Ord No 06-15-2213ORDINANCE NO.06-1 5-221 3 An Ordinance amending Section 15-91 of the Code of Ordinance of the City of South Miami is hereby amended in pertinent part to reference Sections 7- 15 and 7-16 concerning construction operations in place of specific limitations on hours of operation. WHEREAS,sections 7-15 and 7-16 of theCity of South Miami Code of Ordinances alreadyprovidesforlimitationsondays of theweekandhours of thedaywhenconstruction operations are allowed;and WHEREAS,the Mayor andthe City Commission desire to consolidate the limitation on construction activities. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section1.Section 15-91 of theCodeofOrdinanceoftheCity of SouthMiamiishereby amended in pertinent part toreadasfollows: Sec.15-91.-Pile-drivers,steamshovels,pneumatic hammers,etc. Itshallbeunlawfulforanypersoninconductingtoconductanybuildingoperationsin violation of section 7-15 and section 7-16 of the City of South Miami Code of Ordinances,on Mondays—Fridays betweenthehours of 6:00p.m.and7:00a.m., Saturdays before9:00a.m.andafter5:00p.m.,andalldayonSundays,tooperateoruse anypiledriver,steam shovel,pneumatic hammer,derrick,steam or electric hoist orother apparatus,theuseofwhichisattendedbyloudorunusualnoise,exceptbywritten permission of thecitymanager,andthenonlyincase of emergency. Section 2.Codification.The provisions of this ordinance shall become andbemade part of theCode of Ordinances of theCity of SouthMiamias amended;thatthe sections of this ordinancemayberenumberedorre-letteredtoaccomplishsuchintention;andthattheword "ordinance"maybechangedto"section"orotherappropriateword. Section3.Severability.If anysection,clause,sentence,orphrase of thisordinanceis for any reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shallnotaffectthevalidity of theremainingportions of thisordinance. Section4.Ordinances inConflict.Allordinancesorparts of ordinancesandall sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. However,itisnottheintentofthis section to repeal entire ordinances,orpartsof ordinances, thatgivetheappearance of beinginconflictwhenthetwo ordinances canbe harmonized or whenonlyaportion of theordinanceinconflictneedstoberepealedtoharmonizethe ordinances.Ifthe ordinance in conflict canbe harmonized by amending its terms,itis hereby amended to harmonize the two ordinances.Therefore,only that portion that needs tobe repealed toharmonizethetwoordinancesshallbe repealed.
