MINUTES_ OF THE REGULAR VAETING OF THE CITY
COUNCIL FIELD TUESDAY EVENING JUDY 15, A.D.
1941 AT THE CITY HALL AT 8:06 P.M.
The meeting was called to order by Pres. Vanderboegh, with Mayor -lass2 all
Councilmen and Atty. Ward present.
Minutes of the regular meeting of July 1 were approved as read.
Mr. George Hiltwein appeared before the Council on behalf of the annual
fishing outing given South Miami youngsters, at a total cost of $61.63,
toward which the businessmen had conttibuted $22.506 the sale of tickets
netted $29.05, so that a balance of $10.08 remained to be met. Council-
man Brown, seconded by Councilman Bennett, moved that the City re- imburse
Mr. Hiltwein the $10408. Motion carried 'by poll, as follows:

Mr. Chas Fuchs appeared before the Council with a request that zoning in
the area adjoining S. 4th Ave. and ,S. 8th Street be stepped .up from its
present rating which permits trailer camps and parks. In accordance with
the provisions of Ord. #98., Mayor Glass recommended to the Council the
appointment of Chas. Fuchs, as chairman awl for a two -year period: and
Emile Cotton and John Myers, each for a one-year period, as an Advisory
Zoning Boards and Councilman Brown, seconded by Councilman Bennett, moved
than they be appointed as such. Motion carried, and Mr. Fuchs instructed
to get his board together and proceed in accordance with the provisions
of the Ordinance for the proposed change in zoning.
In accordance with the provisions of the Charters notice had been given
for the public hearing of the 1941 -1942 budggets and at this time Couhcil-
man Gladdens seconded by Councilman Bostwick7. moved that Ordinance #130,
caption of which follows2 be placed on its first reading in its entirety.
Motion carried, and Mayor Glass read the proposed budget.

It was decided to call a, special meeting following the final, meeting of
the equalization boards on .Vednesday evenings July 16, for the purpose of
taking final action on Grdinance #130.

Fire: O.K. Chairman Brown reported- having,been contacted at various times
by persons desiring to buy the City's i old hose, but recommended that all
such hose either be kept for emergencies or given to the County Road
department. The Council agreed to this. 'with Arthur Melton starting on
his vacation and Ericson substituting for him, Councilman Gladden, seconded
by Councilman Bostwicks, moved that Ernest Ericson be paid at the rage of
$3.00 per day for the 14 days, payable with the July 31 pay roll. Motion
carried by polls as follows:

Chairman Brown also reported that Chief Wiegand` has said that nothing would
be gained by attendance at the State Fire College, as the same instructor
had given the course in Miami which he had attended.
Councilman Bennett reported that Chief Wiegand had given the first lesson
to the Volunteer Fire .Class the ,preceding evening, following the Red Cross
First slid classy and again brought up the question of insurance. Following
a discussion in which Atty. Ward stated that it was a question of whether
the training given was for purely personal, defense purposes, or for
municipal duty which would- deterdiine the type of insurance which should be
taken out, he was instructed to take the matter up with the Horsley
k Insurance Agencyq the 'City's insurance agent.,

As a member of the special'co=jittee on water, Councilman Gladden stated
there were no new developments, and that the outcome of the Coral Gables
election that day would have to be awaited,.
Councilman Gladden, seconded by Councilman Bostwick, then moved that Reso

Section 1: That r"JILPREAS, certain lands in the City of South Miami
have reverted to the State of Florida under the provisions of Chapter No:.
-, 18296, General Picts of the Legislature, State of Florida, 1937., commonly
known as the I.Turphy Act ;; and
'V EASE said taxes for the City of South Mlia<ni are now delinquent
on said property; and wheeas the said property is not subject to assessment
while owned by the said State of Florida; and
+'iHE1ZAS, the outstanding City of South I; ami taxes are practically
uncollectible until some compromise can be made so as to induce purchasers
to take from the State; and
WHEREAS, it is to the best interest of the City of South Miami to have
said brVk and delinquent taxes compromised and the property sold by the
StatY put back -on the active tax roll,
NOW9 THEREFORE, BE IT RESOLVED that the City Clerk of the City of
South Miami be and she is hereby authorized to accept eash adjustments
and to cancel all - outstanding taxes on the following basis
(a) All taxes shall be settled on amount equal to 20% of the
assessed value of the said property on the 1940 tax roll.: The proceeds
shall be applied first to pay up in full all current taxes, or tax
certificates or delinquent taxes, if less than two years old, together
with interest and penalties. The balance shall be spread and applied
in equal amounts to the principal of all other outstanding certificates,
4 and all certificates shall be cancelled together with all outstanding unpaid
j taxes to date hereof. The parties seeking to redeem shall in addition to
paying 201 of the assessed value as aforesaid, pay all Clerk's 'costs for
cancellation or assignment of said certificates and all costs of the Clerk
of the Circuit court
in Dade County, Florida.
(B) The City Clerk shall have the authority, in the event the
application for settlement on said taxes is made before the deed has been
obtained, ;on the same consideration and on the same basis to make an
assignment of the certificates or delinquent taxes. All cancellation or
assignment costs are to be paid;, in addition to the percentage basis as
above set forth.
Section 2: That this method and manner of assessment on this type
of ,property shall be in force and effect For a;period of one year from date
hereof.

A letter from Horowitz and Horowitz, asking the Council to reconsirier its
stand on the proposed change of zoning in the County at the corner of
Iail.ler and Ludlum roads was presented and discussedi and the Clerk
~ instructed to write them, stating; that the Council cannot change its
-' decision in the ratter.
Vayor Glass stated that he would prepare a proclatiAt on for alwnlnum week
and Aldo write ;each of the two Red Cross instructors a letter of thanks

for their aplendid work with the South Miami classes.
Councilman iBennett, seconded by Councilman Gladden, moved that the
Xommunity Building be held open P?onday and Friday nights, indefinitely�
for defense projects, and that the Friday Fun Club be notified of this.
Motion carried. The following bills; were presented for approval and
