RESOLUTION NO.016-15-14355 A Resolution for Special Use Approval to permit a general restaurant at 5701 Sunset Drive,Shops at Sunset Place,Unit C11C,within the Specialty Retail "SR",Hometown District Overlay "HD-OV". WHEREAS,pursuant to Section 20-3.4(B)(4)(b)of the Land Development Code (LDC), theapplicant,PasionDel Cielo CoffeeCompany,submitted Application No.PB-15-001 tothe Planning Board requesting aSpecialUseApprovaltooperateageneral restaurant locatedat 5701SunsetDrive,ShopsatSunsetPlaceUnit C11C,within the Specialty Retail "SR", Hometown District Overlay "HD-OV"zoning district;and WHEREAS,the applicant proposes totake over a portion of an existing vacant space fronting the interior street,Banyan Court;and WHEREAS,restaurants are permitted asa special use within the Specialty Retail "SR", Hometown District Overlay "HD-OV"zoning district andis subject to meeting general conditions specified inLDC Section 20-5.8 and subject to meeting special use requirements set forth in LDC Section 20-3.4(B)(4)(b);and WHEREAS,the applicant's restaurant special use meets the special use requirements set forthinLDC Section 20-3.4(B)(4)(b)which are i.All such establishments shall provide only inside or patio service on private property.Public streets,rights-of-way,sidewalks and required setbacks may not be used for patio or street-side services of anykind. ii.No services of a drive-in or of afastfood nature shallbe permitted. iii.Thecity commission shallreviewand recommend approval,disapproval or modification of allsiteplansand project specifications forthis special use permit;and WHEREAS,the approval of aspecialuserequiresa recommendation fromthe Planning Boardandtheapproval of theCityCommissionafterapublichearing;and WHEREAS,atthe January 13,2015PlanningBoard meeting,andfollowingapublic hearing,theBoardreviewedApplication PB-15-001 andvoted6ayes,0naystorecommended approval of the request fora special useto operate a restaurant;and WHEREAS,theCityCommissiondesirestoaccepttherecommendation of thePlanning Board. Section 2.Severability.If any section clause,sentence,or phrase of this resolution isfor any reason held invalid or unconstitutional bya court of competent jurisdiction,the holding shall not affect the validity of the remaining portions of this resolution. Therequestedspecialusecomplieswiththe LDC requirementssetforthforspecialusesin Section20-3.4andthe proposed usemeetstheconditionalrequirementssetforthin Section 20-5.8 in that the use: a)Willnotadverselyaffectthehealthorsafetyofpersonsresidingor working in thevicinityoftheproposeduse, b)Will notbedetrimentaltothepublicwelfareorpropertyor improvements in the neighborhood;and, c)ComplieswithallotherapplicableCodeprovisions.
