ACTING OF TILE CITY COUP;CIL
At the dity hall September 20, 1932 at 8:00 0' Clock P. I.I.
The meeting was called to order by the president, ',.r. Lindley, those present
beside the president being Councilmen Angerman, Burtashaw, Peacock, and Hed.
The clerk then read the minutes o2 the last meeting held Sept 12th, 1932, the
minutes bein g approved as read.
Upon a motion by councilman Red and seconded by councilman Burtashaw, the
following bills were ordered paid: Harley's Service dtation, $0.80,, and Attorney
J. C._btiillivan, 6 O "42./\ poll of the votes resulted as follows;-

A report of the committee appointed at the last meeting of the council to e
investigate the possibility of reducing the number of sirreet lights in the city was
read by louncilman Red who reported that there were few if any lights that should
be abolished The committee recommended that two lights at the Riviera Service Station
be cut off and otner..lights be placed at the corner of Sunset Drive and Ingraham
highway north of the caution light,
Councilman Burtashaw made the motion which was seconded by Councilman fingerman
that the the report of the committee be accepted and the committee be discharged. the motion
Councilman tied offered a motion that . Attorney J. C. Sulli�inetsecured to
defend the suit instituted by the South iiiani Development Co. City of
South Mani, Florida seeking a writ of injunction to prevent the discounting of tax
Jertificates for the years previous to 1930. Die motion was seconded by Councilman
Angerman and upon being put to vote the motion carried unanimously. "
The following i.,otion was made by Councilman iced and seconded by councilman
N`Burtashaw:- �
It appearing to the council thdr- during the tithe the City was not functioning
that money was deposited with the Clerk of the +circuit Court to redeem City tax
certificates Nos. 185, 1429, and 1430 for the year 1929 and lies. 1646 and 1649 for
the year 1925, and that the money so paid said Clerk is held by him because of a;
difference in the emount of interest so paid and the amount claimed to be due by
the City Clerk, the City council therefore hereby authorizes and directs the City
Clerk to accept the settlement so made by the Clerk of the Circuit Court and
surrender said tax certificates.
Upon being,.put to Vote the above motion carried unanimously.
rir. Red then made 'a motion upon the suggestion of Layor Poster that the City
Clerk be authorized to issue a check to Lra. W.J.Shelley in the amount of i'ifteen
Dollars (015,OO).for services in compiling the advertising list for the 1931 tax
roll. The motion vras seconded by councilman Burtashaw and the Clerk polled the vote

A motion was made by councilman Feacoc'k, which was seconded by councilman
Angerman, that ordinance Lo. 63, which reads as follows be placed on its third. and
final reading:—

ordbmce :oo. 2 of the i:ity of Joutn ..iarni, r'lorida, relating to license taxes and
privileges, and cancelling in its entirity, Ordinance ��o ble"

yhe motion carried unanimously. �.
Mayor Foster then addressed the council suggesting the appointment, as soon as possible
of a successor to fill the vacancy caused by the resignation of councilman
fts Shelley. No action was taken upon the matter at this time.
The following resolutioi; pertaining to the collection of 1931 taxes upon,
redemmpton of tax certificates was offered by councilman Red.:-
RESOLUTION P � -�
Whereas this council is advised that when a city tax certificate.is
redeemed at the clerks office payment of the current years tax is not required as
a prerequisite to the redemption of such property, and:.,
Whereas, the failure of the Circuit court clerk to require the payment of
current taxes in connection with the redemption of property sold for city taxes
militates against the financial interests of the city by creating in the minds of
proppectve purchasers of city tax certificates misgivings and fear that they will
x not be protected in the payment of the currentyears taxes,
Now, therefore, be it resolved by the city council of the City of South Miami
that 11r. E. B. Leatherman, Clerk of the Circuit Court of Dade County, be and he is
hereby respectfully advised of the contention of this council. , and he is hereby
requested to demand hereafter, the payment of the current years bity taxes before
or at the time of the redemption of city tax certificates. A regularly issued tax
receipt for current years taxes shall be deemed satisfactory evidence of the payment
of such taxes.
After being duly seconded a vote was taken on the above resolution thb' .
result of which was unanimously in favor of its adoption.
A motion was made by councilman Peacock to place on reading by`c�" ion
only ordinance number 63 for second reading. Councilman Burtashaw seconded the_i
motion which resulted affirmatively upon being put to votes whereupon the clerk
read the ordinance by caption.
Meeting then adjourned.
