1946-03-05 MINUTES CITY COUNCIL MTGMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF SOUTH MIAMI HELD TUES- DAY EVENINGS MARCH 52 A.D. 1946 AT TIE; CITY HALL AT 8900 P.M. The meeting was called to order by Pres. Barrow with Mayor Vander boegn and Councilmen Gladden, SaPos7 Faust, Maplesy Brown and Barrow responding to roll call. Minutes of the regular meeting of February 19 were approved as read. Regular order of business was suspended to listen to the requests of" visitors. Mrs. Betty Fox Of the Dixie Pig Restaurant stated that if a change in zoning for package stores is contemplated she would like considera- tion for her location. It was suggested that she file an applica- tion. Capt. J. I. Nienaber made 'a personal request to supplement his written request for ;permission to deepen an existing rock pit at the north end of his property to form a lake to be stocked with fish and the entire tract - beautified. Following discussion and further questioning$ Councilman Brown, 'seconded by Councilman Maplesq moved that Ca t. Motion George Wiegand stated that he had filed an application for license for a package store, together with copy of deed to the property and money orders to cover the license fee. Clement L. Theedt attorney for Geo. Hardieg stated that they had filed an application and petition for re- zoning and copy of an agreement with John T. Parker for a locations and check to cover the license fee. A general discussion followed in which it was agreed that Atty. Ward is to pass on the legality of the change and whether the present zoning ordinance shall be amended to permit package stores on any property now zoned for C (Commercial) uses providing they are not less than 300 feet from a church or school or playground. In response to a request from V!. As Pressleyt Sr.s who stated that he was making displays in his garage because he had not been able to find another locations Councilman Browns seconded by Councilman Gladdens ; moved that he be given a reasonable 1ehjth of time to find another location. Motion carried. A card of thanks was received from Mrs. Marian Lee for the flowers for the funeral of her husband, Mr. L. L. Lees of the South Miami Coach Lines, Inc. RESOLUTION NO. 246 A RESOLUTION BY TIP. MAYOR AND CITY COUNCIL OF TIE CITY OF SOUTH MIAMI CONFIRMING THE CLOSING OF A CERTAIN STREET IN SOUTH t,1IAMI AS SHOWN BY' T12 RECORDED PLAT, on October 2. 1934 the City Council moved to accept the prWHEREAS, ion p of Wm. A.H. Hobbs that the City open up the street across the south end of HOBBS SUBD. and connect East and West Streets theretop Mr. Hobbs to donate and dedicate all of the said R/V1 'with- out cost to the City'. and WHEREAS, on July 31i 19351 the said VIm. A. H. Hobbs did give the 'l necessary deed to -the S. 25 ft. of Tracts 2 and of Lots 26, 279 28 and HOBBS 29 SUBD." as recorded in DB 1795 page 1781, thus eliminating the need for Luth. Street as per plat of W. A. H HOBBS SUED. as recorded in Plat Book 4, page 1119 Public Records of Dade County and WHGREAS9 the said South Street has never been used as a public R/41 and the present owners of the immediately adjoining property, 111. A. H. Hobbs and Henrietta Hobbs, his wife2 and William Rust and Hazel Rustt his wife) have jointly requested the City Council of South Miami under date of February 21, A. D. 1946 to revoke said South Street as a right -of -way and return said South Street to the assessment rolls NOWx THEREFORE9 BE IT RESOLVED BY TH13 MAYOR AND CITY COUNCIL OF THE CITY OF SOUTH MIAMI`: That the said action of the said City Council be and the same is hereby adopted as and for the action of the 'Mayor and present City Council of the City of South Miami, and that the said dedica- tion of the street within the area above specifically described be and the same is hereby revoked. PASSED AND ADOPTED this 5th day of March, A.D. 1946. Thereupon Councilman Maples, seconded by Councilman Saposq moved that Resolution No. 246 be ado tea as read. Motion carried. In order to correct a technical error in the original R/W deed given by V1. A. H. Hobbs for the S. 25 ft. of his subdivision Councilman Gladdeng seconded by Councilman Faust2 moved that the Mayor and City Clerk be authorized to execute a quit claim deed to W. A. H. Hobbs for ,Lots 26, 27 IV. A. H. HOBS SUBD. subject to that R/W dedication. Fires Chairman Maples reported that they truck had been sent to a bad_County fire down hear Howard and that the motor had had to be replaced. It Was also agreed that the Voluntoer Fire Department be permitted to use the main,fire truck occasionally for drills but that the City fireman is to run it. Councilman 'Maples also reported that John R. Roby had offered to donate free -of- charge a one -way radio for the fire truck. Following a discussion re- garding the placing of the fire welly Councilman Maples seconded, by Councilman Brownq moved that the well be put on the NC'l' corner of Lot 3 Blk 1 CARVERS SUBD.. and that the Leveritt Co. whose bid was 4.00 per ft., be authorized to put the well down. Motion carried Police: Chairman Brownq seconded by Councilman Sapos, moved-that The- City execute a new contract with the City of Miami for Police I _. Radio service, subject to Atty. Wars O.K. J Jorgensen (struct- ural consulting engineer) had been called in to the theater pro - ject and will put a 501000 lb. weight test on the building be- cause the concrete test has been very low.
