OF THE CITY COUNCIL OF TIM CITY
OF SOUTH MIAMI HELD TUESDAY EVEN
ING OCTOBER 11 A. D. 1940 AT THE
CITY HALL AT 8 :00 P. M.
The meeting was called to order .by Pres. Vanderboegh, with
Councilmen Gladden, Brown, Foyle, Bennett & Vanderboegh and
Atty. 'lard responding to roll call.
Minutes of the regular meeting of September 17 and of the
special meeting of September 24 were respectively read and
approved.
Mr. Byron P. Faulk appeared before the Council with a request
for'- adjustment of the City Taxes on the lots in Riviera Pines
on which he had originally made an application for deed "under
the Murphy Act, and which the City had bid in to protect its
certificates. Following a discussion, Councilman Brown
seconded by Councilman Bennett, moved that the City sell to
Byron P. Faulk Lots '20 to 23 inclusive and lots 25 and 27
RIVIERA PINES for a cash price of ;$201.39 net to the City,
he to pay for the state and federal stamps, and that Atty,
Ward be instructed to draw up the proper deed and provide for
the execution of same by the Mayor znd City Clerk.. Motion
carried by poll, as follows

A letter addressed to the Council by Rolf Jungeblutt asking for
the re- opening °of two ditches near lot 30 blo.c'k 11 SEA VIEI.T PARK
in the event of high water, was read. It was agreed that if the
need arises this should be dome, and it was also suggested that
it be called to the County's attention, as these ditches had been
closed to enable the County trucks to reach the canal bank to ;get
the ,gravel there.,

Streets & Parks: The question of enlarging the stage at the
Community Bldgt was brought up but it was decided to hold this
up until an estimate is received from the 111PA office on the
total cost of installing the equipment recently received from the
PTA.
Atty. "lard reported that Rosen was about to get the mortgages
M cleared upq so that the deal should be ready to close soon.

Mr. Fuller, of Fla. 'Power & Light Co., reported that Riviera
Landscape Co., had agreed to move the palms at C:4ABRIDGL LAVINS
for $10.00 each, that the parkway is 35 ft. wide and the palms
will be set out about 12 ft.from the outside edge of the side
walks
The application of Geo. Foy and Neil Turner for a license for
package liquor,store at.254 South First Street was presented: to
the City Council and upon consideration and discussion, and
taking into consideration that the location for which a package
store license was sought was in violation and contravention to
the provisions and prohibitions of Ordinance ;128 of the City of
South Miami, Councilman Brown,.seconded by Councilman Bennett,
moved that the application be denied and the Clerk directed to
refund money in the sum of $562.50 tendered with the application.
Motion carried by poll, as follows:
Gladden yes Brown yes. Foyle yes Bennett yes Vanderboegh yes.
Upon suggestion of atty. Ward it was decided to look into the
possibilities of obtaining a 5150 or 10150 liability policy
instead of the 10/20 originally agreed upon, for the school bus.
It.was also decided to put a, lock cap on the ;gas tank of the
school bus,.
Following the reading of the monthly financial statement for
September, the following bills were submitted for approval and
payment:
