WHEREAS,Said Almukhtar hassubmittedanapplicationforaspecialusetoallow "Natural
Chicken Grill",ageneral restaurant tolocateinthe "SR(HD-OV)"Specialty Retail Hometown District
Overlay zoning district specifically locatedat5850SunsetDrive;and
WHEREAS,ageneralrestaurantisallowedasaspecialuseinthe "SR(HD-OV)"SpecialtyRetail
HometownDistrictOverlayzoningdistrictsubjecttomeetinggeneral conditions specified inLDC
Section20-5.8and subject to meeting special requirements setforthinLDC Section 20-3.4(B)(4)(b);and
WHEREAS,theapproval of aspecialuserequiresarecommendationfromthePlanningBoard
andthe approval of theCity Commission afterapublichearing;and
WHEREAS,onJune 15,2004thePlanningBoard,afterpublichearing,voted5ayesand0nays
to recommend approval with conditions of thespecialuserequest;and
WHEREAS,theMayorandCityCommission of theCity of SouthMiamidesiretoacceptthe
recommendation of the Planning Board.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA:
Section1:That an application forspecialusetoallowthegeneral restaurant,"Natural Chicken Grill"to
locate inthe "SR(HD-OV)"Specialty Retail Hometown District Overlay zoningdistrict specifically
locatedat5850SunsetDriveisherebyapprovedsubjecttothefollowingconditions:
(1)The restaurant shall install a refrigerated garbage storage facility tobeusedpriortoroutine
garbage pick-up;
(2)The applicant shall provide afloorplanforthe restaurant interior tobe submitted
prior tothe application being forwarded totheCity Commission;

(3)Ifthe subject general restaurant is.inthe future,determined bythe Director of Planning to
be adversely affecting thehealthor safety of persons residing or working in the vicinity of the
proposed use.tobe detrimental tothepublic welfare or property or improvements inthe
neighborhood,ortobenotincompliancewithotherapplicableCodeprovisions,thespecialuse
approval maybe modified orrevokedbytheCity Commission upon notification andpublic
hearing."
Section2:This resolution shallbe effective immediately after the adoption hereof.

APPLICANT'S REQUEST:
Pursuant to section 20-3.4(B)(4)(b)of theLand Development Code (LDC),the applicant is requesting a
Special Use Approval to operate a general restaurant attheabove referenced location.The proposed use
is located in the "SR(HD)'\Specialty Retail Hometown Overlay Zoning District.A general restaurant is
permitted withSpecialUse Approval.The proposed usemust meet the requirements forspecialuses
contained under Section 20-3.4(B)(4)(b)General Restaurant and Section 20-5.8 Special Use Approval of
the LDC.A general restaurant shall mean an establishment where the principal business is the sale of food
and beverages tothe customer ina ready-to-consume stateand where the design shall provide a sit-down
area for the customers.
STAFF ANALYSIS:
The applicant is requesting a special use permit tooperate Natural Chicken Grillin part of theground
floor of anexistingtwostory building locatedat5850SunsetDrive.Thefirstfloorwaspreviously
operated asa restaurant called Koo Koo Roo.Thespacehasbeen vacant forthe past twoyears.The
restaurantwilloccupy2000sq.ft.orapproximatelyhalf of thegroundfloor.Itisimportanttonotethat
theHometown Overlay Zoning District RegulatingPlan(map)designates this building asa "contributive
building"(havinghistoric/architecturalmerit),andthereforeitisexemptfromprovidingrequired
parkingspaces.(LDCSection20-7.6(C)(3))
DuringdiscussionatthePlanningBoarditwasnotedthattheLDCspecifiesinSection20-3.4(B)(4)(d)
thatarestaurantinthe "SR"districtmayonlyoccupyamaximum of 25%of thegroundfloorarea of the
building.Staff wasrequestedasacondition of theapprovaltofurtherreviewtheapplicability of this
provisiontotheproposedspecialuse.Itwasdeterminedthatthisprovisionwhichappearsinthespecial
usesection of the Code wasnot applicable inthe Hometown Overlay District.The Hometown District

Overlayhasaseparatelist of permittedusesanditpermitsgeneralrestaurants,however,asquarefootage
maximumisnotrequired.Intheevent of aconflictbetweenanunderlyingzonedistrictregulation(SR)
andtheHometownOverlayDistrict,theHometownOverlayDistrictRegulationssupercedesandis
controlling (LDC Section 20-7.2(B).
SPECIAL CONDITIONS APPLICABLE:
TheLDCprovidesthatspecialusesmustbeapprovedbytheCityCommissionafterapublichearingand
receipt of a recommendation fromthePlanningBoard.Theoverallpurposeistodeterminethe
compatibility of theproposedusewiththesurroundingneighborhood.Aspecialusemustcomplywith
the conditions set forth in Section 20-5.8(B)in that theuse:
a)Will notadverselyaffectthehealthorsafetyofpersonsresidingorworkinginthevicinity of
the proposed use,
b)Willnotbedetrimentaltothepublicwelfareorpropertyorimprovementsinthe
neighborhood;and,
(c)Complies withall other applicable Code provisions.
Inaddition,specialusesmayalsoberequiredtocomplywithsupplementalrequirements,whichareset
forthinSection20-3.4(B)(4)(b).Inthecaseofageneralrestaurantthefollowingrequirementsarelisted:
(i)Allsuchestablishmentsshallprovideonlyinsideorpatioserviceonprivateproperty.Public
streets,rights-of-way,sidewalksand required setbacksmaynotbeusedforpatioorstreet-
sideservices of anykind.Aseparateapplicationforoutdoorseatingwouldberequired.
(ii)No services of adrive-inor of afastfoodnatureshallbepermitted.
(iii)Thecity commission shallreviewandrecommendapproval,disapprovalormodification of
allsiteplansandprojectspecificationsforthisspecialusepermit.
PLANNING BOARD ACTION
ThePlanningBoardatitsJune 15,2004 meeting,adopted amotionbya6aye0nayvotetoapprovethe
specialuse request subject tothe following conditions:
(1)Theapplicantshallprovideafloorplanfortherestaurantinteriortobesubmittedpriortothe
application being forwarded totheCity Commission;
(2)The restaurant shall install a refrigerated garbage storage facility tobeusedpriorto routine
garbage pick-up;
(3)Ifthe subject general restaurant is,in the future,determined bythe Director of Planning tobe
adversely affecting the health or safety of persons residing or working inthe vicinity ofthe
proposed use,tobe detrimental tothe public welfare or property or improvements inthe
neighborhood,ortobe not in compliance with other applicable Code provisions,the special
use approval maybe modified or revoked bytheCity Commission upon notification and
public hearing.

RECOMMENDATION
The requested special use complies withtheLDC requirements setforthfor special usesin Section 20-3.4
andthe conditional use requirements setforthinSection20-5.8.Approval of the application withthe
following conditions is recommended:
(1)The applicant shallprovideafloorplanfortherestaurantinteriortobesubmittedpriortothe
application being forwarded totheCity Commission;
(2)Therestaurantshallinstallarefrigeratedgarbagestoragefacilitytobeusedpriortoroutine
