A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,DECLARING A WEATHER
EMERGENCY PURSUANT TO SECTIONS 14.05 AND 14.12 OF
ORDINANCE NO.11-93-1539;GIVING THE CITY MANAGER THE
NECESSARY AUTHORITY AND DIRECTING HER TO TAKE ALL
NECESSARY AND APPROPRIATE ACTIONS TO PREPARE FOR AND
RESPOND TO HURRICANE FRANCES;PROVIDING AN EFFECTIVE
DATE.
WHEREAS,pursuant toits municipal homerule powers to prepare forand respond to
weather and other emergencies,the Mayor andCity Commission of the City of South Miami
enacted Ordinance no.11-93-1539,entitled "Emergency Management;"and
WHEREAS,the Emergency Management ordinance provides forthe City Manager or
her designee to recommend a declaration of a weather emergency pursuant to sections 14.05 and
14.12,and upon such declaration,to exercise powers relating to evacuation;curfew and
designation of restricted areas;suspension or regulation of thesale of alcoholic beverages,
ammunition,firearms,explosives and combustibles;prohibition on price gouging;water use
restrictions;suspension of local building regulations;regulation of theuseand rationing of fuel,
iceand other essential goods;and emergency procurement procedures;and
WHEREAS,theState of FloridaremainsunderaState of Emergency declared bythe
Governor prior to Hurricane Charlie,and Hurricane Frances,on September 2,2004,was
classified asa category IV hurricane,prompting the National Hurricane Center toposta
hurricane warning forthe entire east coast of theState of Florida;and
WHEREAS,the Mayor andCity Commission believe itis necessary to declare a weather
emergency andto organize all available Cityresourcesto prepare for,respond toand recover
fromall threats tothe security,safety andhealth of thepeople of South Miami.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT
Section 1.A weather emergency resultingfromthe threat of imminent damage from
Hurricane Frances is declared to exist as of this date.
Section 2.TheCityManagerisauthorizedanddirectedtoexerciseallnecessaryand
appropriatepowersunderOrdinanceno.11-93-1539 toaccomplishemergencymanagement
duringthe duration of this emergency.TheCity Manager shall report tothe commission atits
nextregularlyscheduledmeeting,unlessaspecialmeetingiscalledearlier,a preliminary
assessment of thedamagecausedbythehurricane,allactionstakeninresponsetothe
emergency,theeffectiveness of theemergencymanagementstructure,the estimated cost of the
response,furtheractionswhichmayberequired,contractswhichmustbe reviewed andratified
bythecommissionandanyemergencybudgetappropriationswhichmayberequested.

Section 3.This declaration of emergency shallbe effective immediately andremain
in effect untilthenext meeting of the commission,whichisnow scheduled for September 21,
2004,unless itis terminated earlier bythe commission or by certification of the City Manager or
her designee.
Section 4.This resolution shalltake effect immediately upon approval.

RESOLUTION
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,DECLARING A WEATHER
EMERGENCY PURSUANT TO SECTIONS 14.05 AND 14.12OF

BACKGROUND AND ANALYSIS
On September 2,2004,Hurricane Frances was classified as a category IV hurricane and the
NationalHurricaneCenterdeclaredahurricanewarningfortheentireeasterncoast of theState
of Florida.TheState of FloridaremainedunderaState of EmergencydeclaredbytheGovernor
priortoHurricaneCharlie
The City's Emergency Management ordinance provides for the City Manager to recommend a
declaration ofa weather emergency pursuant to sections 14.05 and 14.12,and upon such
declaration,to exercise powers relating to the protection ofthe City andits residents,including
evacuation;suspension of local building regulations;regulation ofthe use and rationing of fuel,
iceandotheressentialgoods;and emergency procurement procedures.
Considering the threat that this hurricane presented to the City of South Miami,the City Manager
felt it prudent to exercise the provisions of the Emergency Management ordinance and
recommends thatthe Commission declare a weather emergency beginning on September 2".

BEACH...INCLUDING LAKE OKEECHOBEE.
AT 11 AM AST...1500Z...A TROPICAL STORM WARNING AND A HURRICANE
WATCH ARE IN EFFECT FOR THE MIDDLE AND UPPER FLORIDA KEYS FROM
SOUTH OF FLORIDA CITY TO THE SEVEN MILE BRIDGE INCLUDING FLORIDA
BAY.
A HURRICANE WARNING REMAINS IN EFFECT FOR THE ALL THE BAHAMAS.
AT 11 AM AST...AST THE HURRICANE WARNING FOR THE TURKS AND CAICOS
ISLANDS HAS BEEN DISCONTINUED.
A HURRICANE WARNING MEANS THAT HURRICANE CONDITIONS ARE EXPECTED
WITHIN THE WARNING AREA WITHIN THE NEXT 24 HOURS.PREPARATIONS TO
PROTECT LIFE AND PROPERTY SHOULD BE RUSHED TO COMPLETION.

LATITUDE 23.4 NORTH...LONGITUDE 73.9 WEST OR ABOUT 55 MILES...90
KM...SOUTHEAST OF SAN SALVADOR...AND 450 MILES...725 KM...EAST-
SOUTHEAST OF THE LOWER FLORIDA EAST COAST.
FRANCES IS MOVING TOWARD THE WEST-NORTHWEST NEAR 13 MPH...20 KM/HR.
THIS GENERAL MOTION WITH A TURN TO THE NORTHWEST AND A DECREASE IN
FORWARD SPEED IS EXPECTED DURING THE NEXT 24 HOURS.ON THIS
TRACK...THE CORE OF HURRICANE FRANCES WILL BE MOVING NEAR OR OVER
THE CENTRAL BAHAMAS THIS AFTERNOON AND EVENING.
FRANCES REMAINS A DANGEROUS CATEGORY FOUR HURRICANE ON THE
SAFFIR-SIMPSON HURRICANE SCALE WITH MAXIMUM SUSTAINED WINDS NEAR

INTENSITY ARE EXPECTED DURING THE NEXT 24 HOURS.
