No. 145-04-11924RESOLUTION NO.145-04-11924 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,DECLARING A WEATHER EMERGENCY PURSUANT TO SECTIONS 14.05 AND 14.12 OF ORDINANCE NO.11-93-1539;GIVING THE CITY MANAGER THE NECESSARY AUTHORITY AND DIRECTING HER TO TAKE ALL NECESSARY AND APPROPRIATE ACTIONS TO PREPARE FOR AND RESPOND TO HURRICANE IVAN;PROVIDING AN EFFECTIVE DATE. WHEREAS,pursuanttoits municipal homerulepowerstoprepareforandrespondto weatherandother emergencies,theMayorandCityCommission of theCityofSouthMiami enacted Ordinance no.11-93-1539,entitled "Emergency Management;"and WHEREAS,theEmergencyManagementordinanceprovidesfortheCityManageror herdesigneetorecommenda declaration ofaweather emergency pursuanttosections 14.05 and 14.12,anduponsuchdeclaration,toexercisepowersrelatingtoevacuation;curfewand designation of restrictedareas;suspensionorregulation of thesale of alcoholicbeverages, ammunition,firearms,explosivesandcombustibles;prohibitiononpricegouging;wateruse restrictions;suspension of localbuilding regulations;regulation of theuseandrationing of fuel, iceandotheressentialgoods;andemergencyprocurementprocedures;and WHEREAS,Hurricane Ivan,onorabout September 8,2004,was classified asa categoryVhurricaneandtheState of FloridaremainedunderadeclaredState of Emergency; and WHEREAS,theMayorandCityCommissionbelieveitisnecessarytodeclareaweather emergency andtoorganizeall available City resources topreparefor,respondtoandrecover fromallthreatstothesecurity,safetyandhealth of thepeople of SouthMiami. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT Section 1.A weather emergencyresultingfromthethreat of imminent damagefrom Hurricane Ivan is declared to exist as of this date. Section 2.TheCityManagerisauthorizedanddirectedtoexerciseallnecessaryand appropriatepowersunderOrdinanceno.11-93-1539 toaccomplishemergencymanagement duringtheduration of thisemergency.TheCityManagershallreporttothecommissionatits nextregularlyscheduledmeeting,unlessaspecialmeetingiscalledearlier,apreliminary assessment of the damage caused bythehurricane,all actions taken in response tothe emergency,theeffectiveness of theemergencymanagementstructure,theestimatedcost of the response,furtheractionswhichmayberequired,contractswhichmustbereviewedandratified bythe commission andany emergency budgetappropriationswhichmayberequested. BACKGROUND AND ANALYSIS This isthe same situation,buta more powerful storm,we faced withthe approach of Hurricane Francis.On or about September 8,2004,Hurricane Ivan was classified asa category V hurricane and the State of Florida remained under a State of Emergency. The City's Emergency Management ordinance provides for the City Manager to recommend a declaration ofa weather emergency pursuant to sections 14.05 and 14.12,and upon such declaration,to exercise powers relating to the protection of the City and its residents,including evacuation;suspension of local building regulations;regulation of the use and rationing of fuel, iceandotheressential goods;and emergency procurement procedures. Considering the threat that this hurricane presented to the City of South Miami,the City Manager felt it prudent to exercise the provisions of the Emergency Management ordinance and recommends that the Commission declare a weather emergency beginning on September 8l. RECOMMENDA TION Yourapprovalisrecommended.
