MINUTES OF TH3 REGULAR MEETING OF THE

HALL AT 8:00 P.M.
The meeting was called to order by Ores. Barrow, with Mayor
and anderbleshl Atty. 1,17arto rol call. Councilmen Gladden, Sapos, `Faust
Minutes of the regular meeting of IVlarch 5, were approved as read.
Regular business was suspended to consider the requests of visitors.
Eugene Herndon presented a request for a franchise for taxicabs but
Atty. Ward stated that under the present charter the City cannot give
an exclusive franchisee and recommended that applications be filed
for the Council's consideration and action, also that the City tryy
to work out a reciprocal agreement with Miami and Coral Gables. The
entire matter was tabled for two weeks in order that tatty. Ward might
look into the situation and draft an ordinance to cover the City's
needs along this line
The possibility of amending the present 'liquor zoning ordinance was again
discussed from various angles. H. C. Brown, operator of Washbish
Liquors expressed the opinion that while he was not opposed to com-
petition, he did not feel that from an economic standpoint the terri-
tory would support more package stores that reasonable competition
is good but undue competition would not make it interesting for any-
one. Clement Theed, as attorney for George Hardier one of the new
applicants, stated that they were joust waiting to see what is being
planned on package store zoning.
At this point Councilman 'Brown joined a2cifieeting. Atty. ,lard reminded
all present that the present ordinalce,would; have to be amended,
has been upheld twice, in Court.
George Wiegand, another applicant, was also present but had no comment.
Atty. Ward reported on the theater project by ;giving the report of the
consulting engineers, Jorgenson and Schreffler, stating that the
tests to be made at the end of 60 days should be undertaken around,
the first of April. He suggested that a copy of the Jorgenson letter be
sent to the theater people with a statement that the tests must be
made before license to operate is granted. " ouncilman Saposq seconded
by Councilman Browng moved that the theater people be notified that
no permits will be granted until the tests mentioned by the engineers
in their letter, have been made and satisfactorily passed, and that
carbon copy be sent to Atty. Ward. Motion carried.
On motion of Councilman Browne seconded by Councilman Sapos,.Atty. Niard
was instructed to draft an ordinance regulating the conditions, etc.,
for operation of a motion picture theater, including adherence to State
laws on exits, health and sanitation, and providing for the 'same-
hours of operation as the Coral Gables theaters. Motion carried.
A this point Pres. Barrow At p asked to be excused and Vice- Pros Brown
took over.
The request of Ted Crockett for a change in zoning at the M11 corner of
Red Road and N. 4th St. vas turned over to the advisory Zoning Board for
action.
Upon receipt of a report from the Building Inspectors Councilman Maples
seconded by Councilman Sapost moved that condemnation proceedings be
gone ahead with on the building; on Lot 12, Block 5 TCYINSITS OF LARKDNS,,
Motion carried.

Fire. U.K. Chairman Maples stated that it had been necessary to go
down 6.9 ft. for the well at the ilight--iay and N. Red Ct.

Councilman Faust7 seconded by Councilman;Maplesq moved that the liquor
zoning ordinance be amended to permit the issuance of package store
license upon Council approval in any location zoned for a C (commercial)-
use and more than 300 ft. from a churchq, school or playgrounds measured
as a pedestrian would walk along a highway or dedicated sidewalk. Motion
carried.
In connection with the proposed taxicab ordinance the question of rates
and insurance was also raised and left to be worked out by Atty. Ward

Councilman Gladden, seconded by Councilman Maplesy moved the bills be
paid as read. Motion carried by poll, as follows:
