RESOLUTION NO.038-15-14377 A Resolution approving an application for variances fora new two-unit residential structure located at 6031 SW 76 Street,South Miami,Florida, within the RM-18 zoning district. WHEREAS,on February 2,2015CensigHoldings,LLC,submitted an application forfour variancestoconstructanewtwo-unitresidentialstructurewithinthe RM-18 zoningdistrict;and WHEREAS,application No.PB-15-002 was submitted tothe Planning Board bythe applicant Censig Holdings,LLC;said application requesting approval of a variance fromSection 20-3.5(F)to permit the construction of a new two-unit structure,to allow forlotsize7,358 squarefeet where a minimum of 10,000squarefeetis required,to permit a frontage of 52.03 where 75feetis required,andto permit side setbacks of 5feet where a minimum of 12.5feetis required,fora new two-unit residential structure located at 6031 SW 76 Street,South Miami, Florida,within the RM-18 zoning district;and WHEREAS,the approval of a variance requires a recommendation fromthe Planning Boardandthe approval of theCity Commission afterapublic hearing;and WHEREAS,atits February 10,2015 meeting,the Planning Board afterapublichearing voted4ayes1naysto recommend approval of thevariancesrequested;and WHEREAS,the Mayor andCity Commission of theCity of South Miami desireto accept the recommendation of the Planning Board. NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA THAT: Section1.Therecitalssetforthinthisresolutionaretrue,thattheyaresupportedby competentsubstantialevidenceandthattheyareincorporatedintothisresolutionby reference. (5)Theapplicant's Statement ofHardshipstates that allvariancesdecisionsshallbebasedupon anaffirmativefinding that the denialof the variancewould result ina hardship to the landowner.Further,the hardshipmustbe inherent in the land. Thesubjectparcelat 6031 SW76 Street isconsidereda legal non-conforminglotofrecordand anynewconstructionmustmeet the zoning standardsforthe RM-18,Low Density Multi-Family zoningdistrict.Developmentofthepropertyisprohibitedbecausethelotareaoftheparcelis 7,358 sq.ft which isbelowthe minimum required lot size of 10,000 sq.ft Theproperty will face SW76Street which has only 52.03 feetof frontage.This frontage isbelowthe minimum requiredfrontageof75feetforthezoningdistrict (LDC Section 20-3.5(F).Thethirdandforth variance requestedareside(interior)setback variance.Please refertotheproposedSite Plan, Sheet Al,that illustrates the overall intent Further,the development will comply with all other City Code requirements. In June2008 the City Commission amended the Land Development Code to add specificcriteriafor judging variance requests.LDC Section 20-5.9 (H)now requires that allvariance decisions shallbebasedonan affirmative findingas to each of the following criterion: I.The varianceisnecessarytorelieveparticular extraordinary conditions relating to a specific property; This structure is built on an irregular shaped lot and was constructed in 1951 prior to the establishment of the current dimensional requirements. The approval ofthe variance is consistent with the Gty's objective to preserve the character ofthe designated structure and neighboring structures. At the February 10,2015 Planning Board meeting,the boardreviewed Application PB-15-002 for the requested variances,and following a public hearingon the application,voted4ayesand I nays to recommend approvalof the varianceas requested. Recommendation The Planning Boardrecommendsapprovalofthe request as presented.TheCityCommission canapprovetheapplicationassubmitted,approvewithconditions/modifications or deny the application.Should the Commission recommend approvalof the requested variances,the development will comply withRM-18zoningdistrict,Section 20-3.5(F),Dimensional Requirements;includingmaximum building heightof2 stories (30feet),maximumimpervious coverageof 60%,andall other City Code requirements. Mr.Marrero stated that the gentleman totheeast,Dr.Wertheim,does not livein the residencethatheowns.Mr.Marrerothenstatedthathisclientswereoriginallyintalks withDr.Wertheimtopurchasehispropertyaswellbuttalksbrokedown.If theywere topurchaseDr.Wertheim's property,thenthevariancesthatarebeingrequestedatthis time would not be needed. Ms.Fischer stated that onlyone house could be placed onthelotand would be more appropriate,especially sincethezoningdistrict directly tothesouthwasRS-3.Shethen stated that afivefoot setback isthe equivalent of a sidewalk.It gives the impression that there isazerolotlineforthe property.Ms.Fischer stated that sheis concerned that if the5foot setback wereapproved,theplanscouldchange;utilizing thenew setback forthe whole side,bythetimeit comes before the ERPB.She then stated that because a 5foot setback isnotin character withthe neighborhood,she could not support this project.Mr.Marrero stated that he understands her concerns,and that itis not the intention of the developer touse that 5foot setback forthe whole building.If necessary, a condition could be made,tying the submitted plans forthe project tothe approval for the variance. Mr.Williams asked Mr.Fischer howshefelt about the response that wasgiven.Ms. Fischer responded that she would bemore comfortable if the project wereasingle family residence with larger side setbacks. Mr.Greiner stated thatwhileasinglefamilyhouse could be built onthe property,due tothe regulations forthe district,thesize of the single family house could rival thesize of the multi-family project that is currently being reviewed.Thefact that itisa two-unit structure is irrelevant. Ms.Glaveyasked staff ifa variance forthesize of thelot(7,358SF)would be necessary regardless of whatwasbuiltonthe property,of whichMs.Kamalistatedyes.
