CITY HALL AZ 8 :00 P.M.
In. the absence of both President.and Vice - President, the meeting was called
to order by Mayor Glass, and Councilman Bennett appointed chairman of the
meeting, attended by Councilmen Gladden, Bostwick, Bennett and Core.
Chairman.Bennett read the notice for the meeting which had been called for
the purpose of holding a hearing on the preliminary assessment roll for
Improvement H -9 and for the purpose of conducting such business as might
have come before the regular meeting of June 179 which was not held because,
of the lack of a quorum.
There being rio one present to protest the .preliminary assessment roll Coun-
cilman Bostwickt seconded by Councilman Coreq moved that Resolution >#210
be read. *lotion carried.
RESOLUTION NO. 210
A RESOLUTION CONFIRMING THE PREL,IMINARY ASSESS-
MENT tROLLS: FOR HIGMlAY IMPROVEL NT H -9.
114GREASt the Council of the City of South IZiamis Florida met on
June 24* A. D. 1941 pursuant to legal notice of said meeting under Section
54 of the City Charter to hear all written objections to the confirmation
of the Preliminary Assessment Rolls for the cost of work in highway district
H -9, and
affected byssaio objection thereto was made by any person interested in or

assessment rolls appearing in all
respects regular and in accordance with the requirements and provisions
of the 'City Charter.

1. That the prima facie assessment as °apportioned and indicated on
said Preliminary _Assessment Rollo be and it is hereby ih all things con-
firmed and sustained against any and all lots or parcels of the ground
described therein.
2 That the sums or amounts assessed against each of the lots or
parcels of groundin said Preliminary Assessment :lolls are less than the
amount that each of said lots or parcels of ground is especially benefitted
by said improvement and that such amounts are in proportion to the special
benefits that the property received and according to frontageo and not
in access of the special benefits to the property assessed.
. That the total costs of said improvements in the sum of $160.0
for H39 be, and the same are, hereby approved and confirmed.
4. That thirty :days after the above confirmation of assessmentsi the
amount apportioned and assessed against each lot or parcel of ground shall
be due and payable at the office of the Mayor at the City Halls but that-
if the owner of any lot -or parcel shall file with the Mayor before such
date on which full payment is required, his or her written undertaking
waiving all irregularity and illegality in connection with the said
assessment against such lot or parcel, he or she shall have the prise aagge
of paying the same in equal annual installments in each of five succeeding
yearsg with interest upon'such deferred installments at the rate of six
percent per annum, payable annually from the date on which such assessment
would be due if such undertaking were not filed'.
PASSED AND ADOPTED this 24th day of June, A. D. 1941,
Thereupon Councilman Gladden, seconded by Councilman'Bostwickt moved that
Resolution #210 be adopted as read. Motion carried by poll, as follows:

Following a discussion; as to merits and benefits' to be derived from the
codification of the charter and ordinances, Councilman Gladden2 seconded
by Councilman Bostwiek9 moved that Resolution #211 be read. Motion carried.

RESOLUTION` SPONSORING THE STATE_VJIDIE CODZ
FICATION OF MUNICIPAL ORDINANCES AND CHARMS
PROJECT, 0. P. N0. 165 -1-jW-110, IN THE CITY
OF SOUTH MIAMI FLORIDA AND APPROVING THE
APPROPRIATION AY THE CRY OF SOUTH MIALFI.
4YFEREAS,. the Cit `Council of the City of South Miami has considered

the suggestion that the said City become a co- sponsor of the State -wide
Codification of b?unicipal Ordinances and Charters Project, 0. P. No. 165
1 -35 -110, and
WHEREAS, it is to the beat interest of said City to obtain 'a codification
of the present City Charter so as to make the management of said City more
efficient..
NOW9 THEREFORE, BE IT RESOLVED by the City Council of the City of
South Miami, Florida, that the said City of South Miami shall become a co
sponsor of the State -wide Codification of Municipal Ordinances and Charters
Project 0. P. No. 165 -1 -35 -1109 which project has legal authority to
prosecute the codification of the City charter of the City of South Miami,
does hereby delegate to the Florida State Planning Board, official sponsor
of the aforesaid project, the right to sponsor the operation of aaid
project in the City of South Ui.ami, Floridaq and does hereby appropriate
the sum of ONE H=1-MD AND T1WITY -FIVE DOLLARS ($125.00) from the general
;lfund of the said City of South 131ami to be immediately paid to the Florida
State Planning Board as and for the purchase of necessary suppliers, equip-
ment and /or other necessities in the operation of said project, and hereby
agrees to publish in book form a minimum of thirty -five (35) copies of the
" finished code of ordinances and charter, furnishing the Work Projects
Y. f Florida twelve (12) copies and the Florida State Planning
Board five (5) copies of same,.
BE IT FURTHER RESOLVED by the City Council of the City of South Miami,
Florida, that W. G. WARD, City Attorney, is hereby engaged to consult with
and advise.the attorneys of the aforesaid project during the process of
codification, said City Attorney to be paid the sum of FIFTY DOLLARS
($50.00) for his said services.
BE IT FURTHER RESOLVED by the City Council of the City of South Miami,
Florida, that the finished and completed code of ordinances will hereafter
be maintained, currently, by the said City of South Miami, Florida.
PASSED AND ADOPTED this 24th day of June, A. D. 1941p by affirmative
vote of 4 members of the City Council.
Councilman Gladdent seconded by Councilman Bostwick then moved that
Resolution No. 211 be adopted as read. Motion carried by poll, as follows:

A request for the adjustment of taxes on 15 lots in WESTERFIELD MANOR com-
pletely surrounded by Quo Warranto property, and which could also be easily
sued out, was presented and following a discussion, Councilman Bostwick,
seconded by Councilman bore, moved that upon payment of full face and
interest on all taxes two years or less delinquent, the City accept $1.00`
per lot per year in settlement of taxes more than two years delinquent, plus
the cancellation fee payable at the office of E. B. Leatherman, Clerk of
Circuit Court. Motion carried by poll, as follows..

Couhcilman Gladden, seconded by 'Councilman Bostwick, moved that the City
adjust taxes with Margaret Jackman on two lots in TOWNSITE OF LARKINS,
and J. H. Mercer on 3 lots in SEA VIEW PARK, as per Resolution #198.

The following bills were presented for approval and payment:

Councilman Gladdens seconded by Couhcilman Bostwick, moved that E; Ericson
be paid for 15'days at $3.00 per days with the regular pay roll, on June 30

for substituting for Melton who is serving on the police force during the
vacation of Officer Roby. Motion carried by poll, as follows:

Chairman Bennett called the Council's attention to-the fact that the new
siren had never been property mounted and connectedq a condition that
should be remedied before the summer storn seasons ,gets under way.
Councilman Bostwick, seconded by Councilman Gladden, moved that this be
taken care of without further delay. Motion carried.
There was a discussion as to installing the fluorescent lights and an
exhaust fan in the City Hall. and it was left 'up to Councilman Bostwick
to work out the details.
There being no further business, the meeting was adjourned in regular
order at approximately 9 :15 P.M.
