ORDINANCE NO.07-15-2214 An Ordinance of the City of South Miami,Florida,abandoning and vacating a portion of the unimproved right-of-way of SW 60 Avenue located between SW 79 Street and SW 80 Street,which was previously abandoned and vacated by Resolution 81-05-12060,ratifying the action taken by Resolution 81-05-12060 and amending the conditions of vacation originally adopted in such resolution. WHEREAS,theCity Commission hasthe power tovacate,abandon,discontinue andclosean existing publicorprivatestreet,alley-way,road,highway orotherplace usedfortraveloranyportionthereof,otherthanastateorfederalhighway,andto renounceandquitclaimanyright of theCityandthepublicinandtoanylandin connection therewith;and WHEREAS,the Administration,in 2005,recommended the vacating of that portion of SW 60Avenuelocatedbetween SW 79Streetand SW 80Street,astheright- of-waywasnotservinganypublicpurposetotheCityorthepublicandbecause,uponits reversion tothe adjacent property owners,it would constitute additional ad valorem tax revenues tothe City;and WHEREAS,theCity Commission,onJune14,2005,adopted Resolution 81-05- 12060 which provided thatthe portion of SW60 Avenue described above within theCity of South Miami was thereby,abandoned,renounced,and disclaimed bythe City of South Miamiand,pursuant theretoandtheplatcreatingthatroad,reverted tothe ownership of the immediately adjacent properties. WHEREAS,the original abandonment contained certain conditions,including that "Abutting property ownersmaynotadd development to their existing properties or create new building sites which usesthe square footage of the vacated street[;]"and WHEREAS,on December 2,2014,the City Commission approved by Resolution afinal plat proposed forthe property abutting SW 60 Avenue closed bythe above Resolution 81-05-12060,however,since that time it has been determined that the approved final plat isnotthemost appropriate configuration forthelotstobe developed on such abutting property;and WHEREAS,theCity Commission has determined that itisinthe public interest and public health,safety and welfare to ratify the passage of Resolution 81-05-12060 and to amend the conditions of Resolution 81-05-12060 to permit the abutting property touse the square footage of the vacated right of way of SW60 Avenue for the creation of one building site that abutsthe vacatedright-of-way of SW60 Avenue as reflected inthe previously approved five re-platted lotssoasto avoid the necessity of creating alotwith a narrow alleyway attached totheproperty,and clarifying thatthe abandoned right-of- way canbe used forthe calculation of front linear footage of lots abutting the abandoned right-of-way butnotforanyadditional development or other purpose including butnot Page1 of 4 Ord.No.07-15-2214 limitedtoany calculation of floorarearatioinexcess of whatcouldbeobtainedbyusing thelot area that doesnot include the abandoned right of wayorforany calculation of impervious area in excess of whatcouldbe obtained by using thelot area that doesnot include the abandoned right of way;and WHEREAS,theCityAttorneyhasopinedthatsincea conveyance of aninterest in property occurs asa result of the vacation,that South Miami City Charter Article II, Section 6(6),requires that such conveyance beby ordinance;and NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.The abandoned and unimproved right of way known asSW60 Avenue,located between SW79StreetandSW80 Street that is more fullyand legally described inthe attached Exhibit "A"is hereby vacated,abandoned,discontinued and closed.TheCityherebyrenouncesanyright of theCity,and of thepublic,totheproperty described inthe attached Exhibit"A"andherebyquitclaims ownership insaidproperty, andauthorizesthereversion of title,tothecurrentowners of theimmediatelyadjacent property,including thepropertythatislegallydescribedas Tract 8,lesstheWest100 feetthereof,andthewest25feet of SW60AvenueadjoiningTract8whichwasvacated by CityResolution 81-05-12060,REVISED PLAT OFA PORTION OFTHE AMENDEDPLATOFPALMMIAMIHEIGHTS,accordingtothePlatthereof,as recordedinPlatBook43,Page37 of thePublicRecords of Miami-DadeCounty,Florida. This action is subject tothefollowingconditions: a.Abuttingpropertyownersmaynotaddtotheimperviousarea of any developmentbasedonthesquare footage ofthevacated right-of-way ("ROW") andmaynotusethevacatedROWtoaddtothefloorarea of any future development oftheir existing properties butmayusethesquare footage ofthe vacatedROWforthecalculationoftheminimumlotsizerequirementsofthe lotsabuttingthe abandoned right-of-way iftheoverallparcelbeing subdivided is large enough without the vacated ROWto accommodate thesame number of subdividedlots.ThevacatedROWmayalsobeusedforthecalculation of the frontfootagerequirements of theabuttinglotsandthefloorareacalculationsfor eachlotmaybe calculated based onthesizeofeachlot,including the vacated ROW,solongastheglobalfloorareaforthenew subdivision doesnotinclude thevacatedROW.RegardingDavisOaksfivelotsubdivision,thetotalfloorarea for houses onall5 lots inthe subdivision shall beno more than 25,509.18 sq ft. Thetotal footprint ofthe5 houses and accessory buildings inthe subdivision shall beno more than 17,006.08 sq ft.The total maximum impervious coverage onallthe lots inthe subdivision shall beno more than 22,674.8 sq ft.The total pervious landofthe5 lots ofthe subdivision shallbenolessthan 41,218.01 sq ft. b.Abutting property owners may not subdivide or re-plat their property using thesquare footage or lineal footage insuchawayastocreatealotthatis incompatiblewiththe surrounding neighborhood. Section 2.The City Commission approved this ordinance onfirst reading on February V7,2015,byavote of _5to Q ,and following notice on 2/20/1 5held a second reading and public hearing on March 3,2015,andthis ordinance is hereby enacted forthe purposes herein expressed. Section 3.Notice.Notice of the adoption of this Ordinance bythe Commission shall be published one time,within 30days following its adoption,inone issue of a newspaper of general circulation published in Miami-Dade County.The proof of publication of the notice of public hearing,the Ordinance as adopted,andthe proof of publication of the notice of the adoption of such Ordinance shallbe recorded inthe public records of Miami-Dade County. Section 4.Codification.Significant portions of this ordinance may become and be made part of the Code of Ordinances of the City of South Miami as amended;that the sections of this ordinance maybe renumbered or re-lettered to accomplish suchintention; andthatthe word "ordinance"maybe changed to"section"or other appropriate word. Section 5.Severability.If any section,clause,sentence,or phrase of this ordinanceisforanyreasonheldinvalidor unconstitutional byacourt of competent jurisdiction,thisholdingshallnotaffectthevalidity of theremainingportions of this ordinance. Section 6.Ordinances in Conflict.All ordinances or parts of ordinances andall sectionsandparts of sections of ordinancesindirect conflict herewith arehereby repealed.However,itisnottheintent of thissectiontorepealentireordinances,orparts of ordinances thatgivetheappearance of beingin conflict when thetwo ordinances can beharmonizedorwhenonlyaportion of theordinanceinconflictneedstoberepealedto harmonize theordinances.If theordinancein conflict canbe harmonized byamendingits terms,itisherebyamendedtoharmonizethetwoordinances.Therefore,onlythatportion thatneedstoberepealedtoharmonizethetwoordinancesshallberepealed. Section 7.Effective Date.Thisordinanceshallbecomeeffectiveuponenactment after second reading andpublichearing. (3)In addition therearelettersfromBell South,Miami-Dade WaterandSewer,andFPLstatingthat theyhavenoutilitiesintheright-of-wayanddonotobjecttothestreetclosure. (4)The petition ofthe applicants statesthatthereisnoreasonforthe right-of-way toexistandthatthe paving ofa street would create traffic andbe dangerous to children inthe area.Itisalso pointed out that 60th Avenuesouth of 80th Streetisclosed.
