APPLICABLE REGULATIONS (See ATTACHMENT) •Land Development Code Section 20-3.5(C )(1)Dimensional Requirement Tables •Land Development Code Section 20-3 .5(E)Dimensional Requirements .Jtyc •Land Development Code Section 20-5.9 Variances Approvals J(^l q -T y^ BACKGROUND &ANALYSIS It is important to note that the current setback standard for second stories in residential zones was amended bythe City Commission in September of 2003,aspartofalot overcrowding concern expressed by many residents.The resulting ordinance changed the dimensional requirements for all single family zones by mandating that the second story ofa home mustbe setback ontheside yard further thanthefirst floor.IntheRS-3,Single family use district,the side interior setback for the first floor is 7.5 feet;the setback for the second story is15feet. March 2,2004 Page2 of3 i VV In October,2001 the applicant submitted plans for a building permit to remodel the f <existing 1835 sq ft structure by constructing a two story addition (total of 1558 sq.ft.)on thewestside of thehome.Theapplicanthasstatedthattheplanssubmittedmetallofthe required side setbacks (7.5 feet)existing atthat time.The applicant failed to respond to comments madebypermitreview officers foranextendedperiod(over2years)andin accordancewiththeFloridaBuildingCode,theBuildingDepartmentvoidedthepermit application. In November,2003the applicant re-submitted thesameplansincludingthetwostory addition.Thesubmittedplansshowthewestsidesetbacktobe7.5feetforboththe ground floor and second story addition.Based uponthe current dimensional requirements adopted bytheCity Commission on September 2,2003,the second story setback mustbe 15feettherebyresultinginthe applicant's varianceapplication. Inadditionthetotalsquarefootageofthesecondfloormustnotexceed60%of the ground floor square footage.Thesizeofthe applicant's second story,779 square feet,is belowthemaximumallowedsquare footage.Theapplicantcomplieswiththesecond story limitation. STAFF OBSERVATIONS •Thepermit application submittedin November,2003 is considered anew application requiringadherencetocurrentLDCdimensionalstandards. •The application statesthatthe hardship involved isaresultoftheCityadjustingthe setback requirements aftertheir submission ofthe original permit application,which wasvoided.Theapplicant'sclaimofhardshiphasbeenbroughtaboutbyactionsof the applicant /propertyownerinthattheownerfailedtoimplementthepermit received in 2001. •Thepropertyislocatedina residential areawhereallofthe surrounding homesare one story.Theadditionofthepartial second storyasshown,woulddetractfromthe architecture of thebuildingandwouldhaveanadverseimpactontheneighboring property owners. •The proposed variance,if granted,would confer onthe applicant a special statusnot beingmade available toother properties inthe immediate vicinity. A RESOLUTION OF THE MAYOR &CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO A REQUEST FOR A VARIANCE FROM SECTION 20-3.5(E)OF THE LAND DEVELOPMENT CODE TO ALLOW THE SECOND STORY INTERIOR SIDE SETBACK OF A BUILDING TO BE 7.5 FEET,WHERE A MINIMUM OF 15 FEET IS REQUIRED ON PROPERTY WITHIN AN "RS-3"SINGLE-FAMILY RESIDENTIAL USE DISTRICT,LOCATED AT 6023 SW 61 SREET,SOUTH MIAMI,FLORIDA,AND LEGALLY DESCRIBED AS LOT 28,BLOCK 1, "CAMBRIDGE LAWNS PARK"PLAT BOOK 50,PAGE 4;AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS,Application No.PB-03-024 was submitted tothe Planning Board bythe applicantGertrudisDelSol,saidapplicationrequestingapprovalforavariancefromSection20- 3.5(e)of theLand Development Codetoallowthesecondstory interior side setback of a building tobe7.5feet,where a minimum of 15feetis required on property within an "RS-3"Single- Family Residential use district,located at6023SW61 Street,and legally described asLot28, Block1,"Cambridge Lawns Park"PlatBook50,Page4;and WHEREAS,the City Commission atits September 2,2003 meeting,in response to concerns about lot overcrowding,adopted Ordinance No.17-03-1810A which amended Section 20-3.5(E)pertaining to setback requirements forthesecondfloor of residential structures;and WHEREAS,the applicant in November,2003 submitted plans to make atwostory addition toa single family residence with a setback of 7.5feetfor both the ground floor and second floor;and WHEREAS,the applicant's original building permit application submitted in October, 2001hasexpiredandnew dimensional zoning requirements arenowineffect,thereby requiring the submission of a variance request;and, WHEREAS,the approval of a variance requires a recommendation fromthe Planning Boardandthe approval of theCity Commission aftera public hearing;and WHEREAS,on January 13,2004thePlanningBoard,after public hearing,adopted a motion byavote of 6ayes0naysto recommend denial of the variance request. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1:Thatthe subject application submitted byAlfonsoand Charlotte?Poroz requesting avariancefrom Section 20-3.5(e)of theLand Development Codeto allow the second story interior side setback of a building tobe7.5feet,wherea minimum of 15feetis required on property within an "RS-3"Single-Family Residential use district,located at6023SW61Street, andlegallydescribedasLot28,Block 1."CambridgeLawnsPark"PlatBook50,Page4,is hereby denied.
