Winn -Dixie Approval: The Contractor shall not commence work under this contract until he has obtained all insurance required under this section and this insurance has been approved by Winn- Dixie, nor shall the contractor allow any subcontractor to commence work in his subcontract until all similar insurance required of the subcontractor has been obtained and approved by Winn- Dixie. B. .Insurance: The Contractor shall not commence work under this contract until he has furnished evidence of insurance, satisfactory to Winn -Dixie Stores, Inc., as well as himself against all claims, liability, damage and accidents. The Contractor shall, at his expense, maintain such insurance in.full force and effect during the life of this contract, including completion and final acceptance of the work cancellation of such insurance shall not be made without written notice from the insurer to Winn -Dixie Stores, Inc., 30 days prior to said cancellation. The minimum kinds and limits of insurance to be carried by; the Contractor shall be as follows: Workman's Compensation - to include all benefits applicable under the Workmen's Compensation law for all employees of the Contractor and . all subcontractors. ' C. Protection of Persons and Propertyn The Contractor shall be responsible for initiating, maintaining and supervising all safety precautions and programs in connection with the work. The Contractor shall take all necessary precautions for the safety of persons and property, and shall provide all necessary protection to prevent damage, injury or loss. • The Contractor shall assume the risk of loss or damage to his ' • construction machinery, tools and/or equipment, and employees' tools and effects, caused by fire, extended coverage perils, vandalism and malicious mischief. d. Indemnification: The Contractor agrees to indemnify and hold harmless Winn -Dixie Stores, Inc., its subsidiary companies, and the Property Owner from all claims, suits, losses or damage (including damage to persons or property) arising from anything done by or negligence of the Contractor or its subcontractors or the efficers, agents or employees of *either while engaged in the performance of this contract, or while in or about said building or premises, or arising from accident or injun:y to any subcontractor or any officer, agent or employes of a subcontractor while engaged in or about the performance of this contract, or while in or about said building or premises, or arising from liens or claims for services rendered or labor or materials furnished in or for the performance of this contract, such idemnification not to exceed 11,000,000.00, per occurance. • 1X.3 PERMITS AND -FEES: The contractor shall provide and pay for all construc- tion permits, and shall pay any fees incidental to any inspections required by law. • 1A.4 WATER AND ELECTRICITY: All water and electricity necessary for the construction of the project shall be paid for by the Contractor. Contractor shall make all necessary arrangements for these services. 1A.5 SUPERVISION OF THE WORK: The Contractor shall provide a thoroughly competent foreman or superintendent who shall be in charge of the work at all - times during the construction. 1A.6 CONSTRUCTION CONTRACT: • A. Schedule of values shall be prepared in conformance with requirements of General Conditions and submitted to Winn -Dixie prior to signing construction contract • B. Construction Contract shall be prepared on AIA form A101 latest edition. • 1A.7 PAYMENTS: A. Period covered by Application for Payment shall be one calendar month ending on the twenty -fifth day of the month. B. Provided that the Application for Payment is received by Winn -Dixie not later than.the first of the following month, Winn -Dixie will make payment to the contractor not later than the fifteenth day of the same • month. C. If an Application of Payment is received by Winn -Dixie after aplication date fixed above, payment shall be made by Winn -Dixie not later than an equivalent amount of days after Winn -Dixie received the Application for Payment. • D. Winn -Dixie shall retain 10% of the amount of wach progress payment until the final completion and acceptance of the work covered by this contract. After final acceptance of the work,.Winn -Dixie shall continue to retain 10% of the amount fo the contract, or shall retain the full amount of the last of final payment fue to contractor, whichever is greater in amount, until presentation by the Contractor of all affidavits required by the Mechanic's Lien Law of the State and furnish to Winn -Dixie a Certificate of Occupancy. E. At Winn- Dixie's request the contractor shall furnish partial release of lien affidavits for labor an/or material attached with payment request for previous month. IA.8 SCHMULES: The Contractor shall furnish Winn -Dixie with a schedule . indicating the dates on which he will require the final decision or other . instructions concerning materials or work subject to selection form samples. The purpose of this Schedule is to permit some convenience to Winn -Dixie in making these selections without unduly delaying the work. 1A.9 AS -BUILT DRAWINGS: During the progress of the work, the job superinten- dents of pluIInbing, heating, ventilation, air conditioning and electrical subcon- tractors shall record on the drawing (one complete set) any variations from*the contract documents and this set shall be turned over to Winn -Dixie at the comple- tion of the job. 1A.10 SANITARY PROVISIONS: The Contractor shall provide and maintain in a neat and sanitary condition, such accommodations for the use of his employees as may be necessary to comply with the regulations of the State Board of Health and any sanitary regulations of the community in which the work is being performed. No nuisance will be permitted. I.A.li GENERAL NOTES: A. Alterations to existing work being of such nature that all facets of the work being impossible to detail and specify, it is therefore, the responsibility of the Contractor to carefully examine the building and completely familiarize himself with the existing conditions and correlate these conditions with the scope of the proposed new work, in order that a • complete, neat, and workmanlike completed job will be the end result, all in full accordance with the intent of these drawings. B. The Contractor shall verify all existing dimensions and dimensions shown on the drawings before proceeding with the work. C. The demolition of existing work shall be done as the work progresses. All materials which cannot be reused and those not noted on the drawings to be relocated shall be removed from the site. Removal of existing work shall be done in a careful manner so as not to damage existing surfaces and materials which are to remain. The demolition or removal of existing portions and the erection of new work and applications of new finishes must be scheduled with the store officials and executed with extreme care in order to minimize inconvenience to the daily operation of the store. THE STORE SHALL CONTINUE ITS NORMAL OPERATION AT ITS REGULARLY SCHEDULED HOURS. The contractor shall take all safety precautions during all phases of the work to protect from injury all store customers, store personnel and Contractor's workmen. ..tee. D. Any and all surfaces which are damaged during demolition and which are intended to remain shall be repaired and refinished to match similar and adjacent undamaged surfaces. Any fixtures, equipment, etc., damaged due to negligence -of the contractor shall be replaced with a new fixture, equipment, etc., of equal quality with no additional expense to Winn -Dixie or the Property Owner. E. All corridors, aisles, etc, shall at all times be kept free of stacked new materials, all debris, and Contractor's equipment, in order to maintain continuous, unobstructed pedestrian traffic. F. All items removed, become the property of the contractor, unless noted otherwise. G. General contractor all provide any and all items requested by local Building Officials to obtain Certificate of Occupancy (C.O.) before final payment. 1A.12 WINN- DIXIE'S EQUIPKMr: A. Refrigerated display cases, coolers and freezers - furnished and installed by Winn - Dixie; connected ready for use by Contractor. B. Machine room racks - refrigeration machines installed on racks (furnished and installed by Winn-Dixie). Electrical connections complete and ready'for use by the wired from this point by Contractor. The electrical work on rack in pre -wired to a control panel which must be wiredffrom this point by Contractor. Note: The refrigeration tubing is furnished and connected by Winn - Dixie. C. All merchandising displays and equipment such as gondola shelving, wall shelving, checkstands, cash registers, island tables, desks, cutting tables, wrapping tables, and portable power driven equipment furnished and installed by Winn- Dixie. See plans for items requiring electrical connections by contractor. • D. Wall lettering - furnished and installed by Winn - Dixie. E. Winn -Dixie sign letters - furnished and erected b'y Winn�Dixie.- Connected by Electrical Contractor. F. Safe - furnished by Winn- Dixie; set -in -place by Contractor. G. Refrigeration tubing - Winn -Dixie will furnish and connect all tubing to display cases, machine room racks, coolers, freezers, and heat reclaim coil. H. Refrigerated display oases, coolers and freezers - Electrical and Plumbing Contractors shall make connections for complete installation ready for operation. I. See drawings for additional qualifications and clarifications. 1A.12 BIDS: Winn -Dixie or the Property Owner reserves the right to reject any and all bids without penalty or prejudice. They may also accept the bid they desire for the performance of the work. DIVISION 2 - SITE WORK SECTION 2A CLEARING, GRADING EXCAVATION AND BACRFILLING 2A.1 GENERAL; The contractor shall visit the site and shall determine for himself the existing conditions which affect the work. He shall also determine • • for himself the. availability of any suitable earth required and the quantities of such fill needed. The work included in this section is clearing, excavating, filling, compaction, grading and testing necessary to complete to work shown on the drawings. 2A.2 CLEARING: The area to be covered by building shall be completely cleared of all material and matter. All voids and holes caused from the clearing opera- tions shall be filled and compacted. The contractor shall relocated any existing utility poles, meters,- valves, etc., as required to complete the proposed addi- tion and alteration. 2X.3 EXCAVATING AM BACKFILLING: The excavations shall be to the depths and dimensions indicated on the plans. Cut the sides and bottom of footing excava- tions clean; if stable, they may be used for placing the concrete without forms. All footing shall bear on firm undisturbed soil or compacted fill. If any muck or other suspicious material is encountered, it shall be removed to a depth of one foot below the bottom of the footing or slab without adjustment on contract price. If there is evidence that unsuitable soil extends below this, Winn -Dixie shall be notified. . Excavated material from the site may be used as a fill if done to meet proposed grades. Fill shall be distributed in layers to a depth suitable far the compac- tion technique used. Where possible, tamping, shall be done by mechanical means. 2A,4 COKBACTION.TESTS: After all fill under floors has been placed and fully compacted, the Contractor shall have an independent testing laboratory make a density test for compaction of soil by the modified Proctor Test (ASTM Designa- tion D1557,.Method "A "). The Proctor Curve shall show a density of not less than 95X -under the floor slab, if less than 95% is shown, additional compaction-will be required until the density equals 95% or greater. All costs shall be borne by the Contractor. 2A.5 DEWATERING: Removing all water from excavations before placing concrete therein and maintain the excavations free of water until concrete is placed. Provide dewatering equipment as necessary. SECTION 2B SOIL POISONING: Pretreatment shall be provided for termites in accordance with the recommendations by the State Board of Health. A certificate stating that the building has been treated and guaranteeing against termite infestation for a period of one year shall be furnished. Poisoning shall be done by the use of Dieldrin at a normal rate of one pound technical material per 300 square feet of soil, applied in not less than 50 gallons of water. All breaks in slabs, such as expansion joints, wherever pipes, conduits, etc., extent through slab, shall have material applied at double the normal rate. SECTION 2C ROADS AND WALKS: Contractor shall be responsible for repairing any damage to existing paving or walks which is incurred during construction of the addition and alterations. Quality, thickness, and appearance of new work shall match existing. SECTION 2D PAVING AND STRIPING: Refer to the drawings for work required. SECTION 2E BASCART CORRALS AND HWICAP SIGNS. A. Install Bascart corrals as indicated on the drawings. B, Install Handicap signs as indicated on the drawings. If drawings do not indicate Handicap signs two shall be installed at locations directed by Winn - Dixie. The striping shall be painted Traffic Blue. DIVISION 3 - CONCRETE . SECTION 31 STRUCTURAL CONCRETE 3A.1 L: Furnish all labor, materials and equipment necessary to complete all concrete POURED -IN -PLACE as indicated on the drawings and as specified herein. 3A.2 COORDINATION WITH O'T'HER TRADES: Cooperate with other trades to' coordinate all openings and placement of embedded items which are required to be furnished and/or placed under those sections of the specifications pertaining to those applicable trades. 3A•3 REFERENCE STANDARD: Unless otherwise noted on the drawings or specified herein, all concrete work shall be performed in accordance with all applicable requirements of ACI 301 "Specifications for Structural Concrete for Buildings ", latest editiaa. One copy shall be kept at the job site at all times. ACI shall be supplemented as follows: . A. Shop Drawings: Only shop drawings for the fabrication and placing of reinforcing steel for structural columns, beams and slabs will be required. • B. Strength: Refer to the notes on the drawings for 28 -day compressive strength requirements. C. Reinforcing Steel: Comply with the requirements of ASTM A615. Provide grade 40 to 60. D. Welded Wire Fabric shall conform to ASTM A185. E. Construction Joints: See drawings. F. Ready -Nixed Concrete: All concrete for this project shall be • ready -mixed concrete in accordance with ASTM C94, except for small miscellaneous amounts mixed in procedure and proportions to obtai -n same consistency as ready -mixed concrete. G. Testing: Concrete testing for this project shall be paid for by the Contractor, and shall consist of compressive tests made by the laboratory in accordance with ASTM C39. Secure samples for test cylinders in accordance with ASTM C31. Slump tests shall be made in accordance with ASTM C143. ., H. Class A tolerance (1 /8" in 10') on floor slabs. 3A.4 CONCRETE FORM WORK: I • • A. Work Included: Provide formwork in accordance with the provisions of this section for all cast -in -place concrete shown on the drawings or required by other sections of these specifications. B. Design of Formmmwork i e Contractor's responsibility. C. Standards: Comply faith all pertinent provisions of ACI 347, latest edition. D. Construct formwork for exposed concrete surfaces with smooth faced undamaged plywood or other panel type materials acceptance to Winn-Dixie to provide continuous, straight, smooth as -cast surfaces. Furnish in largest practicable sizes to aunimize number of joints. E. Provide factory - fabricated, adjustable- length, removable or snapoff metal form ties, designed to prevent form demliition and to prevent spalling concrete surfaces upon removal. F. Forms Coating: Provide commercial formulation form - coating compounds that will not bond with, stain, nor adversely affect concrete surfaces requiring bond or adhesion, nor impeded the wetting of surfaces to be cured with water or curing compound. G. Side forms of footings may be omitted and concrete placed directly against excavation only when requested by the contractor and accepted by Winn - Dixie. When omission of forms is accepted, provide additional concrete one inch on each side of the minimum design profiles and dimensions shown. H. Clean and repair surfaces of forms to be reused in the work. Split, frayed, delaminated or otherwise damaged formfacing material will not be acceptable. Particular care should be taken to pour and finish a LEVEL floor slab for purpose of obtaining proper aligned and plumb merchandise fixtures in place. B. The concrete floor slab shall be an ACI standard finishes with class A tolerances. C. A slab shall be considered as not level if it is 118" or more out in 101. As determined by a 10' straight edge placed anywhere on the slab in any direction. D. Ming -Dixie representative shall decide if floor slab is not level for*the -ir operation. If he decided the floor slab is not acceptable, the slab shall be removed and replaced at no additional cost to Winn -Dixie or Landlord. SECTION 3B CONCRETE FINISHES FOR FLOORS, WALKS AND RAMPS 3B.1 GENERAL: Furnish and apply Plexgard as manufactured by Lambert Corp., 20 North Coburn Avenue, Orlando, Florida 32805, Tel. (305- 841- 2940), to concrete sidewalk full width of the Winn -Dixie Store, and ramps. Color to be Irish Green, or as approved by Winn- Dixie. 3B.2 APPLICATION: • 38.2.1 To insure proper adhesion and maximum durability, the surface imist be thoroughly cleaned of all dust, dirt, grease, oil, wax and loose paint. 3B.2.2 New Concrete Surfaces: Plexgard may be applied shortly after the . concrete surface has received the final finish and is still damp. A light broom finish is required to insure adhesion and slip - resistance. 3B.2.3 Old Concrete surfaces should be etched with a storing solution of muriatic acid. 38.2.4 Plexgard shall be applied in accordance with manufacturer's printed specifications. SECTION 3C CONCRETE HARDENER (FOR INTERIOR EXPOSED FLOORS ONLY) 3C.1 GENERAL: Furnish and apply concrete hardener "Solidus" by Lambert Corp. or "Lapidolith" by Sonneborn BuilLding Products; to interior backroom floors which are to remain exposed. • . 3C.2 APPLICATION: Apply hardener in three (3) coats in strict accordance with manufacturer's printed specifications. The floor slabs must be cured a minimum of 10 days prior to application, DIVISION 4 - MASOHItY SECTION 4A CONCRETE IINITS 4x.1 GE2AL: Furnish all labor, materials and equipment necessary to con- struct all masonry work indicated on the drawings, as specified herein. 4A.2 PRODUCTS: • 4A.2.1 Concrete Masonry Units shall be of matching dimensions and shall include all special shapes and sizes to complete the work as indicated on the drawings. Units shall be free from surface defects that wound be noticeable and objectionable in wall surfaces. 4A.2.2 Types of Units: Hollow regular concrete masonry and split face units shall conform to "Standard Specifications for Hollow Load- Bearing concrete Masonry Units" (ASTM Designation: C -90) except as modified herein. Non - bearing units shall conformm to ASTM Designation C -129. 4A.2.3 Linear shrinkage potential of concrete masonry units. Units shall be delivered to job site in an air -dry condition and the maximum linear shrinkage potential shall be .045, determined by ASTM 426. 4A.2.4 MORTAR: Shall conform to the "Tentative Specifications for mortar for Unit Masonry" (AST: C -270). a. Mortar Type: Required by local building code, but equal to or exceeding the fni I nvi„a+ . . 1. Type M or S for all below grade masonry, bearing walls, and exterior walls. 2. Type S for all non - bearing walls. b. Mortar Color: Shall match mortar color of existing construction. 4A.2.5 JOINT REINFORCEKEN•P: Shall be fabricated from cold drawn steel wire conforming to ASTM A82. Reinforcement shall consist of two No. 9 gauge • deformed longitudinal wires welded at 16 inch intervals to No. 9 gauge cross wires width of reinforcement shall be as required for the width of the wall. Reinforcing shall be placed in all masonry walls at 24" o.c. vertically. • 4A.3 EXECUTION: . 4A.3.1 Handling and storage of Materials : Handle all masonry units carefully, . avoid damage by chipping, breakage or soiling. 4x.3.2 'WORKMANSHIP: A. All masonry walls shall be true and plumb. Where no bond or pattern is indicated, the wall shall be laid in straight uniform courses accurately spaced and with course breaking joints with the course next below. All workmanship shall be of the highest grade. . B. Concrete masonry units shall never be wetted prior to laying the structure. 4A.3.3 MORTAR: A. Machine mix all mortar thoroughly in a mixer designed of this purpose. Keep mortar mixed an tempered on the boards, so it will at all times contain as much water as it is able to carry. B. Time Limit: All mortar shall be used and placed in final position within 2 -1/2 hours after mixing when air temperature is 80 degrees F., or higher, and within 3 -1/2 hours when air temperature is less than 80 degrees F.. 41.3.4 MORTAR JOINTS: A. Standard thickness of mortar joints for both horizontal and vertical joints shall be 3/811. Vertical joints shall be filled to full face -shell thickness and shall be shoved tight.
