Res No 043-15-14382RESOLUTION NO.043-15-14382 A Resolution acknowledging Commissioner Welsh's (Group Seat IV) appointment of Subrata Basu,as the representative of Group Seat IV,to serve on the Health Facilities Authority for an unexpired term ending December 19,2015. WHEREAS,Article II,Section 8,Sub-section A of theCity Charter provides that: ***When a Board or Committee is comprised of five members,each City Commissioner shall appoint one person to serve asa representative on the Board or Committee.When there are more than five(5)members ona Board or Committee,each City Commissioner shall appoint one person to serve asa representative on the Board or Committee,and all members of such Board or Committee in excess of five(5)shall be appointed by three (3)affirmative votes of the City Commission based on recommendations submitted by any City Commissioner.When a Board or Committee has less than five(5)members,then the selection of all members shallbebythree(3) affirmative votes of the City Commission from recommendations submitted by any City Commissioner.(Amended 2-09-10) WHEREAS,Ordinance No.11-95-1584 creating the City of South Miami Health Facilities Authority,provides: Section 3(b)"Members:Terms of Office.The Authority,unless otherwise provided byStatelaw,shallbe composed of five voting members.Members shall be residents of the City appointed by the Commission for terms of four years;provided that of thefirst members appointed,the Commission shall designate one member toserveforoneyear,one member toservefortwo years,one member toservefor three yearsand two members to serve forfour years,ineachcaseuntilhisorhersuccessoris appointed andhasqualified. Thereafter,all appointments bythe Commission,except appointments tofill vacancies shallbeforaterm of fouryears.Vacancies during a term shallbe filledforthe unexpired termbytheCommission,a member of the Authority shallbe eligible for reappointment.Any member of the Authority matbe removed bythe Commission for misfeasance,malfeasance,willful neglect of duty or such other cause authorized by law." WHEREAS,Commissioner Welshnowdesiresto appoint Subrata Basutoserveonthe HealthFacilityAuthority,ashisrepresentative,tofillthevacancyleftbyBarbaraAckerwhose termwouldnotexpireuntilDecember 19,2015.Therefore,Mr.Basu's appointmentshallexpire December 19,2015,oruponhisremovaloruntila successor isduly appointed andqualified. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT: Section 1.TheCityCommissionhereby acknowledges Commissioner Welsh's right toappointSubrataBasuastherepresentative of GroupSeatIVforanunexpiredtermand Page 1 of2 Res.No.043-15-14382 pursuanttothetermsoftheCityCharterand Ordinance 11-95-1584,contingentuponthatthis appointment willnotbeviolatingthedualoffice of Florida's Constitution.
