1947-05-20 MINUTES OF CITY COUNCIL MTGkINUTES 0E THE REGULAR b4EETING OF THE CITY 'COUNC,IL HELD TUESDAY EVENING, b'!AY- 20, A.D. 1947 AT THE CITY HALL AT 8:00 P.M. The meeting was called to order by Pres. Clark with Mayor Thompson and all members of the Council present Minutes of the regular meeting of May 6 were approved as read. Regular order of business was suspended to take up the requests of I visitors. E. L. Sauls„ Jr. stated he would like to make application fora cocktail f lounge at his new building at 209 S. State Highway, Councilman Maples seconded by Councilman Atwood) moved that the request be tabled until the Council can get advice from the 'City Attorney on the matter. motion carried. The following report and recommendations of the Zoning Board was then read: Baas 17, 11,147 Hon. Wayor and City Council' South Miamil Florida Gentlemen: In accordance with the provisions of 'Section XVIII of Ordinance' No. 98, known as the Zoning Ordinance,, the Advisory Zoning Board con- ducted hearings for certain changes in zoning and recommends the fol- lowing: 1. That the application for a change of zoning from residential to commercial 'C -1 for lots 15 to 26 inclusiveg Block 8 TOWSITE OF LARKINS be approved. 2. That the application for a change of zoning from residential to com- mercial C -1 for lots 1, 2,9 31 26 to 31 inclusives AMERICAN TONNSITES BE APPROVED. 3- In view of the opposition to the a placation for re- zoning of the part of SE4 of SWq of livlJ q Sec- 36 - 54 - 40 east of the FEC R/WI from its present C -2 to a proposed C -,3 to permit a lumberyard, the Advisory Zoning Board recommends that the applicant for the change submit detailed plans and specifications for the improvements to be made by him in "con nection with the proposed lumber yards said plans to be presented at a future hearing before the Advisory Zoning Board. 4. That the zoning of Blocks 3 to 6,1 9 to 129 and 15 to 23, CAIMRIDGE LAWNS be changed from residential to special use for playground and park purposes and riding Club activities restricting buildings for Riding Club activities to Lots 17 to 28 inclusive, Block 11 and all of Blocks 21 and 229 with the further recommendation that stables be erected not closer than 300 Pt. to North 8th Street and not closer than 100 'ft. to. any private property line, and that strict sanitary supervision be main tained and that the stables be screened, The Advisory Zoning Board feels that the proposed development of this here- tofore neglected,area will provide needed recreational facilities for the citizens of this community and that every effort should be made to secure assistance from the County authorities to assure and hasten the early development of that ;portion of CAMBRIDGE. Ctotton, Chairman Advisory Zoning Board Councilman Shaferg seconded by Councilman Pressley, moved that the Council . approve the first 2 recommendations for change in zoning, as made. Motion carried by poll, as follows; Bryant yes Shafer yes Atwood yes Barrow yes Pressley yes Maples yes Clark yes Councilman Shafer, seconded by Councilman Pressleyt moved that the Council approve the 3rd recommendation requiring detailed plans, before any action is taken, and that all activity as a lumbef yard at that location be held up. Motion carried by poll, as follows: Bryant yes: Shafer yes Atwood yes Barrow yes Pressley yes Maples yes Clark yes In connection with the zoning Board's 4th recommendation = regarding the Riding Club's request for re- zoning Mayor Thompson spoke at length in favor of the change and Pres. Wittkow of the Riding Club stated that it was his belief that the Biding Club should be an asset to the 'community and should be a community affair. James C. Parrish. who admitted to being a comparative newcomer but had chosen his acreage location because it was in South Miami questioned whether E. L. Cotton, as a, member of the Riding 2lub should not have disqualified himself as Zoning Board chairman in this hearing and stated that in his opinion it was a ijuestion of whether the Riding Club would enhance the City from all standpoints, C. G Stioutl representing a group of CAMBRIDGE LAWNS residentst stated that ;a majority of the residents there were against the Hiding Club development and believed that their community would be spoiled by the horses. krs. W. A. Pressley, Sr. stated that there were still too many horses even under present conditions. Councilman Yaples arose to state that he believes the majority of the people who are going to be affeetbd by the proposed Riding Club are against it and he will therefore feel obligated to vote against it Pres. Clark agreed with Councilman Maplesq and Councilman Bryant stated that he had contacted people in CAbTInIDGE LAINS personally and found that the majority do not vtant it, that he therefore must also vote against it and. let the zoning remain as it now is. Carl Gluck stated that the residents of CAMIDC8 LAWNS would welcome any form of park. Councilman Barrow st$ted that he is still for the Riding Club as an asset to the Community but inasmuch as the people who are against it are the ones primarily 4ffected1 he believes the Council will have to adhere to their pleas. Councilman Atwood, seconded by Councilman Pressley, made the motion that the recommendation of the Advisory Zoning Board on this question be rejected and the zoning remain as it is and that in future no Riding Club be es tablished within the City limits. Motion carriedp by, poll as follows., Bryant yes Shafer yes Atwood yes Barrow not voting Pressley yes Maples yes Clark ye In accordance with legal notice in the Miami Daily News on May 5, calling for bids, the following sealed; bids were received and opened at this time: Asphalt Paving Co. •791 per`sq• yard Sea -Land Service Co. .98 per sq. yard Richardson Asphalt Paving Co. of Fla. 1.39 per sq. yard' Councilman Maplesq seconded by Councilman Shafer) moved that Chairman Atwood be given a chance to check them over before making the award. Motion carried. Reports of standing committees were as follows: With Mrs. Elva Carballo off on vacations Chairman Bryant2 seconded by Councilman Shafer moved that Ruth P Shugars be employed for full time for that periodt at the rate of $5.00 per day. Motion carried by poll; as follows; Bryant yes Shafer yes Atwood yes Barrow yes Pressley yes Maples yes Clark yes. Sanitation;. Chairman Barrow reported that he had authorized pay- as usual for . W. Thompson who was absent for several days because of a death in his family. Ae also authorized that ice for their water keg be set off at the City Hail each morning when the cooler is serviced. In connection with the clean -up campaign, it was agreed that if neces saryg both trucks be put into service on Sunday to pick up trash that Is to beyput out by the householders,, and that prisoners be credited with double time if they will work on Sundays. At this Wint Councilman Barrow asked to be excused. Police: Chairman Pressley brought up the question of a key for the Clerk's office being left with the fire department so that the office could entered 'lif necessary'., but such a need was questioned and the possi- bility of caging off the office discussed: E. L. Cotton returned to the meeting at this time to state that he had believed all controversial zoning matters were taken care of for the time being and he would like to turn in his resigmation as Chairman of the Advisory Zoning Board effective as of any date tho Council would like to make it. In response to inquiry, he recommended W. ri. Horton, present Board members for the chairmanship. Following a discussion in which L',r. Cotton expressed his beliof that he would not be leaving any unsettled problems at this times and an expression of commendation by Councilman Shafer for Mr. Cotton's services Councilman Maplest seconded by Council- man Pressley, moved that Mr. Cotton's resignation be accepted with re- grets, as of this day„ that he be thanked for the good work he has done on the zoning Board, and that it is hoped the City can get as good members in the future. Motion carried. The name of V. 1,11., Brown was mentioned as a possible Zoning Board members but no action was taken at this time. Mr. Cotton assured the Council that he will always be glad to give any help, if necessary. + A letter was read from the Miami Claip\Dept. of the American Fire and Casualty Co. enclosing check to Harley's Service Station for damages incurred by a bullet fired from the gun of special officer W. A. Pressley ir.q; suggesting that the City Attorney contact the 'writer in connection_ with claims of this type. In connection with a recent claim under 1�1orkmen's Compensation for medical attention to a volunteer fireman2 the Horsley Agency is addressing a letter to the IdC Commission for clarification. In the meantime) the Clerk was instructed to write a letter of thanks to.Dr.- Donald R. Fort- ner for treating dames Hales the volunteer fireman7_without charge to the City, when the WC insurance turned doyen the claim. The question of liability for injury sustained in a fall on a sidewalk was raised in connection with the report to the Clerk's office of a fall by Miss Frances Bailey, c -o Chas. W. Parr,, 46o S.W. 23rd Rd., on the walk in front of or adjacent to the ,Denning Seed store on S. State Highway, because that R/W had never been given. The matter was to be referred to Atty. ward. Streets & Parks: Chairman Atwood reported that he had put W. S. Bennett to work on the Community House addition at $20. per week. with the under- standing that he might be hired to replace We 0. Tannery Jr. when he leaves at the end of the month If he can fill the job. The question of a shoulder injury sustained by Bennett before he started to work for the City was to be checked. Councilman Shafer seconded by Councilman Maples moved that the City pay W. E. Bennett :25.60 per week out of Debt Service Fund until such time as Chairman Atwood makes another recommendation. Notion carried by poll, as follows:` Bryant yes Shafer yes Atwood yes Pressley yes Maples yes Clark ye Chairman Atwood also brought up the matter of the 25¢ increase per car inspection to be used for street work, per Council minutes of September 39 1946 and it was agreed to transfer those funds to the proper account. He also reported on the progress being made at the Community Building with the addition and with the clearing of the back part of the park there for a ball diamond for the juniors. Following; a discussion on street rollers and the suggestion that a check be made with the County Councilman Maples., seconded by Councilman Atwoodo moved that the City ask for bids on a roller. Motion carried. A used one for $850 had been located but Atty. Ward ruled that bids will still have to be called for& In the event that he will undertake the work Councilman Atwood seconded by Councilman Maplesq moved that Dr. H. L Hughes be made supervisor of the boys at the playground for the throe vacation months, at $95.00 per month. Rogers had blasted out the well at North 30th St. and Alta Werra Blvd., but that 4 in. drilled wells were still wanted. He also discussed the possibility of hooking onto the water line that may be run to serve the Macke Co. houses;. Buildings.: O.K. Insofar as the colored question was concerned$ as discussed at the last meeting, it was generally agreed that there was a need for expansion but the problem was to find; available ground. Councilman Bryant seconded by Councilman Shafer$ moved that the bills be paid as read.
