BACKGROUND &ANALYSIS Since June of 2001,the Police Department hashad wireless technology to access the State and National Criminal Information Network.Thisisakeyfeature of the MDT (Mobile Data Terminal)project.The hardware requirements forthe wireless service areone frame relay,one router,wireless air cards for each terminal,and one server. The Police Department hasbeen approached bythreelaw enforcement agencies requesting to share theuse of theframerelayandtheuse of the server being usedto operate their MDT's. TheseagenciesareMiamiShoresPoliceDepartment,Virginia Gardens Police Department and Miccosukee Police Department.These threeagencies currently use AT&T wireless for their services;however,theydonothaveaframerelay.Theyare currently utilizing IndianRiver County Sheriffs'Department frame relay service andserver.Effective November 2003,Indian River County Sheriffs'Department changed their wireless service provider and these other agencies need to either change carriers or purchase aframerelay and server. There isnocosttoourcityfor other agencies touseourframerelayandserver.However,there wouldbeamonthlychargetomaintainandsupporttheframerelayandserverforeachagency. This charge is based oneach agency's number of unitIPaddresses. The suggested charge for maintenance and support is based onthenewmonthly charges that the police department will incur after the upgrade to the next generation of wireless technology from AT&T. The funds that are obtained from the charges to these three Police Departments would be placed intoan account tobeusedsolelyto repair,maintain,replace and purchase equipment for the MDT Project within the Police Department.The benefits of this agreement wouldbea savings of $510 monthly,whichwouldnormallycome from the Operating Equipment account of the Police Department. I.AGENCY REQUIREMENTS: 1.AbidebyallprovisionsofthestandardFloridaDepartment of Law Enforcement (F.D.L.E.)CriminalJusticeUser Agreement (current andfuture revisions)that areapplicabletoaccess,andaffirmthroughexecution of thisagreementtoabide byall terms and conditions of the same. 2.ObtainandprovidetherequiredLawEnforcementAgency ORI and Neumonic IdentifierforeachIPaddressrequestingaccesstothesystem. 3.Provide hardware andsoftware(clientand server)and wireless data communications compatiblewiththePolice Department's Aether/Cerulean Mobile Data System. 4.ProvideanagencyapprovedlistingofLawEnforcementpersonnelusinglegal names andsocial security numbers for account access. 5.Appointandsupplyasinglepointofcontactfortheagencywiththename,rank, telephone number,facsimile number and e-mail address (where possible). II.ACCEPTABLE USE: 1.Utilization ofauser account mustbein support oflaw enforcement,associated research and administrative functions and must be consistent withthe objectives of a law enforcementagency. 2.Use of other organization's networks or computer resources must comply with the rulesappropriateforthatnetworkor system.Inclusive of thoserulesestablished byFDLEfor operation andaccesstotheir systems. Publication,ownership or transmission of any material in violation of any U.S. stateorlocalregulationisprohibited.Thisincludes,butisnotlimitedto copyrighted material,threatening or obscene material or material protected by trade secret. 4.All communications and information accessible via the network should be consideredprivateproperty. Use ofthe network for product advertising or political lobbying is prohibited. 6.Illegal activities are strictly prohibited and will be investigated and prosecuted to the fullest extent of the law. All communication must use appropriate language,bepoliteand business related. Theuse of profanity,vulgarities,andracial/ethnicstatementsor harassment of other usersisprohibited. 8.Electronicmailisnotprivateandcanbereviewedwithoutnotificationtotheuser. Any userofthe e-mail system for the purpose of supporting illegal activities will beinvestigatedandprosecuted. II.PRIVILEGE:The use ofthe Police Department computer system and network isa privilege.Inappropriate use can result in cancellation of those privileges.Based upon the acceptable use guidelines outlined in this agreement,the system administrator will deem what is inappropriate use of the network and take appropriate actions. 1.All usersare expected toabidebythetermsand conditions above.If the perspective users cannot abide by anyorall of the term and conditions setforthin thisdocument,thentheywillbeadvisedto acquire accessthroughan alternative information management source. 2.Thesystem administrator(s)will terminate any account,as required,for any violation of this agreement. 3.Electronicmailinthe Aether/Cerulean PacketCluster Patrol systemhasno expectation of privacy andmaybe reviewed without notification totheuser. III.SECURITY -Securityonany computer systemisahigh priority. 1.Ifyou feel you can identifya security problem onthe Police Department network you must notify SouthMiamiPoliceDepartment's system administratororsend e-mail to bednev@citvofsouthmiami.net. 2.Donotdemonstratetheproblemtootherusers. 3.Users may not,underanycircumstances,useanother individual's account. 4.Donotgiveyourpasswordtoanyotherindividual. 5.Attemptstologintothe system as any other user may result in suspension or termination of userprivileges. 6.Attemptstologintothesystemornetworkasan administrator willresultin immediate termination of the user account. 7.Authorized users only may view automated information obtainedviathe agreement.Nouserwilldisseminateorprovide information to non-law enforcement persons.Any non-law enforcement request for information willbe forwarded to the agencies Records Unit as a public record request. RELIABILITY -ThePoliceDepartmentmakesno warranties of anykind, whether expressed orimplied,forthe service itis providing.South Miami Police Department willnotbe responsible forany damages you suffer.This includes loss of data resulting from delays,non-deliveries,mis-deliveries,or service interruptionscausedbyitsown negligence oryourerrorsor omissions.Useofany information obtainedviathePolice Department's computer andnetworkisat yourownrisk.SouthMiamiPoliceDepartmentdeniesanyresponsibilityforthe accuracyorquality of informationobtainedthroughitscomputernetwork services. 9.INDEMNITY-Theuser specifically agreestoindemnifythePoliceDepartment orany if itsemployeesforanyloss,costs,ordamages,includingreasonable attorneys'feeincurredbytheUserorSouthMiamiPoliceDepartmentandtheir employeesrelatingtoor arising outofanybreech of thisagreement. VII.EXCEPTIONS OF TERMS AND CONDITIONS -All terms and conditions as statedinthisdocumentareapplicabletoSouthMiamiPoliceDepartmentandall subscribers.These terms and conditions reflect theentire agreement ofthe parties and supersede allpriororalor written agreements and understandings ofthe parties. Thesetermsandconditionsshallbegovernedand interpreted inaccordancewiththe laws of the State of Florida. Summary: In review,applicants are advised that South Miami Police Department computer system and associated networkis provided forthe specific purpose of supporting the mission goalsand objectives ofthelaw enforcement community.All users are expected to abide bythe provisions of this agreement. I understand andagreetofollowthetermsand conditions oftheabove agreement,and furthermore recognize that failure to comply with the conditions ofthis agreement may cause termination of the account.
