CITY COUNCIL OF SOUTH MIAMI HELD TUES-
DAY EVENING, NOVEMBER 5, A. D. 194`6 AT
THE CITY HALL AT 8`z0O P.M.
The meeting was called to order by Pres. Barrow, with Mayor Vanderboegh;,
(` 'Atty. Ward and Councilmen Gladden, Shaferg Sapos, Maplesq Brown and
Barrow responding to roll call.
Minutes of the regular meeting of October 15 and of the special meeting
of October 30 were respectively approved as read.
M. J. Johnson appeared before the Council to submit a written applica-
tion for 10 certificates of public convenience
and necessity for the operation of 5'zone -rate taxi -cabs and 5 U drive
it rental carsq together with a,schedule of fares stating that he was
prepared to start operation within 30 days afterhe certificates were
granted. Following a discussion, Councilman Maples, seconded by
Councilman Brown, moved that the Council accept M. J. Johnson's pro
posed terms and that they be embodied in an ordinance to be drafted
by Atty. Ward. motion carried;.
Mr. Johnson also stated that he would like a certificate of convenience
or a franchise for bus service for negroes exclusively, but this mat-
ter was taken 'under advisement.
C. A. Brinson, 'Supt. of South Miami Coach Line, Inc., appeared before
the Council in connection with a proposed amendment to the present
franchise for the extension of their service into the immediately
surrounding territory. Following discussion and explanation by Atty.
Wards Councilman Brown, seconded by Councilman Gladden, moved that
Ordinance #158 be placed on first reading in its entiret y. kotion
carried.

Thereupon Councilman Gladden, seconded by Councilman Shafer, moved
carried.

Motion
As an emergency measure, Councilman 'Brown, seconded by Councilman
Sapos, moved that Ordinance 11158 be placed on third and final reading
in its enti_ety. Motion carried.
Councilman Maples, seconded by Councilman Gladden, then moved that ,
Ordinance #158 be adopted as read. Notion carried by poll, as follows;
Gladden yes Shafer yes Sapos yes Maples yes Brown yes Barrow yes
Mayor Vanderboegh also expressed his approval.
Applications for building permits were submitted and acted Upon, as
follows*.

I. Joetik Realty Co. For alterations (interior) to commercial building
not exceeding $1,000. Councilman $ipwnt seconded by Councilman Maples
moved that the application be;apprbOed. Notion carried.
2. Application of Robert Nykiel, for 12 frame residences in the. McKeever
Terrace subdivision, on plans previously approved;g and FHA authorization
granted. In this connection a letter of protest from August Klecak re
garding this type of construction in that area was read, and tabled.
Councilman Brown, seconded by Councilman Gladden, moved that the Nykiel
application be approved. Notion carried.
3. Carl Brorup. Councilman Maples, seconded,by Councilman Brownl,moved
that this application be approved, subject to proper blueprints and
FHA authorization. Notion carried.
Pres. Barrow was excused at this point (10 P.M.), and Vice -Pros. Brown
took over.:
4. Gilbert Adair'. This application for a permit for a guest house was
turned down for better Plans.
Atty. Ward made a report at this time on the decision rendered by the ,
Circuit Court in the Quo Warranto suit involving 60 acres of land north
of !Miller Road, stating that he would like to take it on to the Supreme
Court. He pointed out that the problem resolves itself into the fact
that as long as people can get municipal services from the County at
no cost, they will sue out, that the cities are actually paying for
than service and suggested that a letter be written to other municipal-
ities bringing forth this matters that the County is usurping municipal'
services. Councilman Gladdens seconded by Councilman Browns moved that
Atty. Ward be authorized to carry this case to the Supreme Court,
Motion carried. -
In connection with the watermelon shack still.standing next to the
Standard Oil Service Stations Councilman Maples* seconded by Council-
man Sapos,t moved that the Dorns be served with condemnation notice'
to tear it do on the ground that it is a violation of the zoning
and building ordinances. Notion carried'.
Additional building applications were cornsideredg as follows:
Arthur Moorerz Application for a frame garage costing not more than
$400. Councilman Shaferg seconded by Councilman Maplesg moved that
the application be approved providing he brings in elevations and
plans and gets the O.K. from the building Inspector. Motion carried.
Norman Slack. One -room addition to dwelling. Must get better plans.
Carl Shugars: Complete plans and FHA authorization presented for a
residence. Councilman Shafer, seconded by Councilman Sapos, moved
than the application be approved. Motion carried.
In connection with the request of Manuel Holmes For permit to add tc�
his atorey Councilman Shaferg seconded by Councilman Saposq moved that
he be permitted to add 7 feet at the side provided he removed the
blocked -.in front porch on the present building. ?lotion carried.
Chairman Shafer brought up the matter of ."r. N. Strickland enclosing his

building in spite of the fact that the permit was for a porch only, but
action was deferred until the matter could be discussed with Atty.
Ward, who had been excused earlier in the evening.
H. G. Cummings came :before the Council to report that they -,as South
Miami Taxi - had started service the preceding Friday on an 8;30 A. M.
to 1;30 A. M. schedule with one cab and were planning to put on more
cabs as needed, and asked; that they be granted the same rights and
privileges as anyone else. He stated that they had been promised a
phone by December 26, that they were not inLerested in the race track
business but in working up a good local business. He was assured that
they would be given equal consideration with anyone else.

Fire: Chairman Maples reported on a letter recently sent to Fire
Chief Melton ,by State Insurance Commissioner Larson with reference to a
2 -day session of a Fire Marshals school at Tampa on November 18 and 19
and stated he would like to see both Melton and McKinney go Follow-
ing a discussion Councilman Maples2 seconded by Councilman Gladden
moved that the Cty send the two men. Motion carried.
Police: Councilma�}plkes seconded by Councilman Shafer moved that
the City purchase" ec R14 set for the police radio thru the Miami
Police Department at a price of approximately $00.00. Motion. carried.

Streets & Parks. Chairman Sapos reported satisfactory progress with
the road repairs in the colored section.
The revised application of Fred Acker to keep 3 horses on his acreage
south of the canal was presentedq and Councilman Gladdens seconded by
Councilman Shafery moved that he be permitted to keep the ,3 horses at
that location. Motion carried.
Councilman Maplesp seconded by Councilman Sapos, moved that the City
order a new Greater Miami City Directory at $30,.00. Motion carried;.
