A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO AN
APPEAL FROM A DECISION OF THE ENVIRONMENTAL
REVIEW AND PRESERVATION BOARD REGARDING THE
APPROVAL OF A SITE PLAN AND FOUR STORY BUILDING
LOCATED AT 6141 SUNSET DRIVE
WHEREAS,theEnvironmentalReviewandPreservationBoard(ERPB)atitsDecember
16,2003meetingreviewedApplicationNo.ERPB-03-068andapprovedaproposedsiteplan
and building designforafourstoryofficebuildingtobeconstructedonavacanttractlocatedat
6141 Sunset Drive;and
WHEREAS,theERPBdecisiondidnotstipulateconditionsrelatedtothe preservation or
relocation of the 39 trees located onthesite;and
WHEREAS,theLandDevelopmentCodeassignstotheERPBthe authority toreview,
modifyandapprove landscape elements of asiteplan including theauthoritytoregulatethe
relocation andorthe removal of existing trees;and
WHEREAS,Section20-6.2(A)of theLandDevelopmentCodeallowsforanappeal of an
ERPBdecisiontobe made totheCityCommissionbytheapplicant,interested citizens,orthe
City administration;and
WHEREAS,onJanuary30,2004theCityAdministrationappealedtheERPBapproval
action forthissite stating thatthe decision shouldbe modified to include relocation or
replacement of the existing trees onthe site which are designated for removal.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That theappealtothe decision of the Environmental Review and Preservation
Board of December 16,2003,regarding thesiteplanforanew office building at 6141 Sunset
Drive is hereby remanded back totheERPBwitha request thatthe Board modify its decision to
include specific actions regarding theremoval,relocation,or replacement of the existing onsite
treesand directing the City Manager toworkwiththeapplicant.
Section 2.This resolution shall be effective immediately after the adoption

BACKGROUND
InOctober,2003SunsetDevelopment,LLCfiledanapplicationwiththeEnvironmentalReviewand
PreservationBoard(ERPB)forsiteplanandbuildingdesignapprovalfortheconstruction of a4story
medicalofficebuildingtobelocatedona.7acreheavilywoodedvacanttract of landat 6141 SunsetDrive.
After review and minor modifications,theERPBatits December 16,2003 meeting,gavefinalapproval of
the application.TheBoarddidnot stipulate any conditions related tothe preservation or relocation ofthe39
trees located on the site.
Itisimportanttonotethattheplansofa previous developer ofthissite(Gold'sGym)in 2001 wouldhave
requiredthe removal ofalltreesonthesite.That developer wasintheprocessofnegotiatinga contribution
totheSouthMiamiTreeTrustFundinlieu of preservingorrelocatingtreeswhentheentireprojectwas
abandoned.ThedonationprocedureisallowedbyaprovisioninthelandscapingregulationintheLand
DevelopmentCode.Itisgenerallyusedasalast resort,whenremovalorrelocationisnotfeasible.
CURRENT SITUATION
TheLand Development Codeassignstheauthoritytoreview,modifyandapprovelandscapeelements of a
siteplantotheERPB.ThisisthereasonforarecentamendmenttotheERPBmembershipsection
mandatingaprofessionallandscapearchitecturalpositionontheBoard.Aspart of itslandscapereview
authoritytheBoardcanregulatetherelocationandortheremoval of existingtrees.Theactualtreeremoval
processrequiresapermitissuedbythePlanningDepartment.Theappropriateissuance of thistype of permit
administratively isgreatly enhanced if thereare recommendations or guidelines fromtheERPB.

In January,2004 the new developer ofthe 6141 Sunset Drive site approached the Planning Department
concerning a tree permit to remove 29ofthe39 existing trees onthe site.Inthatthe ERPB did not address
the issue oftree removal,the Acting Planning Director advised theCity Manager ofthe situation and
suggested thatthe ERPB decision shouldbe appealed.
The City Manager on January 30,2004 appealed the ERPB approval action forthissite stating thatthe
decisionshouldbemodifiedtoincluderelocationorreplacementoftheexistingtreesonthesitewhichare
designated for removal.The appeal stays any development from proceeding onthe site.
RECOMMENDATION;
Itis recommended thattheCity Commission approve the appeal andremandthe application backtothe
ERPB for specific action regarding the removal/relocation ofthe existing onsite trees.

BACKGROUND &STAFF ANALYSIS:
Theapplicant first appeared beforetheERPBonNovember4,2003andreturnedon
November 18,2003 and was deferred on both instances.On the ERPB meeting of
December 2,2003 the applicant received preliminary approval.The board's only
exceptionwasthat the north wall tothe garage be 36"between the columns to obscure
the parking but to allow the light to come in,as well as,allow air to flow through.At this
time,the plans have been resubmitted forfinalreview.
The applicant is proposing to build a four-story professional medical office building.The
irregular shaped property hasan area of 31,134 sf.or 0.71 acres.The site is currently a
vacant lot andthe zoning classification isthe Transit Oriented Development District
(TODD MU-4/MU-5),in which a medical office useis permitted by right.Please refer to
the ZoningLegendforadditional information,sheet A-1.
Due to the ERPB reviews and comments,the corner building has improved significantly.
Atthis time,the applicant seeks final approval ofthe site plan and building desian
from the ERPB.
RECOMMENDATION:Final Approval,with the following conditions:
