A Resolution of the City of South Miami,Florida amending its approval of theplat
of Davis Oaks,beinga re-plat of aportion of tract 8 of "revised plat of a portion of
the amended plat of Palm Miami Heights"recordedinPlat Book 43,Page37,
Miami-Dade County,Florida.
WHEREAS,onDecember2,2014,theMayorandtheCityCommission of theCity of South
Miami received,reviewed and approved an application filed by RP1-SM,LLC,a Florida limited liability
company,seekingtore-platpropertylegallydescribedasTract8,lesstheWest 100 feetthereof,andthe
west25feetofSW60AvenueadjoiningTract8whichwasvacatedbyCity Resolution 81-05-12060,
REVISEDPLATOFAPORTIONOFTHEAMENDEDPLATOFPALMMIAMIHEIGHTS,
accordingtothePlatthereof,asrecordedinPlatBook43,Page37 of thePublicRecords of Miami-Dade
County,Florida;and
WHEREAS,afterfurtherreviewand discussion withthepropertyowners,neighborsandother
interestedpersons,and uponthe recommendation ofCitystaffandinaccordancewiththeland
development regulations oftheCityofSouth Miami,theMayorandtheCity Commission have
determined thatthe approval oftheplat should be amended to eliminate the flagpole lot provided therein;
and
WHEREAS,pursuanttoother anticipated actionbytheCity Commission toapprovean
ordinanceratifyingandamendingitsvacationoftherightofway of SW60Avenue,locatedbetweenSW
79StreetandSW80 Street,and amending the conditions of approval thereof,the applicant has agreed to
amenditsplattoreconfigurethelotsthereinandremovetheflagpolelot,consistentwiththeconditionsof
approval of the amended vacation and abandonment of SW60 Avenue.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.ThePLATOFDAVISOAKS,asamendedtoreconfigurethesubdivisiontoeliminate
alot having a flagpole configuration,as provided forbythe ordinance ratifying and amending Resolution
81-05-12060 (acopyofthe proposed amended platis attached tothis resolution and made aparthereof
by reference and will be recorded byoron behalf of RP1-SM,LLC),is hereby approved and subject to
the following conditions,and/orother conditions deemed appropriate bytheCity Commission:
1.Compliance withthe conditions ofthe Miami-Dade County approval of application No.
T-23506-4-REV;
2.CompliancewithcurrentCityLand Development Code requirements.
3.CompliancewiththeCity'stree removal andcanopy mitigation requirements.
4.CompliancewiththeCity'sPublic Works requirements forany driveways,sidewalksor
other improvements.
5.Compliance withthe provisions of ordinance ratifying and amending Resolution 81-05-
12060.
6.Demolition ofthe existing one-story structure prior to issuance ofa development permit.
7.Compliance withany Miami-Dade County Environmental Resource Management
requirementspriortofinalrecording of thisplat.

WHEREAS,the Mayor and the City Commission of the City of South Miami have received and
reviewed an application filed by RP1-SM,LLC,a Florida limited liability company,seeking to re-plat
property legally described as Tract 8,less the West 100 feet thereof,and the west 25 feet of SW 60
Avenue adjoining Tract 8 which was vacated by City Resolution 81-05-12060,REVISED PLAT OF A
PORTIONOFTHEAMENDEDPLATOFPALMMIAMIHEIGHTS,accordingtothePlatthereof,as
recorded inPlat Book 43,Page37ofthe Public Records of Miami-Dade County,Florida;and
WHRERAS,theMiamiDade County plat committee meton November 21,2014and

BACKGROUND:
OnJune11,2014,anapplicationforTentativePlat Application no.T-14-006)review wasfiled
bytheowneroftheproperty,RP1-SM,LLC,inordertodivideoneexistingtractofland
located at 6001 SW80thStreet (Figure 1)into five single family lotsasshownin Figure 4.This
propertyalso includes aportionofSW60thAvenue,anunimproved right-of-way thatwas
abandoned and vacated by Resolution No.81-05-12060,and recorded inthepublic records of
Miami DadeCounty.Theexistinghome,andother structures will bedemolished prior tothe
construction of the new singlefamilyresidences.
Following submittal totheCity,thepropertyownersubmitted for reviewto Miami-Dade
County,pursuanttoChapter28oftheCountyCode.Theproposalwastodividethe 1.31 acre
tracttocreate five buildable lotsasdepictedinthe Figure 4proposed plat,withlots1through3
fronting SW79thStreet,andlots4&5 fronting SW80thStreet.The Miami Dade Piatt
Committee approvedtheproposed Tentative Plat (application no.T-23506-3-REV)on
September 5,2014.Pursuant to Chapter 28ofthe County Code,the property ownerthen
submitted for Final Plat review tothe City of South Miami City Commission.
OnOctober 21,2014,theCity Commission review the Final Plat request described above and
deferred the item onthe grounds that the applicants useofthe vacated right-of-way was
contrary to the stipulation of the vacation stated in Resolution No.81-05-12060.The
Commission suggested the applicant consider other options for the subdivision ofthe tract,and
presentthose options ata future Commission meeting.
On November 6,2014,the applicant presented the original proposal,and four additional
Options for Commission review.However,the applicant indicated that the original request was
still themost feasible proposal and requested approval ofthat Final Plat The Commission failed
toapprovethemotionfor Final Plat Davis Oaksbyavoteof1 aye;4 nays.
