RESOLUTION NO.031-15-14370 A Resolution acknowledging Vice Mayor Harris'(Group SeatIV) appointment of SallyPhilips,astherepresentativeofGroupSeatIV,to serve on the Board of Trustees/Police Officers Retirement Trust Fund,for a two- year term ending March 2,2017. WHEREAS,Article II,Section 8,Sub-sectionA of theCityCharterprovidesthat: ***WhenaBoardorCommitteeis comprised of fivemembers,each City Commissioner shall appoint oneperson toserve asa representative onthe Board or Committee.When there are more than five (5)members ona Board or Committee,each City Commissioner shall appoint one person to serve asa representative on the Board orCommittee,and all members of such Board or Committee in excess of five(5)shall be appointed by three (3)affirmative votes of the City Commission basedonrecommendations submittedbyanyCityCommissioner.WhenaBoardorCommitteehasless thanfive(5)members,thentheselection of allmembersshallbebythree(3) affirmative votes of theCity Commission from recommendations submitted by any City Commissioner.(Amended 2-09-10) WHEREAS,theCity Commission desiresto acknowledge the appointment of SallyPhilips,a resident of theCity of South Miami,toservefora two-year termonthe Board of Trustees/Police Officers Retirement Fund.Appointment shallexpireMarch2,2017oruntil removed or unless a successor isduly appointed and qualified;and WHEREAS,commencing with appointments made after January 1,2009,Sec.2-22 "Term Limits"of the Code of Ordinances provides that,appointees are limited totwo(2) consecutive two-year terms of membership ona specific commission,board,or committee. Afterservinga maximum of two(2)consecutive yearterms,an appointee shallnotbe reappointed tothesame commission,boardor committee unlessatleastoneyearhaselapsed between theterm limited position andthe effective date of commencement of the proposed appointment fora new term;and WHEREAS,Sec.2-22"TermLimits"oftheCode of Ordinances,asamendedbyOrdinanceNo. 06-14-2184,datedApril15,2014,providesthatthe appointer,orhisorhersuccessorinoffice,mayextend thetermlimitsofhisorherappointmentwiththeadviceandconsentofamajorityoftheCity Commission; and WHEREAS,thiswillbeMs.Philips'first,two-yeartermservingonthisBoard. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT: Section1.TheCityCommissionherebyacknowledgesViceMayor Harris'rightto appointSallyPhilipsto the Board of Trustees/Police Officers Retirement Fund asthe representative of GroupSeatIV pursuant totheterms of theCityCharter.
