COUNCIL OF SOUTH MIAMI HOLD TUESDAY EVENINGy
FEBRUARY 199 A.D. 1946 AT THE CITY'HALL AT
8:00 P.M.
The meeting was called to order by Pres. Barrow with Mayor Vander -`
boegh and Councilmen Gladden2 Sapo,sq Faust,, Maples9 Brown and
Barrow responding to roll call.
Minutes of the regular meeting of February 5 were approved as read.
A delegation of 9 residents of CAMBRIDGE LA;YNSp headed by H. H.
Finley, came before the Council to protest the continued keeping
of horses in that area* stating that some had gotten out again
with almost disastrous resultsl and that if relief could not be
had thru the 'City they would be obliged to take the matter into
their own hands. They left the meeting with the assurance that.
definite Action would be taken immediately.
Applications on file for permits to keep horses; were then taken up
and considered on the basis outlined at the special meeting of
January 16, with action thereon as follows:
Councilman Browns seconded by Councilman Faustt moved that permit
be denied to William Glore on the grounds that he does not come
within the limits specified. Motion carried.

Councilman Maplesv seconded by Councilman'Saposs moved that permit
be denied to Fred Acker on the grounds that he does not come within
the limits specified. Motion carried.
Councilman Gladden, seconded by 'Councilman Brown, moved that the
application of Mrs. S. M. Greene be approved insofar as her
stables are concerned) but that it be questioned as to the loca-
tion of her riding ring. , Motion carried.

Councilman Gladdenp seconded by Councilman Brown! moved that the
application of C. Wittkow be approved insofar as the stable is
concernedv but that it be questioned as to the location of the
riding ring. ?lotion carried.

Councilman Browne seconded by Councilman Sapos, moved that all
applicants'recei�Ang permits be advised that same are subject to
revocations should complaints arise. Lotion carried.
On the recommendation of the Advisory Zoning Board for an amendment to
permit the restricted parking of trailers for a period of one year,
to meet the housing situation, Ordinance #150 had been prepared
and Councilman Browns seconded by Councilman Maplest moved that said
Ordinance #1509 caption of which followsl be placed on first reading
in its entirety. Motion carried.
ORDINANCE NO. 150
AN ORDINANCE AMENDING SECTION XIII OF ORDINANCE
NO. 98, COMMONLY CALD THE ZONING ORDINANCE OF
THE CITY OF SOUTH MIAMI9 AS AN EMERGENCY MEASURE
AND PERMITTING THE PARKING OF TRAILERS FOR OCCU-
PANCY AS LIVING QUARTERS IN CERTAIN SECTIONS OF
THE CITY OF SOUTH MIAMI UNDER CERTAIN RESTRICTIONS
DEFINING THE LIMITATIONS THEREOF AND DEFINING THE
PERIOD OF ONE YEAR FROM TIE DATE OF THIS ORDINANCE
AS TIE PERIOD OF SUCH EMERGENCY AND PROVIDING
PENALTIES FOR VIOLATIONS OF THE TERMS HEREOF,
Thereupon Councilman Faustq seconded by Councilman Saposj moved that
Ordinance #150 be placed on second reading by caption only. Motion
carried.
Councilman Gladdens seconded by Councilman Browns then moved. that
Ordinance #150 be placed on third and final reading in its entirety.
Motion.carried.

Following the third and final reading in its entirety,, Councilman
Maplesy seconded by Councilman Sapos, moved that Ordinance #150 be
adopted as read.. Motion carried by pollq as follows:

j The question of enforcement, of state laws and regulations within the
City of South Miami was again discussed2 and Ordinance #151
caption of which follows] placed on first reading in its entirety
on motion of Councilman Faustt seconded by Councilman Maples and
carried.
ORDINANCE NO. 151
AN ORDINANCE MING IT UNLAWFUL TO COMMIT ANY ACT
WITHIN THE CITY OF SOUTH MIAMI 'WHICH SHALL BE RECOG-
NIZED BY THE STATE OF FLORIDA AS A MISDEMEANOR AND
FIXING AND PROVIDING THE PENALTIES FOR VIOLATION
THEREOF AND DECLARING THIS ORDINANCE TO BE AN EMERGENCY
MEASURE AND DISPENSING WITH THE REQUIREMENTS OF READING
THE SANE ON TWO SEPARATE DAYS BY A FIVE- SEVENTHS VOTE
OF TIM MEMBERS OF THE CITY COUNCIL OF THE CITY OF
SOUTH MIAMI.
Councilman Gladdens seconded by Councilman Saposq then moved that
Ordinance Nu. 151 be placed on second reading by caption only.
Motion carried.
Councilman Brown, seconded by Councilman Maplesq then moved that
Ordinance No. 151 be placed on third and final reading in its
entirety. Motion carried.

At this point Pres. Barrow was excused from the meeting and Vice
Pres. Brown took over the meeting.
Reports of standing committees were as follows
Finance: O.I. Audit completed and report received.
Sanitation: Councilman Maples, seconded by Councilman Fausty moved
that statement of Patrick Ellis for $20.00 for bull -dozer work in
the pit,, be approved, and paid. Motion carried by polh as follows:

Streets & Parks: Councilman Maples stated that Jeff Gautier had
asked that the holes in S. 12th Street be filled and that S. llth
.St• be opened with a bull dozer. No action was taken at this time.
Buildings: Councilman Gladden] seconded by Councilman Maplesq moved
that the Council accept the recommendation of the Advisory Zoning
Board on the Booth application for permit to erect an all - metal
residential buildings said recommendation being that permit not be
granted. Motion carried
Councilman Maplesq seconded by Councilman Sapos� moved that the City
get an abstract on the 20 ,acres of land it owns in Sec. 26 -54 -40 and
authorize the City Attorney to go ahead with the suit to quiet title.
Fire: Price for putting down a 6 -ft. well was obtained from 3 drill-
ing companies and varied from $4.00 to $4.25 per ft It was sug-
gested that these ,uotations be gotten in writing, and that easement
he obtained from Chas. Fuchs before giving order for the work,

day shows and Sunday hours and of theaters
not less than 300 ft. from an existing church were read. Atty. Ward'
pointed out that the entire area would have to be re -zoned and the
entire matter was tabled.
Mayor Vanderboegh brought up the matter of permitting a package store
in the colored section but a study of the map showed the difficulty
that would be encountered in finding a location that would be 300 fte
distant from a church and the question was left open.
There being no further business, the meeting was adjourned in regular
order,
