1931-08-17 MINUTES CITY COUNCIL ADJOURNED MTGMinutes of adjourned meeting of the City Council, held at City Hall, South
Miami, Fla. Aug. 17,; 1931. at 8 P. M.
Present were R. J. Lindley, president of the council, and councilmen, Red,
Shelley, Angerman, Smith, Burtashaw and Houser.
The meeting was called to order by the president, following which, councilman
Red, made motion seconded by ;councilman Angerman, that the clerk be instructed to accept
payment, for tax certificates for the years, 1926, 19279 1928, lknd 1929 at a reduction
of sixty -six and two thirds;, per cent, without demanding payment of the 1930 tax
This reduction to 'apply to owners only, and to be in effect as long as the council is ==
in existence. A poll was taken on above motion and motion carried unanimously.
The following bills were then presented,, and councilman Burtashex made motion
seconded by councilman Angerman,tbat they be paid,

'~ votes were ,polled at said election, that 163 of which said votes were cast; against
abolishing the Charter of the City of South Miami, Florida; and that 184, of which said
votes were cast in favor of abolishing the Charter of the City oQ South Miami, Florida,
And that the majority of the votes cast in favor of abolishing the•Charter of the City
of South Miami Florida, was 21, votes. Therefore it is ordered by the council that
J. L. Yarborough City Clerk, be and is hereby ordered to notify the Secretary of State
for the State of Florida, of the result of said election by furnishing him a duly certi-
fied copy of this finding and order of the council, And said Clerk is hereby authorized
and directed to collect hold and preserve, the Archives, Records,, Books, Moneys, Accounts,
Tax Certificates, Personal property or other effects of the City which are now or may
hereafter come into his possession while so acting as such custodian, until such time
as he may be lawfully telieved of such trust and until he should have received a copy oQ
a true and correct audit of his books and accounts by a competent certified accountant.
Resolution was unanimously adopted.
These minutes have been read-approved and are now signed and thin council,is declared"

MR R. W. Dorn then inquired regarding bill rendered by him, for the repair of
one of the street lampsq and after some discussion councilman Burtaehaw made motion sec-
onded by councilman Red, that this bill, of 10.00 be paid. A poll on above motion was t
taken and motion carried unanimously.
Councilman Red then presented the following resolution,;

Whereas it is common knowledge, and generally conceded,that the result of the election
held in the City of South Miami, on August 10, 1931, on the question of abolishing the
City Charter, was adverse to the Charter, and in view of the furthur fact, that J. L.
Yarborough as Clerk, of the City,, is the custodian of the Archives, Records and Property
of said City, and that it will be his duty, to care for and preserve, said effects and
property until he is relieved of such responsibility by lawful authority, for which service
said Clerk will be entitled to compensation, Be it therefore resolved, by the council
that said Clerk is, hereby allowed one month's salary viz, 75.00, inradvance from the
15th day of August, ''1931. and that he be and is hereby authorized to at this time
draw a check on the treasury for this amount, A poll was taken on the above resolution
and resolution`wsas unanimously adopted.,
A short recess was then :taken to allow the Clerk to make checks, covering bills
ordered paid. Checks were then signed by the ;proper committeemen.
The certificates of the special Charter Election were then presented and council-
man Red presented the following resolution;

And now comes on to be considered the returns of an election held in the City of
South Miami, Florida, on the 10th, day og August 1931, held in conformity to the provis-
ions of House Bill 210. 1362 of the extraordinary session of the 1931 Legislature of Florida,
to determine, the question, shall or shall note the Charter of the City of South Miami#
Plorida, be abolished, And the 'council having inspected and considered said returndo
which seers to be regular on their face, and in duo form, find and declare* that, 341
