1927-06-25 LEGISLATIVE CHARTER OF CITY OF S MIAMIr - e u June 25,i 1927. The Legislative Charter for the City of South Miami going into � effect this 25th day of June, A. D. 1927, in accordance 'With the re=;� ' quirements of said charter the City Counci1�as named by said Charter' (, met and organized at 12:00 o'clock noon in the City Hall on Sunset Road. „ W. A. Foster was sworn in as Mayoi�of the City of South Miami by R. Z. Martin, Notary Public of the State of Florida, J L. Paxson, John Myers, W. G. Stang and R`. L. Martin were then sworn in as Coune lmen.of the City of `South Miami by Mayor Foster, The council organized by electi ng J. L Paxson President of tke ., City Council and R. L. Martin Vice -Presi + ,�,r�✓ : dent . President Paxson then a follows ppointed the various committeemen as W G. Stang, Police Committeeman R L * Martini Sanitary Committeeman John Myers, Street Committeeman On a motion by Councilman.ayers, seconded by Councilman Martin, Shea W Airey was appointed City :Clerk, Tax Collector, Tax Assessor and Treasurer; Wm. J. Weaver was appointed ..Chief of Police; W. A. Foster: was appointed Judge of the Municipal Court. The motion was carried. Above appointees were then sworn to the discharge of their ,re- spective duties. It was regularly moved,; seconded and carried that Hall & Pentland, Accountants, be employed to audit the books of the Town of South Miami bwfore being 'taken over by Y the City of South 34iami. It was regularly moved, seconded and carried that -the regular meeting nights of the City Council of South Miami be the first and third Tuesdays of each month., It was regularly moved passed that J. C. ,,, seconded and Sullivan be appointed City Attorney. It was regularly moved, seconded and passed that A. H. Beck be appointed Building Inspector Councilman Stang moved and Councilman Myers secorried the motion that the following resolution be adopted: RESOLUTION #26. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF T10 CIT -Y OF SOUTH MIAMI, FLORIDA: WHEREAS, the Town of South Miami was incorporated on the 2nd day of March, A. D. 1926, and WHEREAS, by recent act passed by the legislature of i the State of Florida in its 1527 Session, entitled: 11 I June 25, 1927. - i�2• "AN ACT , TO ABOLISH THE PRESENT 1AUNICIPA " GOVERN1sN2 OF THE TOVN OF SOUTH MIAYI, D,1DE' COUNTY, FLORIDA, AND TO CREATE, ESTABLISH AND REORGANIZE A MUNICIPALITY TO BE 1alOWN AND DESIGNATED THE CITY OF SOUTH MIAi?'I. AND TO DEFINE ITS TERRITORIAL BOUNDARIES 61D TO PROVIDE FOR ITS' GOVERNMENT, JURISDICTION, PO'1JERS, FRANCHISES AND PRIVILEGES, ADD TO AUTHORIZE THE ISSUANCE OF MUNICIPAL BONDS, AND FOR OTHER PURPOSES, T i The said Town of South Miami was abolished and the City of South Miami created, "and o WHEREAS, the said act provided for a vote of the people on the ratification or rejection of said Act, and further provided that if a majlority of those legally voting at the election called for the purpose, vote in favor of the ratification of this Act same shall become effective and a law on the tenth day after the date of said election, and WHEREAS, an election was held on the 14th day of ' June, ,A. D. 1927, by which said election :a majority of the qualified electors of said Town of South Miami voted' to ratify said charter, and WHEREAS, by resolution duly passed by the Council of the Town of South Miami and by operation of law,, the said Charter for the City of South Miami became < operative and effective at twelve O'clock midnight on the 24th day of June, A. D. 1927, NOW, THEREFORE, BE IT ORDAINED by the Mayor and the City Council of the City of South Miami, and Pursuant to said Charter, that all of the acts and doings of the Council of the Town of South Miami, and any and all other Peers thereof by them done as such for and on behalf of ' this said municipality are hereby validated, ratified„ -and cnni "irmea° a.Id that all Ordinances, Resolutions and Laws, Of the Town 01- =South Miami be and the same are hereby especially ratified and confirmed, as and for the Ordinances,: Resolutions and Laws of the Cit;�- of South Miami insofar as the same do not conflict with the Charter herein above referred to, or with the Laws of the State of Florida, and that hereafter all Ordinances, and Resolutions passed by- the Council of the Town of South Miami shall, and the same are effective and validated as the Ordinances and Resa utions of the City of South Miami the same to have as full force and effect as the Ordinances and Resolutions of the City Of South Miami as they did for the Town of South Miami; Drovided that nothing therein is in conflict with the said Charter or with the Laws of the State of Florida.
