTES OF THE SPECIAL MEETING OF THE
CITY COUNCIL HELD THURSDAY ETIENIN9,
OCTOBER 7, A.D. 1948 AT THE CITY HALL AT
> 8100 F.M.
The meeting was called to order by Pres. Barrow with Councilmen
Bryant, Shafer, Pressley, Maples and Barrow and Atty. Ward respond -
ing to roll call

Pres. Barrow read the notice for the meeting which had been called
for the purpose of.taking up any,mattBrs that might normally have
come before the regular meetings on Tuesday, September 21 and Tues-
day, October 5, respectively, and which could not be held because
of storms.
Minutes of the regular meeting of September 7 were approved as read
Regular order of business 1was suspended to take up requests of :
visitors. Luther Shafer, as spokesman for a group of property owners
in FAIRGLADE MANOR SUBDIVISION, lodged complaints against Sam Larkins
being permitted to occupy his inconpleted house and against G.W.
Larkins carrying on a business in a residential area, and stated that
he personally had lost the sale of one of his houses because of this
neighborhood. He also registered a complaint against the chickens be-
ing- kept by the tenant of G.W. Larkins in the latter's other house,
J. Jackson, another property owner there, stated that he had care -
fu ly ch'ecked' before buying his property, had, been given to understand
that the R -1 zoning, with a minimum requirement of 1,000 sq. ft. would
be upheld and had spent; approximately $2,000.00 more than he originally
intended, in order to make his house conform with the City's zoning
restrictions, He estimated that with the two homes still to be' com-
pleted the total worth of improvements in that neighborhood would'be
approximately $100,000.00 but i,f chicken coop's, lumber yards and uncom
pl''eted house are permitted: further development will stop. H. X. Nason
stated his problem is the same as that of the others except that he is
building directly across from the Sam Larkins, > property and believes the
salve of his house will. be difficult when prospective buyers come and
see -what is across the street. He stated that Paul Compare, whose
hpuse adjoins the Sam Larkins property, also could not get a buyer. firs.
A1leyne Nason stated she would like to see action so property around
there will not deteriorate in value.'
Following discussion, Councilman Shaffer, seconded by Councilman ; Maples,
moved that the City Clerk be instructed to write a letter, to be de
livered by the Building Inspector, to Sam Larkins, advising rim that his
building must be made to comply with the Zoning and building codes with-
in thirty days and that work must be commenced at once. , Lotion carried.
Luther Shafer suggested the 0osnoil appoint a committee of three or four

Fire Chief A. 1. ilelton;, as spokesman for the Volunteer Fire Dept.
asked the Council to consider oxa.`tin; teem, permission to conduct
a carnival to help them raise funds. There was considerable
opposition to this but it was su6;o,ested that they get letters from
any of the other towns iii which the carnival people had operated.
�:.E, ideating, ofonstur�ers .later Co., sat in with the Council to
discuss the City is water problem. He reported that his company
had purchased the Babcock - Lamont water plant in U-NIVERSITY PARK
and was :now operating it,, and could serve approximately 50 to 75 colored
homes in addition to the present customers aild ultimately increase this to
250 more with added facilities. The possibility of this suppler :entaxy
system being .rated a nuisance in; a residential nei6hborhood was discussed
but not considered serious ina.scruch a,s it is operated Twith an electric
pump housed in a concrete block b'uildin- and definitely a temporary
measure until such time as the City will grant a fxancbilse when water is
available from Miami.
Atty. Ward, in discussing this, stated there were three possibilities,
as follows:
1. A temporary permit.'
2. A conditional franchise.
3. An option or similar type of franchise but with •protective
clauses for the benefit of, the City and the Company in ,,specifications.
This could hermit limited expansion under the present system, provided
that six months after Miami seater is available the Company mould then
: go- into 'operation under the franchise,
Mr Keating believed it possible to work out a, more flexible method,
that they could give water service in the downtown "areas and the colored
section without too much delay, and that a gradual approach would be the
best way:
y subdivision y He stated that the present ,rates in UNIVERSITY PARK will be the same as
those in UNIVERSITY 2,:ANJR (a count just to the north) and
are as follows:
Miria,um , 2.00 per month on the first 600 cu. ft. and 250 l er 100
cu. ft. over that amount. Ootverted to gallons, this is a minimum of
$2.00 for the first 4500 gallons of water and 33'1/3 ¢ per each 1000
gallons over that amount.
The service charge for connecting from the main to the home is $15.00
in Coral Gables. kr. Keating also stated that his ,om�any is asking
for an increase in water rates in Coral. Gables' and if granted would ex=
peat the same to apply to South Miami.
There was further discussion on charges and the ori6inal franchise sub-
mitted about a year a6O. ix. Keating' stated that he wanted some

It was generally agreed that the City needed water and that Atty. ;yard,
Ur. Keating, and the Attorney for Comnumers Water Co.. work out the details
of a franchise.
Councilman Shafer 'raised the question of whether it would be feasible,
until Miami will release water to South Miami, not to enforce a Franchise
as it stands, Atty. `k1'ard stated that when the City of Miami :,rater Board
has sufficiently opened and maintained the transmission system to South
Miami then Consumers Water Co. would have six months in which to install
proper mains, and until,' such time maintain such other connections as they
could reasonably- maintain.
The possibility of meeting Monday evening, October 11, on this water
question only, was discussed.
A letter from the Department of 'later and Sewers of the City of Miami,
dated September 16, requesting approval of their plans for the Trans-
mission Main to be built within the City of South Miami, was read.
Following discussion, Councilman maples, seconded by Councilman Pressley,
moved that the plans and profiles be approv;d subject to Atty. Ward's
recommendation with the provision that the Miami. Water Board will not
sell water for wholesale or retail distribution in South Miami to other'
than the franchise holder in South Miami or by special permission of the
City Council. Motion carried by poll,, as follows:

A letter from Hor'sely Insurance Agency was read, calling attention to
the present replacement cost of the City Ball and the fact that it is
now extremely under insured, suggesting a minimum' fire coverage of
$4,000.00 and 44,000.00 windstorm. Councilman Bryant, seconded by
Councilman. Shafer, moved that the City increase its insurance on the
City Hall, as per the recommendation of the 'Horsley Insurance Agency. .
Motion carried.
Councilman Bryant, seconded by Councilman Pressley, moved that Mary*
Frances Maples be transferred to the Sanitary Department payroll, as of
September 1, at $150.00 per month and that Ruby BarRell be put on full
time in the Clerk'1s Office as of September 15 at $150.00 per month.

Councilman Maples,, seconded by Councilman'Pressley, moved that the City
take a full page ad in the South Miami, Riding Club's Horse Show program,
at 475.00. Uotion carried.
There were four recommendations from the advisory zoning and Planning
Board, but it was decided to hold over action ant l the next regular
meeting.
There was further discussion on the regiert for i ermission to conduct a
carnival but no action taken.

come under the vending machine operator's license was raised and the
Clerk instructed to enforce it
Following discussion and on advice of Atty.
Ward, Councilman Maples,
seconded by Councilman Pressley, moved that
action on Acting Mayor
Clark's resignation be withheld, and t'a,t Pres. Barrow make a recom-
mendation to the Council for its approval,
of one or more residents
to fill the unexpired term on the Council at
the adjourned meeting'
on Monday, October 11. Motion carried.
