An Ordinance amending Section 7-15.2(g)of the Code of Ordinance of the
City of South Miami in pertinent part to provide for Commission approved
change in demolition days and hours of operation.
WHEREAS,fromtimetotimea project thatwillbenefittheCity of SouthMiamimay,
duetoextraordinary circumstances requireworktobeperformedonSundaysandearlierthan
9:00 a.m.on Saturdays and
WHEREAS,the Mayor andtheCity Commission desireto provide formore flexibility
under extraordinary circumstances for changing thedaysand hours of permissible work.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Section 7-15.2 (g)of the Code of Ordinance of the City of South Miami is
hereby amended in pertinent part to read as follows:
Sec.7-15.2.-Demolition requirement standards.

(g)All demolition sitesi shall comply with thecity's noise code^Ddemolition activity
is limited between tothehours from 7:00a.m.through 6:00 p.m.?on weekdays from
Monday feu through Friday,and between the hours of 9:00a.m.through 5:00p.m.on
Saturday hours shallbefrom9:00a.m.to5:00p.m.No demolition activity is permitted
onSunday.Notwithstanding theabove,no demolition shalltakeplace in,or within 500
feet of,residentially zoned districts,other than those in the Hometown District,on either
Saturday or Sunday and,as to demolition work in non-residentially zoned districts and in
the Hometown District,all days of the week and hours may be changed by resolution of
theCity Commission upon a finding of extraordinary circumstances.
Section 2.Codification.The provisions of this ordinance shall become andbemade
part of theCode of Ordinances of theCity of SouthMiamiasamended;thatthe sections of this
ordinancemayberenumberedorre-letteredtoaccomplishsuchintention;andthattheword
"ordinance"maybechangedto"section"orotherappropriateword.
Section 3.Severability.If anysection,clause,sentence,orphrase of thisordinanceis
foranyreasonheldinvalidor unconstitutional byacourtofcompetentjurisdiction,thisholding
shallnotaffectthevalidity of theremainingportions of thisordinance.
Section 4.Ordinances in Conflict.Allordinancesorparts of ordinancesandall
sections andpartsofsectionsof ordinances indirectconflictherewitharehereby repealed.
However,itisnottheintent of thissectiontorepealentireordinances,orparts of ordinances,
thatgivethe appearance of being in conflict when thetwo ordinances canbe harmonized or
whenonlyaportion of theordinanceinconflictneedstoberepealedtoharmonizethe
ordinances.Ifthe ordinance in conflict canbe harmonized by amending its terms,itis hereby
amended to harmonize thetwo ordinances.Therefore,onlythatportionthatneedstobe repealed
toharmonizethetwoordinancesshallberepealed.
Section5.EffectiveDate.Thisordinanceshallbecome effective upon enactment.
